JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC) - Norfolk.

2. Description of the Action Being Approved: This is a justification for work to be provided under Work Items listed below of the Statement of Work (SOW) for the POST SHAKEDOWN AVAILABILITY (PSA) and Dry Docking (DD) of the USNS MILLINOCKET (JHSV-3) under RFP N32205-14-R-4000. This justification is covering only the portion of the acquisition which an OEM Authorized Facility/Manufacturer/Representative is required and the approval level requirements will then only apply to that portion.

3. Description of Supplies/Services: MSC Norfolk requires Original Equipment Manufacturer (OEM) authorized technical field service representatives to accomplish the requirements of Work Items (WIs) 105, 108, 401, 501, 502, 503, 504, 507, 509, 603, 604, 605, 606, 904, 906, 910 and 911. For this 70 day PSA/DD availability will be funded utilizing FY 15 Operations & Maintenance funds.

4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C 2304 (c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1(a).

5. Rationale Justifying Use of Cited Authority:

WI 105: INSPECT FLIGHT DECK TIE DOWNS, WI 108: REPLACE COMPOSITE FIGHT DECK PANELS, WI 401: RENEW NAVIBS RADIO SAFETY SURVEY, WI 501: PERFORM ANNUAL STERN RAMP MAINTENANCE, WI 502:RIDE CONTROL SYSTEM BEARING INSPECTION, WI 503:PERFORM ANNUAL STORES CRANE MAINTENANCE, WI 504: A/Cs HEAT EXCHANGER CLEANING; WI 507: FUEL METER INSTALLATION VEGA TLI GROOM:600; WI 603: M.E.S. & LIFE RAFT CERTIFICATIO, WI 604: RESCUE BOAT AND DAVIT ANNUAL INSPECTION, WI 605: SCBA ANNUAL CERTIFICATION, WI 606: FIREFIGHTING SYSTEM CERTIFICATION, WI 904: CATHODIC MONITORING SYSTEM INSPECTION AND MAINT, WI 906: REMOVE AND INSPECT WATER JET, WI 910: UWH BLAS AND RE-COAT, WI 911: PAINT WATER JET INLET TUNNELS

a. WI 105, Flight Deck Tie Down Inspection

The work item requires the OEM to perform disassembly, inspection, reassembly and testing of all flight deck tie downs. Maintenance is required pending a failed visual inspection. The manufacturer of the tie downs is Alcoa; the work item specifies the OEM to perform the statement of work due to the unique nature of these aluminum cup and steel cross bar tie downs. Aloca OEMs may only be hired via the OEM. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.

These tie down assemblies are certified and approved by ABS and NAVAIR to meet all current standards and requirements. The details in assembly, disassembly and testing the tie down assemblies are provided in the attached work item reference drawing 2.1.1. The need for Alcoa to provide flight deck tie down services is required to maintain the NAVAIR certification of the flight deck.

b. WI 108, Flight Deck CBG Panels

The OEM for the vessel’s composite fire protection panel system is CBG. Per the work item specification 7.1, a CBG Representative will be required to install the CBG panels. NAVAIR certification requires for the panel system to be installed by CBG. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.

The subject CBG panels are part of the only NAVAIR approved Composite Panel System for installation onboard the Joint High Speed Vessel Flight Deck manufactured by CBG Systems. The system is a fire boundary to help protect the aluminum structure in case of a fire. The requirement for CBG System to install these panels is to maintain the fire boundary integrity of the Flight Deck.

c. WI 401, Renew NAVIBS/Radio Safety Survey

The OEM for the vessel’s navigation and radio is Northrop Grumman. Per the work item specification 7.1, an Authorized Northrop Grumman Representative will be required to assist in inspections and certifications. Factory authorized service representative provide proprietary technical data/drawings only available from the original manufacturer. This maintains all OEM warranties, ensures equipment reliability, crew safety and certification therefore precluding consideration of a service offered by another by another company.

