1. Scope.

1.1. Scope. The purpose of this contract is to provide for the manufacture and delivery of the Program Loader Enclosure Assembly (PN: 4032AS1110-1). The Program Loader Enclosure Assembly consists of an aluminum enclosure with hinged lid, breather valve, gaskets, handle straps, and other components. The contractor shall provide qualified personnel to perform the tasks described in this Statement of Work.

2. Applicable Documents

2.1. General. The documents listed in this section are specified in section 3. While every effort has been made to ensure the completeness of this list, document users are cautioned that they must meet all specified requirements documents cited in section 3, whether or not they are listed.

2.2. Government documents.

Nothing in this document, however, supersedes applicable laws and regulations unless a specific exemption has been obtained.

3. Requirements

3.1. Disclaimers.

3.1.1. Suggested source of supply. Vendors listed on the drawing(s) are a suggested source of supply only. Other vendors are acceptable as long as their item’s quality matches those of the suggested source of supply listed thereon in form, fit, and function. The contractor shall supply a certificate of compliance for any item supplied by a vendor not listed as the suggested source of supply.

3.1.2. Guarantee of availability. Identification of the suggested source(s) of supply on the drawing(s) is not to be construed as a guarantee of present or continued availability as a source of supply for the item(s).

3.2. General description.

3.2.1. Program Loader Enclosure Assembly. The Enclosure Weld Assembly consists of an aluminum enclosure with hinged lid, breather valve, gaskets, handle straps, and other components as identified on NAVAIR Drawing 4032AS1110 Rev A.

3.2.2. Construction. Each assembly shall be new and constructed of parts and materials that are without defects.

3.2.3. Workmanship. Each assembly shall be uniform, neat, and clean; and shall be free from irregularities and anomalies which degrade form, fit, function, performance or appearance.

3.3. Specific requirements.

3.3.1 Program Loader Enclosure Assembly (PN: 4032AS1110-1, Drawing 4032AS1110 Rev A).

3.3.1.1. Drawing Preparation. This drawing was prepared in accordance with ASME Y14.100, including Appendices B thru E.

3.3.1.2. Dimensioning and Tolerancing. Interpret dimensioning and tolerances in accordance with ASME Y14.5m-1994.

3.3.1.3. Part Identification. Identify part in accordance with MIL-STD-130 with ESD symbol.

Bag and tag all items too small to identify.

3.3.1.4. Finish. Finish assembly as shown: Except latch bodies, gaskets, valve, & dowel pins and Durabak coating.

A. Chem film per MIL-DTL-5541, Type 2, Class 3. See drawing.

B. Prime exterior only with epoxy prime per MIL-DTL-0053022, Type II except on noted areas.

C. Paint exterior only with white polyurethane coating per MIL-PRF-85285, Type II, Class H Color # 17925 of FED-STD-595.

D. Apply Durabak Textured Coating (Find No. 19 of Drawing 4032AS1111 Rev B) as shown on the drawing.

3.3.1.5. Edge treatment. Remove all burrs and sharp edges.

3.3.1.6. Welds. Weld all joints and gaps, grind all outside welds flush and smooth.

3.3.1.7 Studs. Fill and grind all stud areas smooth, surfaces shall be free from any indication of a stud passing thru the outside skin prior to priming and painting, as noted on Note 8 of Drawing 4032AS1111 Rev B.

3.3.1.8. Pressure testing. Sealed case construction, of all units (100%), shall be pressure tested.

Sealed type construction, pressure test per MIL-STD-108, Table III + Note 1, with the options that pressure can be applied from the inside and the time interval reduced to a three minute minimum period. (Test gasket and plug in front door opening, rear cutouts and panel opening).

3.3.1.9. Part masking. Mask from primer and paint. See drawing for applicability.

3.3.1.10. Loose items. N/A. See Exceptions below in paragraph 3.3.1.18.

3.3.1.11. Assembly specifications. Conforms to MIL-STD-454 & MIL-STD-108.

3.3.1.12. Weld specification. Weld in accordance with MIL-W-22248, Class 4 using R4043 filler metal or weld in accordance with AWSD 17.1, Class C. All weld seams shall be filled with filler metal to form a continuous bead free of cracks, holes, and signs of excessive heat.

