SECTION B
1.0 GENERAL. The rates for services provided under this contract shall be payable at the applicable, fully loaded, rates stipulated in Section B. Said payments shall be considered payment in full for all services, equipment, supplies and all Contractor personnel under this contract, including all penalty time, bonuses, payments and emoluments payable to Contractor personnel for services under this contract, irrespective of the geographic scope of said services.
1.1 PER DIEM RATE. Per Diem rates shall cover the cost of daily operation, equipment, personnel, and service for the SBX-1 Security Force, unless an expense is specifically listed in the contract as being reimbursable. Payment of the awardee’s per diem rate shall commence upon the performance period commencement date.
1.2 REIMBURSABLE ITEMS. Reimbursable supplies and services are those items specified in the contract as reimbursable, or otherwise pre-approved by the Contracting Officer. The reimbursement cost shall not include overhead, general and administrative costs, material handling costs, profit, or fees above the actual costs. See Section G for the documentation requirements for reimbursable items. Reimbursables shall not exceed funding expressly obligated to this contract by the Contracting Officer.
1.3 ESTIMATES. All quantities are estimates unless specifically guaranteed.
1.4 CLIN STRUCTURE. The CLIN structure may be unilaterally changed by the Government at award to accommodate the funding format.

RESERVED.
1.6 REDUCED OPERATING STATUS (ROS). Fixed Reduced Operating Status (ROS) prices shall include costs for training, insurance, other personnel expenses, indirect costs, G&A, and profit. Crew size for ROS will be negotiated on a case-by-case basis prior to a ship entering ROS, and will be based on specific crew requirements. The Government will reimburse the contractor for crew wages and fringes based on the wages and fringes negotiated for the FOS price for the corresponding contract period and the required crew size. The Government will also reimburse the contractor for provisions at a fixed rate of $30 per ration (three meals for one person) or a single meal rate of $8.00 for breakfast and lunch, and $14.00 for dinner for all required crew members. In the event the vessel is unavailable to accommodate the crew for messing and berthing, the Government will reimburse the contractor travel and per diem costs in accordance with the DoD Joint Travel Regulations (JTR) in effect at the time of travel.

RESERVED.
1.8 CONTRACTOR’S ACCOUNT. All overtime, penalty time, bonuses, and other additional emoluments, payable for whatever reasons, shall be for the Contractor’s account except as specifically otherwise provided in the contract.
Section C - Descriptions and Specifications
SECTION C
C1.0 Scope of Work/Mission On September 15, 2008, the United States Navy (Navy) and the Missile Defense Agency (MDA) signed a Memorandum of Agreement (MOA) transitioning the Sea Based X-Band Radar (SBX-1) platform Operations and Support (O&S) from MDA to Navy cognizance. The Navy designated Military Sealift Command (MSC) as the agent responsible for the SBX-1 Program Office. MSC's duties include acquiring the proper levels of security and protection for the SBX-1 vessel in accordance with U.S. Strategic Command Directive (SD) 538-2 and other applicable directives listed in the reference section of this document.
Note: SD 538-2 is currently under revision and review and when reissued will be Strategic Instruction (SI) 538-2. The contracting officer may direct the contractor to modify required coverage as determined necessary following the issuance of SI 538-2. The following paragraphs describe the general Scope of the Performance Work Statement (PWS).
C1.1 General The contractor shall provide personnel and material for securing SBX-1 in accordance with (IAW) SD 538-2 and other terms of this PWS. Security requires continuous armed force protection of the SBX at all times; when the SBX-1 is at sea and when the vessel is in port. The contractor shall be responsible for maintaining onboard physical security 24 hours 7 days a week 365 days a year and be able to sustain 58-day rotations in three scenarios, 1) when the vessel is at sea in International Waters, 2) while the vessel is in U.S. Territorial Seas and internal waters (including commercial facilities) and 3) when the vessel is moored, anchored or docked at a U.S. Navy facility and commercial facilities.. The PWS does not include scope to provide SD 538-2 protection to the vessel when moored, anchored or docked at a foreign port or shore-side security duties IAW SD 538-2. If an emergent situation requires the SBX-1 to moor, anchor, or dock at a foreign port the Government will provide shore side security duties and the contractor will provide physical security duties within the lifelines of the vessel IAW SD 538-2. The contractor shall maintain communications with escort and port security personnel and demonstrate capabilities and preparedness to Navy and other authorized and appropriate review agencies (such as but not limited to; Naval Criminal Investigation Services (NCIS), Combatant Commander (COCOM) staff, Coast Guard, etc.) (See for example: DoDI 2000.16 (series) and OPNAVINST 5530.14 (series)). To facillitate this the contractor shall have 3-5 years of experience in security in support of port security or SSL-A requirements as well as 3-5 years of company experience with weapons maintenance of the types (handguns, shotguns, military assault rifles, and crew served weapons).
