REQUEST FOR PROPOSAL

The National Institute of Standards and Technology (NIST) has a requirement for Charpy V-notch Specimens.

Attached is the Statement of Work (SOW) for solicitation NB647020-16-00814 for Charpy V-notch Specimens. Please submit a Proposal for the Charpy V-notch specimens which meet the requirements.

This RFP is conducted under the authority of FAR 12.6, with NAICS code 332999, having a Small Business Size Standard of

750 employees. This is a total small business set aside.

1. INSTRUCTIONS TO OFFERORS: The provision at 52.212-1, Instructions to Offerors—Commercial Items, applies to this acquisition. Offeror shall clearly demonstrate their ability to meet the technical requirements and deliverable schedule as outlined in this solicitation. Proposal shall include shipping cost. NIST reserves the right to ship under NIST provided account.

2. BASIC SUPPLIES: The contractor shall provide Charpy Specimens as required in the attached Statement of Work.

3. TYPE OF CONTRACT: A multiple award contract (MAC). Each awarded MAC is a Firm-Fixed, Indefinite Delivery Indefinite Quantity (IDIQ) contract that is expected to be awarded as a result of this RFP, and will include a Base Year and four option years, which will be exercised at the sole discretion of the Government.

4. PERIOD OF PERFORMANCE: The anticipated IDIQ Base Year (plus 4 Options) Period of Performance is as follows.

Actual performance periods will be identified at the time of award:

Base Period May 20, 2016 through May 19, 2017

Option Period One May 20, 2017 through May 19, 2018

Option Period Two May 20, 2018 through May 19, 2019

Option Period Three May 20, 2019 through May 19, 2020

Option Period Four May 20, 2020 through May 19, 2021

5. MAXIMUM CONTRACT VALUE AND MINIUMUM GUARANTEE:

a. MAXIMUM CONTRACT VALUE (CONSOLIDATED MULTIPLE AWARD):

The maximum contract value for the multiple award contracts (MAC) (consolidated total value all contracts) is $5,000,000.00 for the total 60-month performance period. If the contract performance period is extended utilizing FAR 52.217-8 Option to Extend Services, the maximum contract value shall increase by $300,000.00 for a total 6-month extension (Consolidated MAC).

b. MINIMUM GUARANTEE: The Minimum Guarantee for each MAC contract award is $2,000.00 for the Base Period and for each option period. The Government shall award the minimum guaranteed value no later than the last day of each awarded performance period.

6. TASK ORDERING PROCEDURES: Task Orders will be added to the IDIQ on an as needed basis.

A. A Task Order will be awarded to the Contractor that has the capability to fulfill the requirements and has the lowest price, which represents the best value to the Government.

B. The following personnel are authorized to issue Task Orders:

o NIST AMD Contracting Officers with the appropriate warrant level.

7. SCHEDULE OF SUPPLIES: The Schedule of Supplies is incorporated as a separate document titled Attachment B.

A. The quantities listed in the Schedule of Supplies are the Government’s best estimates based upon past experience. The contractor will be paid based upon the actual accepted supplies as provided in the Statement of Work.

8. BASIS OF AWARD: Award shall be made on technical acceptability and price, based upon the technical specifications as detailed within the attached statement of work.

9. EVALUATION CRITERIA: The provision at 52.212-2, Evaluation—Commercial Items, applies to this acquisition.

Evaluation of Technical Capability will be based on the information provided in the quotation. Documentation submitted in the quotation shall be evaluated to determine that the proposed supplies meet or exceed the Government’s minimum required specifications. Failure to clearly and unambiguously demonstrate this will result in an “unacceptable“ technical rating.

Award(s) will be made to the contractor(s) whose quotation(s) represents the best value to the Government. Best value will be determined by:

A. Technical Capability: The Government will evaluate the offeror's technical approach:

to determine the extent of its understanding of the requirements;

the ability of the proposed technical approach to successfully provide the necessary Charpy specimens;

for vendors that have provided Charpies in the past twelve months, confirmation that there have been no changes to their operation that would negatively affect performance of this requirement;

Prequalification in the Charpy program is a requirement of this RFP.