3.3.1.13. Aesthetics. After fabrication, parts and assembled equipment shall be cleaned of smudges; loose, spattered, or excess solder; weld metal; metal chips and mold release agents; or any other foreign material which might detract from the intended operation, function, or appearance of the equipment.

3.3.1.14. Engraved markings. Engrave and backfill reference designation and functional markings in the approximate locations shown on Drawing 4032AS1111 Rev B. Markings to be in Gothic font using .375 ± .020 character height, .015 deep using ink, opaque, Color: Black, No.

17038, per FEC-STD-595, in accordance with A-A-208, Type I.

3.3.1.15. LCD Screen Gasket. Attach LCD Screen Gasket (Find No. 5 of Drawing 4032AS1110 Rev A) to enclosure using EMI adhesive (Find No. 10 of Drawing 4032AS1110 Rev A). See Note 2 of Drawing 4032AS1110 Rev A.

3.3.1.16. Cinching Straps. Find No. 6 of Drawing 4032AS1110 Rev A shall be assembled on the enclosure both right and left sides.

3.3.1.17. Other requirements. All other dimensional, finish, marking, weld, and assembly information as detailed on the NAVAIR drawing.

3.3.1.18. Exceptions. Part number 4032AS1110-05 (FN2 of Drawing 4032AS1110 Rev A) and part number 4032AS1110-17 (FN3 of Drawing 4032AS1110 Rev A) are excluded from this requirement.

3.4. Warranty. Manufacturer shall provide a standard commercial warranty.

4. Quality assurance provisions.

4.1. General provisions. The inspections (demonstration and/or examination) herein shall be performed to determine whether the item conforms to Section 3 of this SOW.

4.2. Technical Support Services. A kick-off meeting shall be held at the contractor’s facility within two weeks of contract award, if deemed necessary by the Government.

The contractor shall support Technical Interchange Meetings (TIMs), Teleconference Calls and individual questions via phone or e-mail to address technical progress, analysis, test and design issues as required.

Unless approved by or initiated by the contractor:

- TIMs

- Shall be held at the contractor's facility and limited to two days maximum unless extensions are approved by the contractor.

- Shall be announced at least three working days in advance.

- Agenda will be set and agreed upon by the Government before the meeting.

- Teleconference Calls

- Shall be announced at least 24 hours in advance and be limited to 2 hours each.

4.3. Inspections and Acceptance. Deliverables will be inspected for compliance to this statement of work. Inspections may include but are not limited to dimensions, finish, markings, welds, interface requirements and workmanship. A Certificate of Compliance is required for each shipment.

The government reserves the right to perform an initial inspection on the first deliverables at the contractor's facility. This inspection shall be coordinated with the contractor. Unless agreed upon by the contractor, the government is responsible for all inspection tools. A final inspection will be performed at destination.

4.4. Rejection. If any products offered to meet this requirements document fail to comply with any of the applicable requirements; that unit shall be rejected. The Government reserves the right to terminate inspection upon any failure of an assembly or component during the inspection. If a unit fails inspection, the contractor shall 1) return the unit to condition code A, or 2) dispose of and replace the unit.

5. Packing.

5.1. Packaging. Preservation, packaging, packing, unitization and markings shall provide protection for a minimum of one year, provide for multiple handling, redistribution and shipment by any mode and meet or exceed the following requirements.

5.1.1. Cleanliness. Items shall be free of dirt and other contaminants which would contribute to the deterioration of the item or which would require cleaning by the customer prior to use.

Coatings and preservatives applied to the item for protection are not considered contaminants.

5.2. Shipping packaging. The shipping packaging (including any necessary blocking, bracing, cushioning, or waterproofing) shall comply with the regulations of the carrier used and shall provide safe delivery to the destination. The shipping packaging shall be capable of multiple handling and storage under most conditions (such as stacked storage) for a minimum of one year.

5.3. Marking. Each shipment shall be marked in accordance with MIL-STD-129.

5.4. Shipping. Equipment shall be shipped to NSWC Crane by traceable means for acceptance.

The Government will evaluate equally, as regards time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above, will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor's date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term "working day" excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.

