Subject: Replace PVI Boiler #2 Bldg. 3300 (Amendment # 1)

The following items define the scope/statement of work and general approach to the completion of the above referenced project. Revisions, if any, are in bold and eliminations from previous proposal are in strike thorough (thus not included as a part of this scope of work).

SCOPE OF WORK

1. Background. Boiler #2 out of service with no redundant heating back-up source until immediate repairs are complete.

2. Construction General Conditions:

2.1. All work to be completed at Buildings 3300 Davis Building, Quantico, VA 22134.

2.2. Contractor is responsible for all means, methods, supervision and coordination to produce a quality finished product. Time is of the essence, and this project shall be given due consideration and staffing. The contractor must provide all equipment, material, and labor necessary to complete scope of work, described herein.

2.3. Any discrepancy between the scope of work (SOW) and actual job conditions found during the project progress should be immediately reported to the CM/ET in writing.

2.4. In the case of inconsistencies, the contractor shall contact the CM, identify the inconsistency, and seek guidance. Contractor is responsible for providing any requests for information (RFI) in writing to the NAVFAC CM in order to clarify any and all portions of the work that may be in question.

2.5. Contractor agrees to warrant work for a period of 365 calendar days from the date of acceptance by NAVFAC. Warranty will be furnished in writing and must accompany Contractor’s final invoice.

2.6. Materials. All materials required for the entire project shall meet industry standards, shall be new, free from all defects, of the best grade and quality, and entirely satisfactory for the purpose intended and shall be furnished in sufficient quantities to prevent delay.

2.7. Construction Performance Period: no more than 120 calendar days. All work will be conducted during normal working hours. Regular Working Hours. The government’s regular (normal) working hours are from 0700 to 1630, Mondays through Fridays, except (a) federal holidays and (b) other days specifically designated by the Contracting Officer. Federal holidays are New Year’s Day, Martin Luther King Jr. Day, Presidents Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day and Christmas Day.

2.8. The Contractor must be aware that Quantico MCB is a controlled access installation, and as a result requires photographic identification and the potential of vehicle inspection in order to gain entrance onto the installation. Detention, delay, and or other challenges presented to the contract as a result of this fact are the sole responsibility of the contractor.

2.9. Work shall be carried out on consecutive days and completed within the aforementioned contract performance period.

2.10. The Contractor is to comply with local noise ordinances.

2.11. Safety in accordance with the Contractor’s Safety Program. The Contractor will furnish three copies of their safety program to the NAVFAC CM and/or ET upon request (a copy of this plan will be held by the CM and the Quantico MCB Safety Office). The contractor shall be responsible for safety of employees, and Government employees within the work site premises during all operations in accordance with all Government safety requirements and guidance (EM- 385-1-1) including the contractor providing and supervising the appropriate use of all personal protective equipment.

2.12. Any incident involving injury to Contractor’s employees or property damage must be immediately reported to the NAVFAC CM and ET as well as the Quantico MCB Safety Office.

2.13. Safety Requirements and Reports. During the performance of work under this contract, the Contractor shall strictly adhere to Environmental Protection Agency Regulations (EPA), Federal Occupational Safety and Health Regulations (OSHA), U.S. Army Corps of Engineers Safety and Health Handbook (EM- 385-1-1), as well as all applicable state and local requirements.

2.14. Fire Protection. The Contractor shall handle and store all combustible supplies, materials, waste and trash in a manner that prevents fire hazards to persons, facilities, and materials. Contractor must coordinate with the COR or KO to receive hot work permits from the Quantico MCB Fire Department.

2.15. Environmental Protection.

2.15.1. The contractor shall comply with all applicable federal, state, and local laws, and with the regulations and standards. All environmental protection matters shall be coordinated with the KO.

Inspection of any of the facilities operated by the Contractor may be accomplished by PWB Environmental Division and/or Safety personnel, or authorized officials on a no-notice basis at any time.

2.15.2. In event a regulatory agency assesses a monetary fine against the Government for violations caused by Contractor negligence, the Contractor shall reimburse the Government for the amount of that fine and other costs. The Contractor shall also clean up any oil spills that result from the Contractor’s operations. The Contractor shall comply with the instructions from the Quantico MCB Industrial Hygienist with respect to avoidance of conditions which create a nuisance or which may be hazardous to the health of military of civilian personnel.

2.15.3. Air Program. Coatings must comply with VOC limits in 9 VAC 5-45, Article 5. Mastic texture coatings are limited to 300 grams VOC per liter of product. Primers, sealers, and undercoats are limited to 200 grams VOC per liter of product.

2.15.4. The contractor shall provide a list of all Hazardous Materials to be used on the Post and a MSDS shall be provided for each material listed.

2.16. Before completion of work each day, the Contractor shall secure all supplies, materials and equipment.

Contractor shall also remove all scrap, debris, etc. and dispose off-post, unless otherwise directed elsewhere in this SOW and leave the job site in a clean, orderly and safe manner each day.

