About this file

This document provides a justification and approval for a sole source contract award and describes a related pre-solicitation notice. The justification and approval document is for a firm-fixed price contract to be awarded non-competitively to CEPEDA Associates for repair services of CO/H2 scrubbers and burners aboard a Virginia Class submarine. The services include removing, disassembling, reassembling, and repairing existing CO2 removal plant equipment. A sources sought notice received no responses. The pre-solicitation notice states that the Portsmouth Naval Shipyard intends to solicit and award a sole source contract to CEPEDA Associates for installation, repair and maintenance of the same scrubber and burner system aboard the submarine. The requirement is for the original equipment manufacturer, CEPEDA Associates, to perform the services as they own the proprietary drawings and are the only authorized party to conduct the work. The place of performance is Portsmouth Naval Shipyard, Kittery, Maine, and the period of performance is January 6, 2020 to May 20, 2020.

4. Statutory Authority Permitting Other Than Full and Open Competition

The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1), as implemented by Federal Acquisition Regulation (FAR) 6.302-1 (Only one responsible source and no other supplies or services will satisfy agency requirements).

5. Rationale Justifying Use of Cited Statutory Authority

0se of FAR 6.302-1 is appropriate when supplies or services are available from only one reasonable source that will satisfy agency requirements. This authority permits limiting the number of sources solicited by not soliciting this requirement on a full and open competition basis.

CEPEDA Associates is the Original Equipment Manufacturer (OEM) and owns the proprietary data - including drawings, material specifications/measurements, and processes -required to repair the CO/H2 Scrubbers and Burners System.

Said data, which is neither possessed by another vendor nor available to the Government, is critical to ensuring that the system is repaired in accordance with the Statement of Work.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Pursuant to FAR 5.201, a Sources Sought Notice was posted on the Government-wide Point of Entry (GPE) FedBizOps (FBO) on 11 October 2019. Said notice, which sought vendors with the capability to repair the CO/H2 Scurbbers and Burners Systems aboard a Virginia Class submarine, prescribed the following:

"This sources sought notice is a market research tool being utilized to identify potential and eligible firms capable of providing these services prior to determining the method of acquisition and issuance of a Request for Proposal (RFP). As such, all interested parties are encouraged to respond.

Information received will be considered solely for the purpose of determining whether or not to conduct a competitive procurement. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government." The Sources Sought Notice garnered no responses.
