JUSTIFICATION AND APPROVAL (J&A)

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Department of the Navy, Naval Facilities Engineering Systems Command Southeast (NAVFAC SE), Jacksonville, Florida.

2. Description of the Action Being Approved.

Approval is sought to increase the contract maximum not-to-exceed (NTE) amount for the Professional Architect and Engineering (A/E) Services Indefinite Delivery Indefinite Quantity contract (IDIQ) by $7,500,000, thereby increasing the total NTE amount to $54,500,000.

The IDIQ was solicited as a Small Business Set-Aside. It was awarded to the Schmidt-Prime Group, LLC (Schmidt-Prime) located in Pensacola, FL on 20 November 2019. The contract is for a period of five (5) years, with a contract completion date of 19 November 2024. Approval is sought to engage the specific A/E for additional design work to complete two projects from two pre-negotiated options that support the Powertrain Testing and Examination multi-phase project at Naval Air Station Corpus Christi Army Depot (NASCCAD). The Task Orders are N6945023F0404 and N6945021F0804: the first for completion of the design from 35% to Final Design as the Designer of Record and post award construction services (PCAS) for Phase V of the FY 2025 Army MILCON Project P-71597 for a new Aircraft Component Repair Shop and, the second for the documents supporting the future demolition of the existing facility in the complex at NASCCAD in Corpus Christi, Texas.

3. Description of Supplies/Services.

NAVFAC SE procured an A/E IDIQ for the Southeast Area of Responsibility (AOR), providing professional design services to include labor, travel and other direct costs necessary to perform projects in the $200,000 - $30,000,000 task order range. Although this contract is primarily for use within the Southeast AOR, the contract AOR can extend beyond Southeast if necessary. The funding for the requirements detailed in Paragraph 2, will be Army MILCON, with $6M planned for FY 2024 and $1.5M for FY 2025.

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1), source and no other services will satisfy agency requirements for efficient completion of the design efforts that were completed to 35% on 19 June 2023. Awarding to someone else would result in a substantial duplication of cost to the Government that is not expected to be recovered through competition and unacceptable

5. Rationale Justifying Use of Cited Statutory Authority.

Based upon the awards already made under this contract, pending PCAS options, planned future requirements and a planned reserve amount, it is determined that an additional $7,500,000 in capacity is required to meet the full requirements for these two task orders with capacity for change.

6. Description of Efforts Made to Solicit Offers from as Many Offers as Practicable.

The A/E IDIQ was competed as a total small business set-aside. In accordance with FAR 6.303 and Department of Defense FAR Supplement 206.302-1, only one responsible source and no other services will satisfy agency requirements, a sources sought notification was posted to SAM.gov for 14 days on 24 March 2023. Five firms responded to the notification and two firms were determined to be qualified to perform the work. The two qualified firms were considered;

however, use of either firm would duplicate costs and/or further delay the completion date as discussed in Paragraph 5.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

NAVFAC SE will pursue/investigate business opportunities other than the sole-source as new requirements. A new small business $30,000,000 A/E IDIQ solicitation is in rate negotiations with a projected award timeframe of October 2023. A second unrestricted $90,000,000 A/E IDIQ solicitation has completed the slate/selection process with a projected award timeframe of December 2023. Also, a new small business $99,000,000 A/E IDIQ solicitation was received in July 2023 for evaluation and selections. NAVFAC SE will take appropriate actions that promote competition and small business goals that are in the best interests of the agency, stakeholders, and expenditure of tax payer dollars. Further, NAVFAC SE is in the planning stages for an additional five (5) A/E IDIQ instruments with a not-to-exceed value of $495,000,000 for the second half of FY 2024 and FY 2025.