C1.2 Operational Control (OPCON) Operational Control of SBX-1 and assigned personnel will reside with Commander, U.S. PACIFIC COMMAND (USPACOM) and Tactical Control (TACON) will reside with U.S. Pacific Fleet (COMPACFLT) unless specified otherwise.
C1.3 Area of Operations Operations are anticipated to be conducted in the Pacific Ocean.
C1.3.1 Operating Scenario OPERATIONAL TEMPO (OPTEMPO) is expected to be high; 80% of SBX-1 operational time is expected to be underway (at sea). The SBX-1 was deployed for 310 days in 2007, 296 days in 2008 and 197 days in 2009 (major availability). Vessel operations consist of Ballistic Missile Defense operations in support of Home Land Defense test events, transits, and maintenance. The Government may vary OPTEMPO to meet mission requirements.
C1.4 Rotation Schedule for Contract Security Force Because this is a sea going vessel with limited berths, contractor personnel shall operate on a rotation schedule determined by the frequency of Offshore Support Vessel (OSV) runs to rotate personnel (plan on no more frequent OSV runs than every 30 days and as potentially long as 60 days). Due to changing circumstances, security personnel may have to temporarily continue serving aboard the SBX-1 or wait at the berthing location for the arrival of the relief crews. The Contractor shall still perform continuous protection of the vessel during such delay periods.
C1.4.1 Unscheduled Extensions of Duty The on-board staff is subject to mobilization and other modifications of established shifts and work schedules to respond to potential or real threats as determined by the SBX-1 Master (hereafter referred to as Master) or as preplanned by Force Protection Condition (FPCON) as defined in the Vessel Security Plan (VSP).
C1.5 Embarkation/Debarkation The Contracting Officer’s representative (COR) will provide the contractor the port location of the SBX-1 and/or the disembarkation point for the OSV not less than four (4) working days prior to when they are expected to report. Contractor personnel may embark the SBX-1 while in-port or underway (via the OSV, helicopter, or other means). The location of the SBX-1 and OSV shall only be communicated as necessary.
C1.6 Personnel Equipment Requirements Contractor will provide all necessary personal use equipment for duties onboard the SBX including but not limited to clothing suitable to allow other personnel onboard SBX-1 to recognize the Security Force personnel, cold weather gear, ballistic personal protective equipment and consumables. Clothing suitable to recognize the Security Force Personnel includes uniforms. Cold weather gear includes clothing suitable for outdoor wear in Arctic at sea Environments. Ballistic personal protective equipment includes equipment suitable to stop a 7.62x39mm round. (CDRL A017)
C1.7 Personnel Qualifications The contractor shall provide a Security Force with qualifications as described below:
a) Security officers shall complete training in accordance with the requirements of COMSCINST 5530.3(series), this PWS, and as directed by the Master. All security officers must maintain proficiency on all tasks identified in the SBX-1 VSP.
b) Security Forces shall be capable of detecting, assessing, responding, and delaying security threats and meeting performance goals of SD 538-2 and all applicable instructions (including COMSCINST 5530.3(series)) to suppress covert and overt activities against SBX-1. Security officers must be U.S. Citizens and have a secret security clearance before boarding the vessel.
c) Security Force members will be armed while on duty. (CDRL A015) All security officers shall be capable of, and are authorized to, respond in accordance with Force Protection Conditions (FPCON) in accordance with applicable referenced documents, rules and regulations, including the use of deadly force in strict accordance with Standing Rules for the Use of Force (SRUF) referenced in this PWS. Contractor is aware that the primary Use of Force rules for contractor security personnel will, upon direction by Military Sealift Command, change during the contract performance period from the rules contained in enclosure L (STANDING RULES FOR THE USE OF FORCE FOR US FORCES) of Commander Joint Chiefs of Staff Instruction (CJCSI) 3121.01B of 13 June 2005 to the Use of Force rules contained in DOD Directive 5210.56 of April 1, 2011.