2.17. Disposal.

2.17.1. Debris, rubbish, hazardous waste and unusable material resulting from the work under this contract shall be disposed of by the Contractor legally and in compliance with all regulations as may pertain at his expense off of Government property.

2.17.2. All recyclable materials; aluminum and metal cans, glass bottles and jars, plastic bottles, newspapers, cardboard, high grade paper, mixed paper, scrap metal, scrap lumber, pavement debris, and vegetation wastes shall be segregated, removed from the Post, and disposed of in accordance with Department of Defense recycling and solid waste management regulations.

2.17.3. Hazardous waste must be disposed of in accordance with the Resource Conservation and Recovery Act.

2.17.3.1. Hazardous Materials: Projects that are under contract: Materials that are contractor procured must be removed from base once job has been completed. You are not to leave it behind. A list of all Hazardous Materials USED for the project must be reported to NREA once job has been completed (list may be faxed to (703)784-4953). SDS (MSDS) must be kept on hand at all times and produced when requested.

2.17.4. To ensure compliance with EO 13514 waste diversion guidance, the contractor shall use the Construction Waste Management Report form to report the disposal of all recyclable materials, debris, rubbish, hazardous waste and unusable material resulting from the work under this contract through the CM/ET to NREA Solid Waste Program Manager. A copy of the report can be obtained from the NREA Solid waste manager.

2.18. Permits: The Contractor shall, without additional expense to the Government, obtain all appointments, licenses, and permits required for the prosecution of the work. The Contractor shall comply with all applicable federal, state, and local laws. Evidence of such permits and licenses shall be provided to the KO before work commences.

2.19. Notwithstanding any other provisions of this scope of work (SOW), the Contractor shall comply with applicable rules, laws, regulations and policies, in effect at Quantico MCB, and all US laws.

2.20. Contractor shall ensure they comply with any and all additional provisions as applicable to contractors working at Quantico MCB. The contractor is presumed to be fully aware and have full knowledge of any and all policies, procedures and requirements to work on this installation, and is to seek clarification on any specific provision that they are unclear about from the COR if this is not the case.

2.21. All Government design manual standards, the United Facilities Criteria (as posted on www.wbdg.org), the latest edition of the International Building Code (IBC) 2006, (inclusive of Section 1025, “Emergency Escape and Rescue”), and other applicable industry standards, or better, are to be complied with unless otherwise stated. The Authority Having Jurisdiction for the applicability of any and all code provisions is the FEAD and Quantico MCB

PWB.

2.22. Smoking will be prohibited anywhere on the Base so designated on Government property and at all times in such locations, smoking will be permitted in designated areas.

2.23. Work shall be completed in one construction phase.

2.24. Contractor will have access to all work areas at one time.

2.25. Contractor will be allowed to use Government restrooms; however, the Contractor will ensure they are cleaned after use to the satisfaction of the CM.

2.26. Government will provide a location convenient to the work for a temporary site storage container, if determined necessary.

2.27. Contractor will provide protection to all areas adjoining or within the area of the work that are not to be affected or damaged.

2.28. The contractor is fully and totally responsible for the condition of the work and the work site en masse until the work is formally accepted by the government. As a consequence, the contractor may be required to execute rework until such time as formal acceptance of the work is made by the government.

2.29. Contractor shall repair any and all damaged items as a result of his efforts not included in this SOW, to their original condition or better.

2.29.1. On-going site cleanup and final site restoration is required in this contract. Routine cleanup of the project will encompass all areas used by the contractor during construction.

2.29.2. The contractor will be held responsible to repair any damage to the structures, the site and/or property as part of this contract to the satisfaction of the Government.

2.29.3. If the work requires any shutdown or disruption of any utility/service outside of the immediate area of the work/the area under the contractor’s control, the Contractor shall provide at least 14 days’ notice prior to making any such disruption and follow any and all procedures provided by the PWB for such disruptions. To the extent possible, the contractor must note on his schedule planned shutdowns or disruptions that will be required as a part of the work (inclusive of timeframe and any logical connections to other tasks of the work).

2.30. The Contractor shall coordinate any oversized deliveries with the CM/ET in order to allow access to the installation through the proper gate.

2.31. Contractor is required to visit the site prior to submission of a proposal. Contractor is responsible and will execute such measurements and calculations to determine the quantities required to execute the work described herein for bidding, construction estimating, and work execution. The Government will make no guarantee or other confirmation of the applicable quantities, the Contractor makes these determinations at their own risk.

4. Selective Demolition:

4.1. The existing PVI #2 boiler shall be drained, disconnect supply/return, electrical, and breeching.

4.2 The existing PVI #2 boiler shall be disassembled.

4.3. The contractor shall remove the existing PVI #2 boiler from bldg. 3300 mechanical room and dispose of per the waste management plan. The contractor shall be responsible for locking out all equipment being removed or replaced.