d. WI 501, Perform Annual Stern Ramp Maintenance

The OEM for the vessel’s stern ramp is Oldenburgh. Per the work item specification 7.1, an Authorized Oldenburgh Representative will be required to assist in inspections and maintenance. Factory authorized service representative provide proprietary technical data/drawings and knowledge of the software only available from the original manufacturer. This maintains all OEM warranties, ensures equipment reliability, crew safety and certification therefore precluding consideration of a service offered by another by another company.

e. WI 502, Inspect Ride Control System Bearings

The OEM for the vessel’s ride control system is Austal USA. Per the work item specification 7.1, an Authorized Austal USA Representative will be required to perform inspections and maintenance. Factory authorized service representative provide proprietary technical data/drawings and knowledge of the control system software only available from the original manufacturer. This maintains all OEM warranties, ensures equipment reliability, crew safety and certification therefore precluding consideration of a service offered by another by another company.

f. WI 503, Perform Annual Stores Crane Maintenance

The OEM for the Stores Crane is Appleton. Per the work item specification 7.1, an Authorized Appleton Representative will be required to perform stores crane inspections and maintenance. Factory authorized service representative provide proprietary technical data/drawings and knowledge of the control system software only available from the original manufacturer. This maintains all OEM warranties, ensures equipment reliability, crew safety and certification therefore precluding consideration of a service offered by another by another company.

g. WI 504, Clean AC Condensers

The OEM for the AC condensers and chillers is Carrier. Per the work item specification 7.1, an Authorized Carrier Service Representative will be required to perform AC condenser inspections and maintenance. Factory authorized service representative provide proprietary technical data/drawings and knowledge of the control system software only available from the original manufacturer. This maintains all OEM warranties, ensures equipment reliability, crew safety and certification therefore precluding consideration of a service offered by another by another company.

h. WI 507, Fuel Meters Installation

The OEM for the Fuel Meters is Emerson. Per the work item specification 7.10, an Authorized Emerson Service Representative will be required to perform initial configuration, set up and calibration of new fuel meters. Factory authorized service representative provide proprietary technical data/drawings and knowledge of the software only available from the original manufacturer. This maintains all OEM warranties, ensures equipment reliability and certification therefore precluding consideration of a service offered by another by another company.

i. WI 509, Vega TLI Groom

The OEM for the Tank Level Indicators is Vega. Per the work item specification 7.10, an Authorized Vega Service Representative will be required to perform initial configuration, set up and calibration of new fuel meters. The only Factory authorized service representative for marine applications is NAG Marine. NAG is required to provide proprietary technical data/drawings and knowledge of the TLI software only available from the original manufacturer. This maintains all OEM warranties, ensures equipment reliability and certification therefore precluding consideration of a service offered by another by another company.

j. WI 603, MES Annual Certification

The OEM for the Marine Evacuation System is Liferaft Systems Australia. Per the work item specification 7.4, an Authorized LSA Service Representative will be required to perform annual inspection, disassembly and reassembly and certification of the life raft system. Factory authorized service representative provide proprietary technical data/drawings, knowledge of life rafts and trained personnel only available from the Factory authorized service rep. This maintains all OEM warranties, ensures equipment reliability and certification of this life saving appliance therefore precluding consideration of a service offered by another by another company.

k. WI 604, Rescue Boat and Davit Annual Inspection

The OEM for the Rescue Boat is Fast RSQ. The OEM for the boat davit is Ned Deck Marine. Per the work item specification 7.1, an Authorized Service Representative will be required to perform annual inspection, maintenance and certification of the rescue boat and davit. OEM authorized service representative provide proprietary technical data/drawings, knowledge of boat and davit, trained personnel only available from the OEM authorized service rep. This maintains all OEM warranties, ensures equipment reliability and certification of these life saving appliances therefore precluding consideration of a service offered by another by another company.

l. WI 605, SCBA Annual Certification

The OEM for the SCBAs is Scott and the OEM for the SCBA compressor is Bauer. Per the work item specification 7.1 and 7.3, Authorized Scott and Bauer Service Representatives will be required to perform annual inspection, servicing, testing and certification of the SCBAs and SCBA compressor. OEM authorized service representative provide proprietary technical data/drawings, knowledge of equipment and trained personnel only available from the OEM authorized service rep. This maintains all OEM warranties, ensures equipment reliability and certification of theses lifesaving appliances therefore precluding consideration of a service offered by another by another company.

