NATIONAL AERONAUTICS AND SPACE ADMINISTRATION

JOHN F. KENNEDY SPACE CENTER

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION OVER $100,000

1. The Mechanical Division – Mechanical and Civil Systems Branch (NE‐M1) at John F. Kennedy Space

Center (KSC), FL requires an Explosion Proof Vertical Mast Lift to be used as part of the Mobile Launder

Handling and Access (MLHA) Subsystem for use in support of Space Launch Systems (SLS) processing activities.

2. The nature and/or description of the action being approved:

This justification provides the rationale for contracting by other than full and open competition with

Man Lift Manufacturing Company (MLM), Cudahy, WI (CAGE code 1XD86), for the acquisition of a

MVL12EX1 Explosion Proof Vertical Mast Lift.

3. Description of the supplies or services required (including the estimated value):

This action is for the procurement of one (1) MVL12EX1 Explosion Proof Vertical Mast Lift for a total estimated cost of with an estimated lead time of 26 weeks for delivery after receipt of award.

4. Statutory authority permitting other than full and open competition:

The statutory authority which permits this procurement is 10 U.S.C. 2304(c)(1) as implemented by

Federal Acquisition Regulation (FAR) 6.302‐1 – Only one responsible source and no other supplies or services will satisfy Agency’s requirements.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:

MLM specializes in the design and manufacture of mobile personnel lifts that can be used in standard industrial environments and in hazardous and explosive environments. They have provided certified work lifts to KSC and to Department of Defense customers in prior procurement activities. MLM has a commercially available work lift that will be certified for use in explosive environments. MLM is the only source who can manufacture and deliver this unit. MLM does not have authorized distributors.

The KSC Authority Having Jurisdiction (AHJ) has approved the use of this product in the designated hazardous environments in support of Space Launch System (SLS) integrated operations. MLM’s

Explosion Proof Vertical Mast Lift was chosen as a solution for the Core Stage Engine RS‐25 Internal

Access requirement because the product mobility and lifting mechanisms meets the Agency’s design requirements, with slight modification to the personnel basket, and certification requirements within the Agency’s subsystem schedule limitations.

MLM is the only manufacturer of a work lift that meets the Agency’s needs. The explosion proof certification testing has been completed successfully by the certifying company Factory Mutual (FM).

MLM is waiting the receipt of the official certification. This product will be certified for use in Class I, Division 1, Group D areas (explosive environments). The certification will be in place prior to delivery of the product.

No other manufacturer is pursuing explosion proof certification or have an explosion proof certified man lift that meets the Agency’s needs. Due to cost and timeframe of redesigning and obtaining an explosion proof certification, the Agency does not expect any other manufacturer can support this procurement in a timeframe that meets the Agency’s needs.

6. Description of the efforts made to ensure that offers are solicited from as many potential sources as practicable:

The proposed acquisition will be synopsized in the Federal Business Opportunities (FedBizOpps) as required by FAR 5.2. Any additional sources identified through the synopsis procedure will receive due consideration as prescribed by law.

7. Determination by the Contracting Officer (CO) that the anticipated cost to the Government will be fair and reasonable:

The CO has determined that the anticipated cost to the Government will be fair and reasonable. The proposed company has previously contracted with the Federal Government; therefore, has an understanding of the requirements to demonstrate their proposed price is fair and reasonable. A proposal analysis will be performed in accordance with FAR 15.404 to ensure that the final price is fair and reasonable.

8. Description of the market survey conducted and the results, or a statement of the reasons a market survey was not conducted:

A trade study was completed to assess options for the Handling & Access (H&A) Ground Support

Equipment (GSE). Two lifts were considered but later determined to be poor choices because additional modification were still necessary to meet the physical parameters, as well as to meet the proper hazardous design requirement followed by a lengthy certification process by a third party vendor. The certification process includes the following: (a) designs and component selections are first review by FM for compliance with NFPA codes; (b) the designs must be approved by FM; (c) post fabrication, detailed testing is performed to verify performance and applicable mitigations for intended environments; (d) following successful testing activities, formal documentation and certification is generated and sent to the lift manufacturer. The certification process has been demonstrated to take 2 years or more.

Therefore, considering a lift that requires redesign in order to meet our design and certification requirements could not be completed in a timeframe to support the program milestones. If the program milestones are not maintained, SLS integration activities will be negatively impacted.

Following market research on existing commercially available man lifts, MLM was determined to be the only company that provided the closest solution (MVL12EX1). This product met all of the design requirement except for a slightly different hazardous group explosive criteria and a larger basket size than the allowable space per the design requirement. It was determined that this product will exceed the safety requirements needed.

KSC AHJ approved the use of this product, with only the basket modification, in the designated hazardous environments. A performance specification was approved to detail basket modifications required. After the market survey, it was determined that no other sources were available that could make the MVL12EX1 Explosion Proof Vertical Mast Lift.

9. Other facts supporting the use of other than full and open competition, such as:

This acquisition is limited to the identified source as no other source possess a certified lift, or it is pending official certification by FM, which can meet the Agency’s need. The certification process has been demonstrated to take 2 years or more which cannot support the program milestones.

10. A listing of sources, if any, that expressed in writing an interest in the acquisition:

To date, no other sources have expressed a written interest in this acquisition. All notices required by

FAR 5.2 shall be published, and any proposals received shall be considered.

11. A statement of the actions, if any, the Agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:

The Agency continually attempts to overcome barriers to competition by analyzing different source that might be qualified for each acquisition. The Agency will reassess the capability of the market in subsequent acquisitions for this product.

Based on the information above, Man Lift Manufacturing Co. is the only available source that can meet project requirements. I certify that the supporting data presented in this justification is complete and accurate.
