PROPOSAL INQUIRY 1:

IN PAGE 20 OF THE RFP IN SECTION

C. PAST PERFORMANCE EVALUATION

The Contracting Officer is waiving Past Performance In accordance with FAR 15.304 (c)(3)(iii).

Past performance for this requirement would not benefit the selection of a qualified offeror. If a

Supplier is failing to supply electrical power, in accordance with the Italian regulatory agencies then their license is revoked. Any Offeror with a revoked license will not be considered. For this reason past performance is typically not used in the Italian competitive electrical market.

Should it refer to Spanish regulatory agencies?

Moreover, in exhibit (I) sample bank guarantee there are three times in which the detailed address is

Italian (legal seat, communications & legal jurisdiction). Is that correct or should it be Spanish addresses and jurisdictions?

GOVERNMENT RESPONSE 1:

Amendment will be issued to reflect SPANISH REGULATORY AGENCIES and update Exhibit

(I) Sample Bank Guarantee to reflect SPANISH ADDRESSES AND JURISDICTIONS.

PROPOSAL INQUIRY 2:

What is the name of the company that will sign the contract with us in representation of the

Government? We could only find the NIF N4001073H in the RFP. Would it be THE NAVY

EXCHANGE SUCURSAL EN ESPANA? This is one of the names of the company that appears on

Google if you search NIF N4001073H.

GOVERNMENT RESPONSE 2:

Naval Facilities Engineering Command Europe Africa Central (NAVFAC EURAFCENT) is the

United States Government agent delegated to procure electrical power services for and on behalf of

“THE NAVY EXCHANGE SUCURSAL EN ESPANA” with NIF N4001073H.

PROPOSAL INQUIRY 3:

(A): As stated in 5th paragraph of page 5 in article 4, the Price to offer shall not include the

“Aportación al Fondo Nacional para la Sostenibilidad del Sistema Eléctrico”. In case the Spanish

Government might approve the FNSSE, could it be possible to update unitary prices to take into account the FNSSE, or include this concept in the PT Pass Through?

- The purpose of this inquiry is to check if it is going to be possible invoicing this, once it would be approved by the Spanish Government.

(B): Possible change of Access Tariffs:

About the new CNMC 3/2020: these concepts can be updated for invoicing: standard losses, capacity payments, and ATR (Access Tariff), and the Ks will not be updated during the contract performance.

It is possible that the Spanish MINETAD wouldn´t update the Tariff structure till June the 1st.

regarding the new tariff structure and the new P1-P6 periods (6.2TD),

- We would like to clarify if it would be possible to adapt the unitary prices to take into account the new period’s structure, in case the current Tariff 6.2 was still in use for the beginning of this contract (1st of May). In this case, have the Government foreseen any specific procedure or would it be done by the vendor?

- We would like to clarify if it would be possible the submission of alternative offers (i.e.

with the 6.2 Tariff) in this tender is allowed, to be taken in case the MINETAD wouldn´t update the 6.2 Tariff on 1 May.

(C): Supply maintenance:

- Due that 30 March by 10:00 is on Eastern week, we don´t know how much time of offer´s validity is needed to make the Award. We need to know the last time the Award would be communicated (day, time), so we can give the prices that validity to be accepted.

GOVERNMENT RESPONSE 3:

(A). As reported under Art.4, pag. 5, future charges for “Aportación Fondo Nacional para la

Sostenibilidad del Sistema Eléctrico”, "FNSSE", are pass though charges. Under Art. 4, all listed pass-through charges are subject to variation as they are regulated by the Spanish Government, shall not be included in the firm-fixed offer price (precio fijo), and shall be charged in addition to it where applicable.

(B) US Government Request for Proposal has already been formulated in consideration of the new

CNMC 3/2020 (6.2TD) which should start on June 1st 2021. The Projected Consumption in Exhibit

D “Firm Fixed Price Form” already reflects the P1-P6 load profiling of 6.2TD. Therefore, all offers shall be submitted according to the new tariff structure and the new P1-P6 periods (6.2TD). Post-award unit price adjustments are not covered. Offerors shall take into account that start of the

6.2TD may be delayed but that the awarded offer price will be applied to the entire period of performance starting 1 May 2021. The US Government has considered that across the three-year period of performance, the longer 6.2TD period will significantly overweight any short 6.2 tariff period.

US Government shall not accept the offers referring to 6.2 Tariff nor alternative offers not referred to 6.2TD tariff.

(C) The pricing submission shall be on 30 March 2021 at 1000.

The offeror agrees to hold the prices in its offer for three (3) business days till 2 April 2021 at 1000.

The US Goverment anticipates award and communication to awardee no later than 1 April.