B. Past Performance: The Government will evaluate the Offeror’s and, if appropriate, its proposed subcontractors’ past performance information to determine its relevance to the current requirements and the extent to which it demonstrates that the offeror has successfully completed relevant contracts in the past three years.

In assessing the offeror’s past performance, NIST will evaluate the quality, timeliness and ability to control cost and schedule of past work, and the extent to which the offeror has performed work of a similar type, magnitude and complexity. The Government will assign a neutral rating to offerors with no relevant past performance. The government reserves the right to consider data obtained from sources other than those described by the Offeror in its proposal.

C. Price: The price evaluation will determine whether the proposed prices are fair and reasonable in relation to the solicitation requirements.

Relative Importance of Factors: If Technical Capability and Past Performance are approximately equal, best value will be determined by price.

10. REPRESENTATIONS AND CERTIFICATIONS: Offerors must electronically complete FAR provision 52.212-3, Offeror Representations and Certifications—Commercial Items, at www.SAM.gov before submitting the quotation.

After reviewing the SAM database information, the offeror verifies by submission of this offer that the representation and certifications currently posted electronically at FAR 52.212-3, Offeror Representations and Certifications—Commercial Items, have been entered or updated in the last 12 months, are current, accurate, complete, and applicable to this solicitation (including the business size standard applicable to the NAICS code referenced for this solicitation), as of the date of this offer and are incorporated in this offer by reference (see FAR 4.1201), except for paragraphs ____________.

11. ADDITIONAL INFORMATION:

A. The primary Government Point of Contact (POC) for this solicitation is Chendra Conklin, Contracting Officer, at chendra.conklin@nist.gov.

B. Proposals in response to this solicitation must be received via email by the Primary POC no later than Friday, February 19, 2016 at 3:00 pm Mountain.

C. All questions regarding this solicitation must be received via email to primary POC no later than Wednesday, January 27, 2016 at 2:00 pm Mountain. No phone calls will be accepted.

D. All Proposals MUST comply with the submission requirements or they may be rejected as non-responsive, and, accordingly, not be evaluated. Electronic responses preferred.

E. Offerors may submit pricing for one or more items. The Offeror should only submit pricing on the Schedule of Supplies (Attachment B) and Pricing Template (Exhibit 1) for the Supplies you are submitting a quote(s) for.

The Government will award a fixed price IDIQ based on the following factors: Technical capability (capability of the item offered to meet the agency need), price, and past performance. Technical capability will be evaluated by how well the proposed products meet the Government requirement.

FAR 52.209-1 Qualification Requirements

(a) Definition. “Qualification requirement,” as used in this clause, means a Government requirement for testing or other quality assurance demonstration that must be completed before award.

(b) One or more qualification requirements apply to the supplies or services covered by this contract. For those supplies or services requiring qualification, whether the covered product or service is an end item under this contract or simply a component of an end item, the product, manufacturer, or source must have demonstrated that it meets the standards prescribed for qualification before award of this contract. The product, manufacturer, or source must be qualified at the time of award whether or not the name of the product, manufacturer, or source is actually included on a qualified

Offerors should contact the agency activity designated below to obtain all requirements that they or their products or services, or their subcontractors or their products or services, must satisfy to become qualified and to arrange for an opportunity to demonstrate their abilities to meet the standards specified for qualification.

(d) Even though a product or service subject to a qualification requirement is not itself an end item under this contract, the product, manufacturer, or source must nevertheless be qualified at the time of award of this contract. This is necessary whether the Contractor or a subcontractor will ultimately provide the product or service in question. If, after award, the Contracting Officer discovers that an applicable qualification requirement was not in fact met at the time of award, the Contracting Officer may either terminate this contract for default or allow performance to continue if adequate consideration is offered and the action is determined to be otherwise in the Government’s best interests.

