The purpose of this solicitation amendment is to:

I. Remove "this contract is to support funding for travel expenses and accommodations for NNSY representative to w itness performance testing at the contractor’s plant" from Section 7.5.1 of the Attachment (A) NNSY DWG 2310-286 20-Ton AC Unit Specif ication REV. B.

II. Modify Clause 52.212-2, Evaluation and Clause 52.212-1 (Addendum), Instructions to Offerors.

III. Extend the date/time specif ied for receipt of Offer to 14-March-2023, 5pm EST.

IV. All other terms and conditions remain unchanged and in full effect.

SECTION A - SOLICITATION/CONTRACT FORM

SECTION I - CONTRACT CLAUSES

The following have been modified:

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

- Technical Capability of the item offered meet the Government’s requirement specifications and certifications. Vendor shall provide descriptive literature of the unit being offered.

- Price

- Delivery Lead Time

The relative order of importance of the evaluation factors are in descending order.

Award(s) will be made for the technically acceptable item or combination of technically acceptable items that result in the lowest aggregate price to the Government.

The quoted prices of all technically acceptable items will be evaluated and the Contracting Officer shall assume, for making multiple awards, that $500 would be the administrative cost to the Government for issuing and administering each contract award under this Request for Quotation.

Technical Acceptability: Will be determined by reviewing the technical capability certification statement (per

Attachment C) and supporting descriptive literature submitted for each item (or specification) to ensure that all of the technical requirements identified are met. Technical acceptability is defined as follows:

Rating Description

Acceptable Quote meets all of the requirement capabilities, features and specifications identified.

Unacceptable Quote does not meet all of the requirement capabilities, features and specifications identified.

Failure to meet any technical requirement for an item (or specification) will make the quotation unacceptable for that item (or that specification).

If an item (or specification) is technically unacceptable, its price will not be considered for award.

Price: The estimated amount for each line item will be added together to determine the total estimated price which will become the evaluated price. The proposed price of the offeror will be evaluated based on price reasonableness;

and all pricing must be considered fair and reasonable as determined by the government. Price quote shall be held firm for sixty (60) days.

Delivery: The proposed delivery lead time will be evaluated based on most advantageous as determined by the

Government.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS

CLAUSE 52.212-1 ADDENDUM

In addition to FAR 52.212-1, “Instructions to Offerors – Commercial Items”, NAVSEA Service Contracts Division, Norfolk Naval Shipyard shall receive the following information no later than the closing date of the solicitation.

This requirement will be awarded using procedures under Federal Acquisition Regulations FAR Part 12 –

Acquisition of Commercial Items and FAR Subpart 13, Simplified Acquisition Procedures.

1) Interested vendors may send the quotation to the Navy by replying via email to chantay.c.johnson.civ@us.navy.mil. This requirement is 100% Small Business Set-Aside.

2) Proposal content and instructions when submitting an offer shall consist of:

a. Technical Capability (of the item offered meet the Government’s requirement specifications and certifications). Vendor shall provide descriptive literature of the item being offered.

b. Price Submission

c. Delivery Lead Time

d. Acknowledgement of any solicitation amendments – Return 1 copy with Blocks 8 and 15 completed

3) Technical Capability:

Vendor shall provide proof/certification that they are in compliance with the required certifications and qualifications outlined within the solicitation and attachments. The information provided should be presented in such a manner as to enable the government to make a thorough and complete evaluation and arrive at a sound determination as to whether or not the products proposed and described will satisfy the requirements of the Government as stated in this request for quote. NOTE: Vendor shall submit technical capability information/descriptive product literature SEPARATE from pricing.

4) Price Submission:

Vendor shall submit one original signed copy of the completed Standard Form (SF) 1449, and executed copies of all amendments (if applicable), as well as executed Representations and Certifications. Signed copies shall be submitted electronically via email to chantay.c.johnson.civ@us.navy.mil.

Quotes submitted shall be in accordance with (IAW) the schedule contained in the solicitation. Quotes shall be held firm for sixty (60) days.
