JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Contractinq Activity: Department of the Navy, Military Sealift Command Norfolk
2. Description of Action Being Approved: The acquisition is conducted under the authority of GSA Multiple Award Schedule Program.
3. Description of Supplies/Services: Military Sealift Command (MSC) requires the services of two (2) Technical Representative for repairs to the four (4) SSTG's and two (2) LP and two (2) HP propulsion Turbines, originally installed by DeLaval.
4. Statutory Authority Permitting Other than Full and Open Competition: The statutory authority for this procurement is FAR Part 8.405-6 (c).
5. Rationale Justifying Use of Cited Statutory Authority: The four SSTG's and four Propulsion steam turbines installed on USS PONCE were manufactured and put into service by DeLaval Turbines 42 years ago. Based on the age of the steam turbines and previous work performed on the uss PONCE and similar U.S. Navy platforms there are only two responsible and competent sources; MI-Tech Inc. and TurboGen
| Consultants. | These two sources have over 60 years' experience working |
| on U S Navy steam Propulsion Plants and turbines between them. | They |
possess the required knowledge, expertise and access to parts for the
| antiquated steam propulsion and electrical power systems. | The turbine |
| repairs must be accomplished in 35 days. | These two sources provide |
the best possible solution to completing this critical work in such a
| short amount of time. | No other sources are known that have the ability to serve the required repair needs in addition to having the shipboard experience on these particular turbines without risking a |
| drastic loss in time and budget overruns. | To procure services from |
any other source besides the ones recommended could be catastrophic to the equipment and ultimately limit or eliminate the ship's ability to meet its mission. Based on previous work these are the only two viable sources to perform this type of repair.
The SSTG's and main propulsion turbines are considered critical equipment in accordance with SMS Procedure 10.6-002-01-AFSB REV 0.1. These two sources have access to the required parts, can provide the necessary Tech rep services that are required to perform this complex and critical work of the SSTG's and main propulsion turbines. Furthermore the Recommend sources have the necessary drawings and knowledge that a tech rep must have access to, due· to the complexity of the turbines.
The failure to obtain these Technical Services in a timely manner to facilitate installation may affect work progress, cause costly delays as well as disruption in the ship's mission capability. CASREP 14-007 was issued on #1 LP Turbine and is in need of repairs that require lifting the turbine casing. Lifting of a steam turbine casing is an extremely critical repair that must be done correctly. If mistakes are made during these repairs the implications could be considerable
| in time and funding. | The ships propulsion system could be severely |
| impacted for a significant amount of time affecting the ship's ability to perform its mission. | Therefore the equipment is too vital and too complex to not provide technical services. |
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable:
7. Determination of Fair and Reasonable Cost: The Contracting Officer has determined the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable pursuant to Federal Acquisition Regulations (FAR) Part 13.106-3 or 15.404-1, whichever is applicable.
8. Actions to Remove Barriers to Future Competition: No specific action is planned to overcome barriers to competition in subsequent procurement, other than synopsizing the requirements. If another potential source emerges, MSC will assess whether competition for future requirements is reasonable.