(e) If an offeror, manufacturer, source, product or service has met the qualification requirement but is not yet on a qualified products list, qualified manufacturers list, or qualified bidders list, the offeror must submit evidence of qualification prior to award of this contract. Unless determined to be in the Government’s interest, award of this contract shall not be delayed to permit an offeror to submit evidence of qualification.

(f) Any change in location or ownership of the plant where a previously qualified product or service was manufactured or performed requires reevaluation of the qualification. Similarly, any change in location or ownership of a previously qualified manufacturer or source requires reevaluation of the qualification. The reevaluation must be accomplished before the date of award.

FAR 52.209-4 First Article Approval -- Government Testing

(a) The Contractor shall deliver 100 Specimens of each Lot to the Government at NIST, 325 Broadway, Boulder, CO 80305 for first article tests. The shipping documentation shall contain this contract number and the Lot identification.

The characteristics that the first article must meet and the testing requirements are specified elsewhere in this contract.

(b) The Contracting Officer’s Representative or Technical Point of Contact shall notify the Contractor, in writing, of the conditional approval, approval, or disapproval of the first article. The notice of conditional approval or approval shall not relieve the Contractor from complying with all requirements of the specifications and all other terms and conditions of this contract. A notice of conditional approval shall state any further action required of the Contractor. A notice of disapproval shall cite reasons for the disapproval.

(c) If the first article is disapproved, the Contractor, upon Government request, shall submit additional first articles for testing. After each request, the Contractor shall make any necessary changes, modifications, or repairs to the first article or select another first article for testing. The Contractor shall furnish any additional first article to the Government under the terms and conditions and within the time specified by the Government. The Government reserves the right to require an equitable adjustment of the contract price for any extension of the delivery schedule or for any additional costs to the Government related to these tests.

(d) If the Contractor fails to deliver any first article on time, or the Contracting Officer’s Representative or Technical Point of Contact disapproves any first article, the Contractor shall be deemed to have failed to make delivery within the meaning of the Default clause of this contract.

(e) Unless otherwise provided in the contract, the Contractor --

(1) May deliver the approved first article as a part of the contract quantity, provided it meets all contract requirements for acceptance and was not consumed or destroyed in testing; and

(2) Shall remove and dispose of any first article from the Government test facility at the Contractor’s expense.

(f) If the Government does not act within the time specified in paragraph (b) or (c) of this clause, the Contracting Officer shall, upon timely written request from the Contractor, equitably adjust under the Changes clause of this contract the delivery or performance dates and/or the contract price, and any other contractual term affected by the delay.

(g) The Contractor is responsible for providing operating and maintenance instructions, spare parts support, and repair of the first article during any first article test.

(h) Before first article approval, the acquisition of materials or components for, or the commencement of production of, the balance of the contract quantity is at the sole risk of the Contractor. Before first article approval, the costs thereof shall not be allocable to this contract for

(1) progress payments, or

(2) termination settlements if the contract is terminated for the convenience of the Government.

(i) The Government may waive the requirement for first article approval test where supplies identical or similar to those called for in the schedule have been previously furnished by the Offeror/Contractor and have been accepted by the Government. The Offeror/Contractor may request a waiver.

(j) The Contractor shall produce both the first article and the production quantity at the same facility.

FAR 52.211-16 Variation in Quantity

(a) A variation in the quantity of any item called for by this contract will not be accepted unless the variation has been caused by conditions of loading, shipping, or packing, or allowances in manufacturing processes, and then only to the extent, if any, specified in paragraph (b) of this clause.

(b) The permissible variation shall be limited to:

3% Percent increase

2% Percent decrease

This increase or decrease shall apply to the total quantity of each lot.