8. Mechanical Work:

8.1. Install one (1) new HB Smith Model G28HE-8, with Power-flame C2-G-20A; LHL firing;

115V/1PH; Gas only burner Controls: 550LSV MR LWCO, L4079B MR Hi Limit, and operating control. (Or approved equal)

8.2. The new boiler shall be assembled and installed on the existing concrete pad, any insulation that was disturbed on piping shall be replaced, hydro test boiler and witnessed on-site by government personnel and install jacket.

8.3. The new boiler shall be filled and prepared for start-up, started and put in service

• Any insulation that was disturbed on piping shall be replaced.

8.4. The contractor shall have a burner technician perform a thorough start-up and combustion test.

8.5. Existing breeching shall be reconnected. (Note) the breeching circumference is 42” = approx. 12 diameter breeching and the boiler requires 12 breeching.

8.6. The contractor will be responsible for coordinating all work with the customer and Shop-51. All work will be completed while PVI Boiler #1 is on line unless outages are coordinated in advance with the customer and Shop-51.

9. Plumbing Work:

9.1. The contractor shall connect the gas train piping to existing gas line. Supply and return piping shall be installed and connected to the existing piping. Existing shut off valves shall be reused.

10. Electrical Work:

10.1. New burner shall be reconnected using existing electrical service.

10.2. The new burner panel shall be locally mounted not remote.

10.3. The contractor shall install new limit controls.

11. General Work:

11.1. The contractor shall be responsible for all parts, equipment and rentals necessary for completion of their work. Noise restrictions in this area will not apply. All items removed shall become the property of the contractor and shall be disposed of as per owner's instructions. All items which are not in direct support of the contract and to be stored on site by the contractor shall be removed from the job site immediately.

11.2. The contractor will be responsible for coordinating all work with NAVFAC, PWB and FMS Utility personnel. All outages will be coordinated in advance with NAVFAC, PWB and FMS Utility personnel.

11.3. The contractor shall develop and submit a waste management plan identifying all recyclable materials and disposal methods. All removals shall be disposed of and hauled off site on a daily basis. All items removed shall become the property of the contractor and shall be disposed of per the waste management plan. All items which are not in direct support of the contract and to be stored on site by the contractor shall be removed from the job site immediately. Hazmat abatement has not been identified and included in this scope of work. The contractor shall develop and submit a waste management plan identifying all recyclable materials and disposal methods. Noise restrictions in this area will not apply.

11.4. The contractor shall provide O&M manuals on the boiler equipment, follow manufacturer’s specifications for installation and service.

12. Construction/Product Submittals:

12.1. The contractor will certify that submittals meet the requirements of the plans, specifications, and the above SOW. The Contractor shall allow for no less than 14 calendar days for submittal review by the government.

THE CONTRACTOR SHALL NOT BE PERMITTED TO INSTALL ANY AND ALL ITEMS WITHOUT AN

APROVED SUBMITTAL MATCHING WHAT IS TO BE INSTALLED IN ALL RESPECTS. Submittal Logs will be provided. Shop drawings, product data, and samples will be submitted for all equipment and materials related to the project (written submittals will be sent in hard-copy form as well as electronically in Adobe Acrobat readable format to the COR):

52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL

EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)

(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.

(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.

(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction,'' and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.

(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the --

(1) Name, address, and telephone number of the subcontractor;

(2) Employer's identification number of the subcontractor;

(3) Estimated dollar amount of the subcontract;

(4) Estimated starting and completion dates of the subcontract; and

(5) Geographical area in which the subcontract is to be performed.

(e) As used in this Notice, and in any contract resulting from this solicitation, the "covered area" is MCB Quantico, VA.

252.232-7006 WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (JUN 2012)

(a) Definitions. As used in this clause--

Department of Defense Activity Address Code (DoDAAC) is a six position code that uniquely identifies a unit, activity, or organization.

Document type means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).

Local processing office (LPO) is the office responsible for payment certification when payment certification is done external to the entitlement system.

(b) Electronic invoicing. The WAWF system is the method to electronically process vendor payment requests and receiving reports, as authorized by DFARS 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(c) WAWF access. To access WAWF, the Contractor shall--

(1) Have a designated electronic business point of contact in the Central Contractor Registration at https://www.acquisition.gov; and

(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this Web site.

(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the ``Web Based Training'' link on the WAWF home page at https://wawf.eb.mil/.

(e) WAWF methods of document submission. Document submissions may be via Web entry, Electronic Data Interchange, or File Transfer Protocol.

(f) WAWF payment instructions. The Contractor must use the following information when submitting payment requests and receiving reports in WAWF for this contract/order :

The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.

Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.

WAGE DETERMINATION APPEALS PROCESS

1.) Has there been an initial decision in the matter? This can be:

* an existing published wage determination

* a survey underlying a wage determination

* a Wage and Hour Division letter setting forth a position on a wage determination matter

* a conformance (additional classification and rate) ruling

On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)

and 3.) should be followed.

With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