CNIN-NOTICE-0002 NSWC CRANE GENERAL PROCUREMENT INFORMATION (FEB 2016)

1. NSWC CRANE VISITOR INFORMATION: PORTABLE ELECTRONIC DEVICE POLICY

NSWC Crane has implemented full compliance with the NAVSEA Access and Movement Control Instruction 5510.2C, dated 25 February 2014, which restricts the use of portable electronic devices (PEDs) in all NAVSEA spaces. In accordance with NSWC Crane Policy Letter 14-02 dated 20 March 2014, all Government civilian, military and contractor personnel assigned to NSWC Crane and all visitors are prohibited from bringing any device or equipment capable of recording, transmitting or exporting photographic images or audible information of any kind into NSWC Crane spaces . This policy prohibits all personal electronic devices other than personal cell phones. For the purpose of this policy, “spaces” include outdoor ranges and test areas. NSWC Crane areas will be clearly marked. Prohibited devices include: MP3 players, e-readers, digital recording devices, laptop and tablet computers, and/or other electronic devices not provided by the Government or specifically authorized. One-way pagers are allowed for fire, safety and security purposes. These devices can be used in non-NSWC Crane areas.

2. RAPIDGate NSA/NSWC CRANE INSTALLATION ACCESS

NSA/NSWC Crane is implementing the Navy Commercial Access Control System (NCACS) projects. The NCACS is the standard identity management and perimeter installation access control solution for the access management of vendors, contractors, suppliers and service providers who are not authorized a Common Access Card (CAC). The rationale for implementation of this system is to increase security while reducing impacts to the contractor community by improving efficiencies for base entry.

A new protocol being implemented to fulfill this NCACS requirement is the RAPIDGate system. The system meets Presidential Directive (HSPD-12) requirements by providing background checks of contractor personnel.

A personal badge that affords base access (and/or multiple base access) for one year will be issued to each Contractor employee that meets background check criteria. While Contractors are not required to participate in this program, those Contractors who choose not to participate will be required to obtain daily passes for base access.

For contracts which include the FAR 52.204-9 Personal Identity Verification of Contractor Personnel or will otherwise require frequent access to the Naval Support Activity (NSA)/NSWC Crane site, contractors should consider taking advantage of the benefits available from the RAPIDGate program. A Government Sponsor is required to validate a Contractor’s request for RAPIDGate access, and shall be the Contracting Officer’s Representative (COR). If there is no COR, then the Government Sponsor is the Contracting Officer.

The Government does not guarantee the contractor’s successful enrollment or the successful enrollment of any contractor employees in the RAPIDGate program. Significant delays may result from choosing to access the installation by obtaining a one day pass. The Government will not be held responsible for any access delays associated with using the daily pass process. Please address any questions or concerns regarding RAPIDGate to the COR or the local Base Security Office personnel listed below.

3. TAX EXEMPTION

Section 39(A) and Section 6 of the Indiana Gross Income Tax Act of 1933, specifically exempts NSWC Crane Division as a government activity from any payment of sales and use taxes. The assigned Exemption Number is 0018103400015

4. BUSINESS HOURS

NSWC Crane Division allows flexible working hours for its employees. The core time when all employees are scheduled to work is 9:00 am to 2:30 pm (local time).

5. NSWC CRANE RECEIVING FACILITY SCHEDULE

Contractors shall schedule deliveries to ensure arrival at destination only on Monday through Friday (excluding holidays) between the hours of 7:00 A.M. and 2:00 P.M. Eastern Standard Time (EST). The receiving facility is closed on Saturdays and Sundays.

Contractors shall ensure deliveries of EXPLOSIVE MATERIALS arrive at destination only on Monday through Thursday (excluding holidays) between the hours of 7:00 A.M. and 2:00 P.M. EST. The receiving facility for explosives is closed on Fridays, Saturdays and Sundays.

6. HANDLING OF INFORMATION BY CONTRACTOR SUPPORT PERSONNEL

Contractors are hereby notified that contractor support personnel within the NSWC Crane Contracting Department may be handling Bid and Proposal or Quote data as well as other correspondence and documentation concerning this action. Non-disclosure statements have been executed by all contractor support personnel participating in the process and are maintained by NSWC Crane.

252.232-7006 WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (MAY 2013)

(a) Definitions. As used in this clause--

Department of Defense Activity Address Code (DoDAAC) is a six position code that uniquely identifies a unit, activity, or organization.

Document type means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).

Local processing office (LPO) is the office responsible for payment certification when payment certification is done external to the entitlement system.