FAR 52.216-18 Ordering

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from March 20, 2016 through March 29, 2017; then through March 29, 2021 providing all options are exercised.

(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.

(c) If mailed, a delivery order or task order is considered “issued” when the Government deposits the order in the mail.

Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule.

FAR 52.216-19 Order Limitations

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than 1200 Specimens, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor --

(1) Any order for a single item in excess of 2400 Specimens;

(2) Any order for a combination of items in excess of 4800 Specimens; or

(3) A series of orders from the same ordering office within 15 days that together call for quantities exceeding the limitation in subparagraph (b)(1) or (2) of this section.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 10 days after issuance, with written notice stating the Contractor’s intent not to ship the item (or items) called for and the reasons.

Upon receiving this notice, the Government may acquire the supplies or services from another source.

FAR 52.216-22 Indefinite Quantity

(a) This is an indefinite-quantity contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies and services specified in the Schedule are estimates only and are not purchased by this contract.

(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause.

The Contractor shall furnish to the Government, when and if ordered, the supplies or services specified in the Schedule up to and including the quantity designated in the Schedule as the “maximum.” The Government shall order at least the quantity of supplies or services designated in the Schedule as the “minimum.”

(c) Except for any limitations on quantities in the Order Limitations clause or in the Schedule, there is no limit on the number of orders that may be issued. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

(d) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if the order were completed during the contract’s effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after March 19, 2017.

FAR 52.217-6 Option for Increased Quantity The Government may increase the quantity of supplies called for in the Schedule at the unit price specified. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days of contract expiration.

Delivery of the added items shall continue at the same rate as the like items called for under the contract, unless the parties otherwise agree.

FAR 52.217-8 Option to Extend Services The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days of contract expiration.

FAR 52.217-9 Option to Extend the Term of the Contract

(a) The Government may extend the term of this contract by written notice to the Contractor within 1 day; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years.

CAR 1352.201-72 Contracting Officer's Representative (COR).

(a) Willa Mayns is hereby designated as the Contracting Officer's Representative (COR). The COR may be changed at any time by the Government without prior notice to the contractor by a unilateral modification to the contract. The COR is located at:

(b) The responsibilities and limitations of the COR are as follows:

(1) The COR is responsible for the technical aspects of the contract and serves as technical liaison with the contractor. The COR is also responsible for the final inspection and acceptance of all deliverables and such other responsibilities as may be specified in the contract.

(2) The COR is not authorized to make any commitments or otherwise obligate the Government or authorize any changes which affect the contract price, terms or conditions. Any contractor request for changes shall be referred to the Contracting Officer directly or through the COR. No such changes shall be made without the express written prior authorization of the Contracting Officer. The Contracting Officer may designate assistant or alternate COR(s) to act for the COR by naming such assistant/alternate(s) in writing and transmitting a copy of such designation to the contractor.

CAR 1352.215-70, Period of Performance

(a) The period of performance of this contract is from March 20, 2016 through March 19, 2017. If an option is exercised, the period of performance shall be extended through the end of that option period.

(b) The option periods that may be exercised are as follows:

CAR 1352.216-74 Task orders.

(a) In task order contracts, all work shall be initiated only by issuance of fully executed task orders issued by the Contracting Officer. The work to be performed under these orders must be within the scope of the contract. The Government is only liable for labor hours and costs expended under the terms and conditions of this contract to the extent that a fully executed task order has been issued and covers the required work and costs. Charges for any work not authorized shall be disallowed.

(b) For each task order under the contract, the Contracting Office shall send a request for proposal to the contractor(s).

The request will contain a detailed description of the tasks to be achieved, a schedule for completion of the task order, and deliverables to be provided by the contractor.

(c) The contractor shall submit a proposal defining the technical approach to be taken to complete the task order, work schedule and proposed cost/price.

(d) After any necessary negotiations, the contractor shall submit a final proposal.