m. WI 606, Fire Fighting Annuals

The OEM for the firefighting system is Hiller Systems Inc. and the fire detection system is Honeywell. Per the work item specification 7.8. Authorized Hiller and Honeywell Service Representatives will be required to perform annual inspection, servicing, testing and certification of the firefighting and detection system. OEM authorized service representative provide proprietary technical data/drawings, knowledge of equipment and trained personnel only available from the OEM authorized service rep. This maintains all OEM warranties, ensures equipment reliability and certification of theses lifesaving appliances therefore precluding consideration of a service offered by another by another company.

n. WI 904, Cathodic Monitoring System Inspection and Maintenance

The OEM for the Cathodic Monitoring System is CATHELCO. Per the work item specification 7.2. Authorized Cathelco Service Representatives will be required to perform annual inspection, servicing, testing and certification of the Cathodic Monitoring system. OEM authorized service representative provide proprietary technical data/drawings, knowledge of equipment and trained personnel only available from the OEM authorized service rep. Due to the vessels thin aluminum hull, the proper operation of this cathodic monitoring system is essential to the hulls integrity. This maintains all OEM warranties, ensures equipment reliability and certification of theses hull protection appliances therefore precluding consideration of a service offered by another by another company.

o. WI 906, Waterjet Removal and Inspection

The OEM for the propulsion waterjet is Wartsilla Defense Inc. Per the work item specification 7.1, Authorized wartsilla Service Representatives will be required to perform removal, inspection, servicing and reinstallation of the waterjet. OEM authorized service representative provide proprietary technical data/drawings, knowledge of equipment and trained personnel only available from the OEM authorized service rep. The propulsion water jets are critical equipment as they are the only method for the ship to move or maneuver under its own power. This maintains all OEM warranties, ensures equipment reliability and certification of theses lifesaving appliances therefore precluding consideration of a service offered by another by another company.

p. WI 910, Blast and Paint Underwater Hull

The OEMs for the hull paint is International and Sherwin-Williams. Per the work item specification 7.1. Authorized International and Sherwin-Williams paint representatives will be required to perform surface inspections, testing and advise of application of the respective paint systems. OEM authorized paint representative provide proprietary technical data, knowledge of paint and application equipment only available from the paint manufacturers OEM authorized paint rep. Due to the vessels thin aluminum hull, the proper paint system protection is essential to the hulls integrity. The painting systems also offer anti-fouling properties essential to the vessels required high speed capability. This maintains all OEM warranties, ensures paint system reliability and certification of theses hull protection systems therefore precluding consideration of a service offered by another by another company.

q. WI 911, Paint Waterjet Inlet Tunnels

The OEMs for the waterjet inlet tunnel paint is International. Per the work item specification 7.6 Authorized International paint representative will be required to perform surface inspections, testing and advise of application of the paint system. OEM authorized paint representative provide proprietary technical data, knowledge of paint and application equipment only available from the paint manufacturers OEM authorized paint rep. Due to the vessels thin aluminum hull, the proper paint system protection is essential to the hulls integrity. The painting systems also offer anti-fouling properties essential to the vessels required high speed capability. This maintains all OEM warranties, ensures paint system reliability and certification of theses hull protection systems therefore precluding consideration of a service offered by another by another company.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: The Government has posted a synopsis and a Request for Proposal (RFP) for the Post Shakedown Availability (PSA) at the Government Point of Entry, FedBizOpps website, with the intent of awarding a firm-fixed-price contract to the lowest price offeror. Any prospective contractor will be required to use the OEM or OEM authorized vendor(s) as a subcontractor to perform the work in the related WIs.

7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable in accordance with FAR Part 15.

8. Actions to Removed Barriers to Future Competition. For reasons set forth in Paragraph 5, MSC has no plans at this time to allow prime contractors to solicit these requirements competitively, other than synopsizing the requirements. If another potential source emerges, MSC Norfolk will assess whether competition for future requirements is feasible.
