Limited Sources and Justification and Approval Under the Authority of FAR 6.302-1(c), Brand Name Only

BRAND NAME JUSTIFICATION

Requisition Number: N6247A43270028

1. Identification of the Contracting Activity and the Requiring Agency

The Contracting Activity is the General Services Administration (GSA), Federal Acquisition Service (FAS), Global Supply Chain Management Branch. The required activity is the Naval Air Station (NAVFAC SOUTHWEST) at Coronado, CA.

2. Nature/Description of Action

This Brand Name Justification (BNJ) is in response to a Requisition received from NAVFAC SOUTHWEST) for the one-time purchase of Trane HVAC Units:

This BNJ is being performed in accordance with 6.302-1(c). This acquisition is being procured against the open market: thus FAR Subpart 6.305(c) is being invoked to limit sources to only manufacturer: Trane.

3. Description of Supplies and Services

In accordance with agency objectives, the government has a need to procure the Trane HVAC Unit to meet the agency’s needs as outlined in this document.

4. Identification of Justification Rationale

The circumstances and rationale for limiting consideration to select contractors for award follows:

In accordance with FAR Part 8.405-6(b)(1), “Agency requirements shall not be written to require a particular brand, name, product...peculiar to one manufacturer, thereby precluding consideration of a product manufactured by another company.” An exception to this rule is allowed only if there is a written justification...essential to the Government’s requirement.

Additionally, this limited source justification will document that this requirement is essential to the Government’s requirements and the market research which indicated that no other brand is qualified to meet the Navy’s requirements.

5. Demonstration of the Unique Nature of the Required Supply

On December 2, 2024, the required agency submitted a Brand Name Justification Memorandum stating:

The basis for limiting the source for this acquisition is that the brand, Trane, will be able to fit the existing roof mounts. Another brand would require removing and installing a new HVAC system in the roof at significant cost and time to the government. Requested Trane units will fit to the existing roof, avoiding the cost and time of surveying the roof as opposed to replacing the existing units with its brand name.

Therefore, for this acquisition, the contracting activity is restricting the consideration to to include only sources that can provide Trane Part Numbers (P/N’s listed above).

6. Description of the Market Research Conducted

In accordance with FAR Part 6.303 and 6.304. The Customer has provided detailed market research that has been conducted to justify this RFQ as Brand Name only. Market research was conducted in November 2024. This research consisted of reviews of similar previous procurements and a market survey through Federal Supply Schedule contractors. The search engine utilized was the GSA Advantage catalog using the part numbers, description, and manufacturer. The aforementioned product, Trane, is the only system that can be installed in the Navy's facilities existing HVAC units without causing the government extra time or significant costs.

7. Statement of Actions to Overcome Barriers to Competition

Prior to any subsequent procurement the market will be reviewed to assess whether any other qualified sources are available and are able to meet the Government’s requirements.

8. Contracting Officer Certification and Approval

I certify that the justification for Other Than Full and Open Competition is accurate and complete to the best of my knowledge and belief. Based on the above, I hereby determine that it is in the best interest of the Government and most appropriate for this acquisition to be Brand Name.