(b) Electronic invoicing. The WAWF system is the method to electronically process vendor payment requests and receiving reports, as authorized by DFARS 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(c) WAWF access. To access WAWF, the Contractor shall--

(1) Have a designated electronic business point of contact in the System for Award Management at https://www.acquisition.gov; and

(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this Web site.

(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/.

(e) WAWF methods of document submission. Document submissions may be via Web entry, Electronic Data Interchange, or File Transfer Protocol.

(f) WAWF payment instructions. The Contractor must use the following information when submitting payment requests and receiving reports in WAWF for this contract/order:

(1) Document type. The Contractor shall use the following document type(s).

CNIN-G-0007 PROMPT PAYMENT CONSTRUCTIVE ACCEPTANCE (DEC 2013)

Paragraph (a)(5)(i) of the Prompt Payment Clause (FAR 52.232-25) is hereby changed from the 7th day to:

(i) For the sole purpose of computing an interest penalty that might be due the Contractor, Government acceptance is deemed to occur constructively on the 15th day after the Contractor delivers the supplies or performs the services in accordance with the terms and conditions of the contract, unless there is a disagreement over quantity, quality, or Contractor compliance with a contract provision. HQ G-2-0009 SUPPLEMENTAL INSTRUCTIONS REGARDING INVOICING (NAVSEA) (APR 2015)

(a) For other than firm fixed priced contract line item numbers (CLINs), the Contractor agrees to segregate costs incurred under this contract/task order (TO), as applicable, at the lowest level of performance, either at the technical instruction (TI), sub line item number (SLIN), or contract line item number (CLIN) level, rather than on a total contract/TO basis, and to submit invoices reflecting costs incurred at that level. Supporting documentation in Wide Area Workflow (WAWF) for invoices shall include summaries of work charged during the period covered as well as overall cumulative summaries by individual labor categories, rates, and hours (both straight time and overtime) invoiced; as well as, a cost breakdown of other direct costs (ODCs), materials, and travel, by TI, SLIN, or CLIN level. For other than firm fixed price subcontractors, subcontractors are also required to provide labor categories, rates, and hours (both straight time and overtime) invoiced; as well as, a cost breakdown of ODCs, materials, and travel invoiced. Supporting documentation may be encrypted before submission to the prime contractor for WAWF invoice submittal. Subcontractors may email encryption code information directly to the Contracting Officer (CO) and Contracting Officer Representative (COR). Should the subcontractor lack encryption capability, the subcontractor may also email detailed supporting cost information directly to the CO and COR; or other method as agreed to by the CO.

(b) Contractors submitting payment requests and receiving reports to WAWF using either Electronic Data Interchange (EDI) or Secure File Transfer Protocol (SFTP) shall separately send an email notification to the COR and CO on the same date they submit the invoice in WAWF. No payments shall be due if the contractor does not provide the COR and CO email notification as required herein.

(d) Inspection/Acceptance. The Contractor shall tender for acceptance only those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. The Government must exercise its postacceptance rights--

(1) Within a reasonable period of time after the defect was discovered or should have been discovered; and

(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.

(e) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence, such as acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.

(f) Termination for the Government's convenience. The Government reserves the right to terminate this contract, or any part hereof, for its sole convenience. In the event of such termination, the Contractor shall immediately stop all work hereunder and shall immediately cause any and all of its suppliers and subcontractors to cease work. Subject to the terms of this contract, the Contractor shall be paid a percentage of the contract price reflecting the percentage of the work performed prior to the notice of termination, plus reasonable charges that the Contractor can demonstrate to the satisfaction of the Government, using its standard record keeping system, have resulted from the termination.

The Contractor shall not be required to comply with the cost accounting standards or contract cost principles for this purpose. This paragraph does not give the Government any right to audit the Contractor's records. The Contractor shall not be paid for any work performed or costs incurred that reasonably could have been avoided.

(g) Termination for cause. The Government may terminate this contract, or any part hereof, for cause in the event of any default by the Contractor, or if the Contractor fails to comply with any contract terms and conditions, or fails to provide the Government, upon request, with adequate assurances of future performance. In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience.

(h) Warranty. The Contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract.

52.204-3 TAXPAYER IDENTIFICATION (OCT 1998)
