FAR 52.212-2 - EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES

(NOV 2021)

(a) The Government intends to award a Firm-Fixed-Price (FFP) contract resulting from this RFQ to the responsible Offeror whose offer, conforming to the RFQ, provides the best value to the Government, all factors considered.

"Best value" means the expected outcome of an acquisition that, in the Government's estimation, provides the greatest overall benefit(s) in response to the requirement. The Offeror is advised that the proposal meeting the solicitation requirements with the lowest price may not be selected for an award if award to a higher priced Offeror is determined to be more beneficial to the Government.

(b) Quotes will be evaluated using the following factors to select the quote that provides the best value:

(1) Factor 1 –Technical Capability - Certifications

The Quote will be evaluated to determine if the Quoter has submitted the following required documentation:

CAGE Code and/or UEI number (Reference 52.212-3 – Requirement to have an active SAM registration)

This Factor will be evaluated as Pass/Fail as stated in Table 1 below.

Table 1 - Technical Acceptable/Unacceptable Ratings

Acceptable Quote clearly meets the minimum requirements of the solicitation.

Unacceptable Quote does not clearly meet the minimum requirements of the solicitation.

NOTE: All quoters receiving a rating of “Acceptable” in Technical Capability will then be evaluated on Past Performance and Price. Any quoter rated “Unacceptable” in Factor 1 will not be evaluated further.

Past Performance and Price will be subject to the best value trade-off process. Past Performance is more important than price.

(2) Factor 2 – Past Performance

The purpose of the past performance evaluation is to allow the Government to assess the Quoter’s ability to perform the effort described in this RFQ, based on the Quoter’s demonstrated recent and relevant past performance.

If a Quoter has no recent/relevant past performance record, or if a Quoter’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned, the Quoter may not be evaluated favorably or unfavorably on Factor 2. In this case, the Quoter’s past performance will be assigned a rating of ‘Neutral Confidence.’

(i) The first part of the evaluation is to evaluate the recency of the offeror’s past performance. Past performance will be considered recent if the work has been performed within three (3) years before the RFQ release date.

(ii) The second part of the evaluation is to evaluate the relevance of the offeror’s past performance. To be considered relevant, the offeror’s past performance information will be assessed on the similarity of the scope, magnitude, and complexity of the Offeror’s prior or ongoing contracts to this RFQ’s performance requirements.

The Government will evaluate Past Performance relevancy as per Table 4 below:

Table 4 - Past Performance Relevancy Rating Method

Adjectival Rating Description

Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires

Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

(iii) The third part of the evaluation is to evaluate the overall quality of the offeror’s past performance for a confidence assessment rating. The Government will evaluate confidence as per Table 5 below:

Table 5 - Performance Confidence Assessments Ratings

Adjectival Rating Description Substantial Confidence

Based on the Quoter’s recent/relevant performance record, the Government has a high expectation that the Quoter will successfully perform the required effort

Satisfactory Confidence

Based on the Quoter’s recent/relevant performance record, the Government has a reasonable expectation that the Quoter will successfully perform the required effort

Neutral Confidence

No recent/relevant performance record is available or the Quoter’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned

Limited Confidence

Based on the Quoter’s recent/relevant performance record, the Government has a low expectation that the Quoter will successfully perform the required effort

No Confidence Based on the Quoter’s recent/relevant performance record, the Government has no expectation that the Quoter will be able to successfully perform the required effort

The Government will use the Past Performance Information Sheets, Past Performance Questionnaires, and any information independently obtained from Government or commercial sources to evaluate past performance for each Quoter. The Government may verify past performance information and may contact some or all of the references provided, and may collect information through questionnaires and telephone interviews. Additional past performance information may be obtained from other sources available to the Government, to include, but not limited to, the Contractor Performance Assessment Reporting System (CPARS), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (ESRS), other databases, the Defense Contract Management Agency, and interviews with Government personnel.

(3) Factor 3 – Price

Price will not be assigned an adjectival rating but will be evaluated for completeness and reasonableness.

1. Completeness: All price information/data required in the RFQ has been submitted.

2. Reasonableness: Price is fully justified and supported and is considered fair under current market conditions. Reasonableness may be determined by comparison with the Government estimate, comparison with other Quotes received, or any other applicable price analysis technique outlined in FAR 13. The Contracting Officer must determine the Quoter’s price to be fair and reasonable in order for the Quote to be eligible for award.

The government reserves the right to determine which Quotes show the capability to meet the requirements of this solicitation. The government reserves the right to eliminate from further consideration those Quotes which are considered unacceptable and not capable of being made acceptable without major rewrite or revision.

EVALUATION OF PRICE

The Government will evaluate offers, for award purposes, by adding the price of all base period and option CLINs.

CONTRACTOR RESPONSIBILITY

To be eligible for award of a contract hereunder, a Quoter must be determined by the Contracting Officer to be a responsible prospective contractor in accordance with FAR 9.1.
