JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SOLE SOURCE

The Engineering’s Mechanical Division – Hydrocarbon Propulsion and Fluid System

Branch (NE-M4) at John F. Kennedy Space Center (KSC), FL requires installation of new Coriolis flow meters in ground service panels, hard lines to vehicle interfaces, and cable interface plates for the new Design Revision C associated with the KSC spacecraft offline processing element hypergolic ground support integrated system.

The flow meters, interface plates, associated tubing and components are part of the modification installation of Spacecraft Offline Processing hypergol integrated ground equipment for Orion Servicing. The new less than 1 torr vacuum requirement for Orion

CM pre-flight contingency de-service with intent to re-service requires significant removal of long Teflon flex hose lengths replaced by permanently installed hard line followed by significantly shorter metal convoluted hose to insure least likelihood of vacuum pressure decay during 1 torr pull and lockup to monitor residual propellant flashing. Flow rate requirement changes drive the need to remove current Coriolis mass flow meters and exchange/install with new ones for the new mass flow range. These meters are Government Furnished Equipment (GFE). Fabrication and installation of cable plates support electrical changes associated with the fluid hardware for vacuum cart operation. The overall cumulative value of the modification installation is $52,625.29 with an estimated lead time of 4-6 weeks for delivery after receipt of order.

The statutory authority which permits this requirement is 10 U.S.C.2304(c)(1) as implemented by FAR 6.302-1(a)-- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements (sole source).

In accordance with FAR 13.106-1(b)(1), the circumstances of this contract action deem only one source, Precision Fabricating and Cleaning Company, Inc. (PFC), is available.

This modification installation is a continuation of the effort performed by Precision

Fabrication and Cleaning (PFC) under contract NNK08EB72B for delivery orders

NNK11EB41D, NNK11EB52D, NNK12EB41D, NNK12EC27D, and NNK14EB03D.

Fair opportunity was offered to all the Fluids GSE IDIQ contract holders to bid on the panel fabrications under Solicitations NNK11395165R, NNK11395203R, NNK12438678R, NNK12439137R, and NNK14526391R respectively. PFC was the only contract holder to submit a bid under each of these solicitations, and was awarded the delivery order associated with each solicitation. Consequently, all related hypergol equipment in this system was competitively bid, fabricated and installed by PFC, at best value for the government.

A market survey was not conducted because it was not practical to consider competition to PFC in this modification installation pertaining to a system where all of the previous work was performed by PFC with a remaining ~5% delta of modifications in this last increment of work to be performed. Although another company may be capable of performing the work, it would be cost prohibitive for that company to gain the specialized knowledge and experience necessary to process these parts, while PFC already possesses this experience by virtue of its performance on the original hypergol subsystem panel fabrication Delivery Orders.

Based on the information above, PFC is the only available source that can meet project requirements. I certify that the supporting data presented in this justification is complete and accurate.
