Simplified Procedures For Certain Commercial Items In Accordance With Federal Acquisition Regulation (FAR) 13.5

On the basis of the following, I, as the Contracting Officer, hereby approve the use of a Brand-Name only proposed contractual action pursuant to the authority of :

1. Contracting Activity: Naval Research Laboratory, Contracts Division, 4555 Overlook Avenue, SW, Washington, DC 20375
2. The nature and/or description of the action being approved, i.e., sole source under procedures for certain commercial items in accordance with FAR 13.5.
This brand name justification requests approval to award a firm-fixed-price purchase order, on a brand name only basis, for two (2), NetApp storage area network (SAN) appliances, manufactured by NetApp Incorporated, to replace existing end-of-life appliances. The items are particular to one manufacturer, pursuant to 41.U.S.C. 1901, utilizing the simplified procedures for certain commercial items included in FAR subpart 13.5.

3. A description of the supplies and/or services required, including the delivery schedule and/or the period of performance (inclusive of all option periods), and the estimated dollar value of the acquisition.
This requirement is for purchase of two NetApp storage area network (SAN) appliances (with brand name specifications), initial configuration consulting services, and 3 years of 24x7 software and hardware maintenance. The items required are identified in the table below:

4. The statutory authority permitting sole source.

5. A statement demonstrating the unique qualifications of the proposed contractor or the nature of the action requiring use of the authority.
The purpose of this procurement to replace two (2) of the existing NetApp Storage Area Network (SAN) appliances. The equipment to be ordered is unique or highly specialized by brand name.
Obtaining the specific NetApp brand name equipment will allow continued standardization and compatibility with the current NetApp Storage Area Network at NRL. The replacement equipment must be interoperable across the entire MIS SAN (existing and new appliances) and must meet the following essential requirements:
1. An operating system that supports both SAN (Block, iSCSI, FCP, and FCoE) and Network Attached Storage (NAS) services via the Common Internet File System (CIFS) and Network File System (NFS) protocols.

2. Redundant array of independent disks – double parity (RAID-DP) which is a protection against multiple disk failure.
3. Data protection schemes such as SnapMirror and SnapVault which enable MIS to meet COOP and disaster recovery requirements by instantly replicating data across SAN members and protecting those snapshots from deletion.
The required equipment must be the exact part numbers and models to maintain compatibility with the existing equipment installed. The SAN appliances must be interoperable with the existing NetApp array. The infrastructure is built around NetApp products that are already in use in both the primary and disaster recovery facilities. Selection of a different manufacturer’s equipment would require the wholesale replacement of the remaining 3 other SAN appliances in use as well as all associated storage controllers and disk shelves (at a great cost to the government). It would also require reaccreditation efforts for both supported systems to be conducted. This procurement must be brand name to avoid unacceptable delays in fulfilling the requirement. A requirement to maintain form, fit and function reduces the overall system cost and ensures compatibility and operational integrity with the current systems. Prior acquisition history is unclear as to whether DFAR clause 252.227-7015 was included, therefore support for these networks must be obtained from the original source, or its licensed resellers/dealers, due to license agreements, restricted source code, compatibility, proprietary data rights, intellectual property rights and form, fit, function requirements to existing equipment and software. Further, the hard drive and the interface modules must be compatible and interoperable with the existing equipment. The NetApp products rely on proprietary NetApp microcoding to communicate with each other in order to connect with NetApp products that no other vendor can reproduce. Lastly, any attempt to add storage components from other systems would void any existing warranty or service level agreement for maintenance and updates necessary to keep the existing system compliant and operational.
The required brand name NetApp equipment and support are proprietary products, without known substitutable products by other vendors.
While other manufacturers provide similar products, no other manufacturers’ storage appliance will integrate and be interoperable with the existing NetApp SAN members. Additionally, only NetApp can meet all security and operations requirements to include data compression, deduplication, SnapVault and SnapMirror.
NetApp does allow other vendors to sell NetApp products and services, as authorized resellers.
6. A description of efforts made to ensure offers/quotes are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized in FEDBIZOPPS (as required by FAR 5.2) and, if not, which exception under 5.202 applies.
A Sources Sought notice was publicized on FEDBIZOPPS, via N00173-19-RFI-TL20, on 03 September 2019. NetApp.
As such, this procurement will be competed, full and open, using simplified acquisition procedures, among authorized NetApp resellers, on a brand name basis.

8. A description of the market research conducted and the results or the reason market research was not conducted.
A Sources Sought (N00173-19-RFI-TL20) was posted to FedBizOpps, on 03 September2019, for specific brand name or equal NetApp equipment, with an response due date of 13 September 2019.
Responses were received from four (4) vendors. Two (2) were authorized resellers of NetApp SAN appliances, and two (2) provided information on alternate equipment. After assessment of the responses, it was determined that the alternate equipment did not to meet the technical specifications. The alternate equipment lacked the salient characteristics and could not be modified to meet NRL’s needs.
Additionally, a Request for Information (Request #: 134320) was posted to NASA SEWP (Solutions for Enterprise-Wide Procurement) GWAC (Government-Wide Acquisition Contract), on 01 October 2019 and closed on 09 October 2019. No responses were received.
Although other storage manufacturers are available, the requirement is specifically for the replacement of 2 existing NetApp SAN appliances. No other storage manufacturer can fully interoperate with existing NetApp hardware and software.
9. Any other facts supporting the use of sole source.
MIS currently utilizes a NetApp SAN which is comprised of five (5) individual NetApp storage appliances that function together as a SAN to provide centrally managed network storage, dynamic backup and recovery capabilities, and data protection and replication that are cornerstones to the MIS disaster recovery process. These complex capabilities can only function successfully as a unit when the entire SAN is built using the same technology (which in this case is owned by NetApp).
The two current SAN appliances being replaced were originally purchased in FY16 with 3 years of warranty, and are currently on extended support to March 2020 to facilitate time for procurement, installation and configuration of the replacement systems. Maintaining supported hardware and software is a requirement of the IMPS and BIZOPS Authorities to Operate/Accreditations. Additionally, the NRL CIO (Chief Information Office), plans to make the MIS infrastructure the new NRL unclassified network and for MIS to take over approximately 130 additional users in the NRL Executive Directorate early in FY20. Without this acquisition, MIS would not be able to meet the new mission to support the Business Operations Directorate and the proposed new users.

11. A statement of any actions the agency will take to remove or overcome any future barriers to competition before any subsequent acquisition for the supplies or services required.
NRL will continue to conduct market research to stay current on emerging technologies, vendor solutions, Information Assurance requirements, fit, form and function, and competitive products and services. While other manufacturers offer similar storage appliances, those products are currently not compatible with the existing NRL infrastructure. As plans for the NRL-wide, unclassified network solidify and as improved SAN technologies become available, the NRL will evaluate interoperability and fit, form and function among vendor’s products, to increase competition. Additionally, DFAR clause 252.227-7015 will be included in future solicitations and contracts.