(e) Task orders will be considered fully executed upon signature of the Contracting Officer. The contractor shall begin work on the task order in accordance with the effective date of the order.

(f) The contractor shall notify the Contracting Officer of any instructions or guidance given that may impact the cost, schedule or deliverables of the task order. A formal modification to the task order must be issued by the Contracting Officer before any changes can be made.

(g) Task orders may be placed during the period of performance of the contract. Labor rates applicable to hours expended in performance of an order will be the contract rates that are in effect at the time the task order is issued.

(h) If multiple awards are made by the Government, the CO shall provide each awardee a fair opportunity to be considered for each task order over the micro-purchase threshold unless one of the exceptions at FAR 16.505(b) applies.

CAR 1352.216-75 Minimum and maximum contract amounts.

The Minimum Guarantee for each MAC contract award is $2,000.00 for the Base Period and for each option period. The Government shall award the minimum guaranteed value no later than the last day of each awarded performance period.

The maximum contract value for the multiple award contracts (MAC) (consolidated total value all contracts) is $5,000,000.00 for the total 60-month performance period. If the contract performance period is extended utilizing FAR 52.217-8 Option to Extend Services, the maximum contract value shall increase by $300,000.00 for a total 6-month extension (Consolidated MAC).

CAR 1352.216-76 Placement of orders.

(a) The contractor shall provide goods and/or services under this contract only as directed in orders issued by authorized individuals. In accordance with FAR 16.505, each order will include:

(1) Date of order;

(2) Contract number and order number;

(3) Item number and description, quantity, and unit price or estimated cost or fee;

(4) Delivery or performance date;

(5) Place of delivery or performance (including consignee);

(6) Packaging, packing, and shipping instructions, if any;

(7) Accounting and appropriation data;

(8) Method of payment and payment office, if not specified in the contract;

(9) Any other pertinent information.

(b) In accordance with FAR 52.216–18, Ordering, the following individuals (or activities) are authorized to place orders against this contract:

NIST LOCAL-39 MARKING/PACKING INSTRUCTIONS

(1) If the total contract/order includes multiple quantities of the same or like item(s), segregated as separate CLIN/Item numbers, deliverables shall be packed accordingly. Each individual Package / container in the shipment shall include deliverables on a per- CLIN or Item basis.

(2) For each shipment made under this contract/order, the Contractor shall furnish itemized packing list(s), enumerating the specific contents of each shipping container and what specific individual components constitute a full and complete "unit" for each bid item. The packing list shall include the brief description of each item found in the Schedule. If more than one container is required for each unit, each container should be marked accordingly, e.g., "Box 1 of 2," "Box 2 of 2," and the boxes, where feasible, should be taped or shrink-wrapped together as an issuable unit.

(3) The contract number AND CONTRACT LINE ITEM NUMBER (CLIN) OR ORDER ITEM NUMBER shall be placed on the exterior of all containers.

NIST LOCAL-40 BILLING INSTRUCTIONS FOR DELIVERY/TASK ORDERS

(a) NIST prefers electronic Invoice/Voucher submissions and they should be emailed to INVOICE@NIST.GOV.

(b) Each Delivery/Task Order Invoice or Voucher submitted shall include the following:

(1) Contract Number; identified in Block 2 of the OF347.

(2) Delivery/Task Order number identified in Block 3 of the OF347.

(3) Contractor Name and Address.

(4) Date of Invoice.

(5) Invoice Number.

(6) Amount of Invoice and Cumulative Amount Invoiced to-date.

(7) Contract Line Item Number (CLIN).

(8) Description, Quantity, Unit of Measure, Unit Price, and Extended Price of Supplies/Services Delivered.

(9) Prompt Payment Discount Terms, if Offered.

(10) Any other information or documentation required by the contract.

(c) In the event electronic submissions are not used, the Contractor shall submit an original invoice or voucher in accordance with paragraph (b) above to the address identified in Block 21 of the OF347.