d) The SRUF training emphasizes de-escalation, minimal necessary force, and the right of self-defense, using both non-deadly and deadly force. All personnel must be required to show certification of the training received and certify understanding of the Standing Rules of Use of Force (COMSCINST 5530.3(series), ALMSC 017/76 as well as MSC SRUF CD). e) All security officers shall be qualified in the use and maintenance of 9mm handguns, 12 gauge shotguns, AR 15 assault rifles, M-79 Grenade Launchers, deck-mounted / hand held M-240 machine guns and deck-mounted M-2 machine guns IAW OPNAV INSTRUCTION 3591.1(series) SMALL ARMS TRAINING AND QUALIFICATION. (CDRL A010)
f) Contractor will provide proof of Transportation Worker’s Identification Card (TWIC) or Common Access Card and United States passport. Verification of Physical Certification for Physical Fitness (Merchant Mariner’s Physical Examination Equivalent) is required for each crew rotation on the SBX-1) (CDRL A012)
g) Contractor personnel shall be vetted through the MSC El Paso Intelligence Center (EPIC) screening process and receive approval before access to the vessel shall be granted (see paragraph C1.16.1) If personnel are not cleared through the EPIC screening they are not eligible for employment onboard SBX-1.
h) Each Contractor personnel shall submit DD Form 2760, “Qualification to Possess Firearms and Ammunitions”, certifying the individual is not prohibited under U.S. law from possessing a weapon or ammunition due to conviction in any court of a crime of domestic violence whether a felony or misdemeanor, and shall submit the MSC supplement to DD Form 2760 (found in COMSCINST 5530.3(series)) and not be disqualified thereunder from possessing, receiving, shipping, or transporting arms or ammunition. (CDRL A012)
i) A Written acknowledgement by the contractor and individual security personnel, after investigation of background and qualifications of contractor security personnel and organizations, certifying such personnel are not prohibited under U.S. law to possess firearms must be provided to the COR prior to embarkation on the vessel shall be submitted. (CDRL A012)
j) Written acknowledgment by the contractor and individual contractor security personnel that (CDRL A015):
1. Inappropriate use of force by contractor personnel may subject such personnel to U.S. or host nation prosecution and civil liability. Such written acknowledgement should not be construed to limit potential civil and criminal liability to conduct arising from "the use of weapons." For example, contractor personnel could be held criminally liable for any conduct that would constitute a federal offense (see the Military Extraterritorial Jurisdiction Act, (Section 3261 of title 18, United States Code)).
2. Written proof of authorization to be armed must be carried by all contractor personnel who will be armed. Proof of authorization to fire warning shots must also be carried by all contractor personnel who will be armed. Such written authorizations may be granted by (and once granted, may be rescinded by) the Master, the Commodore of the cognizant MSC Area Command that the vessel is operating in, or an individual designated in writing by them. The written authorization will be signed by the Master, Commodore, etc., (e.g., signed in ink or digitally).
3. Contractor personnel may possess only U.S. Government issued and/or approved weapons and ammunition for which they have been qualified in accordance with section C1.7 (e) of this PWS.
4. Contractor personnel were briefed about and understand limitations on the use of force.
5. Authorization to be armed or fire warning shots may be revoked for non-compliance with established rules for the use of force, firing of warning shots, or safe handling of weapons and ammunition.
6. Contractor personnel are prohibited from consuming alcoholic beverages or being under the influence of alcohol while armed.
7. Any security personnel taking Selective Serotonin Reuptake Inhibitor(s) (SSRI), the prescribing physician shall issue a letter stating that the physician has determined the person to be stable on the drugs. The Security Company shall issue a letter granting a waiver and shall retain all relevant documents to include correspondence with medical personnel.
C1.8 Physical Security The Contractor shall coordinate with the Master to establish and maintain minimum theater anti-terrorism/force protection (AT/FP) requirements for SBX-1 which comply with the SSL-A requirements set forth in STRATCOM SD 538-2 and Navy Priority B requirements OPNAVINST 5530.14(Series)
C1.8.1 The six SSL-A requirements are:
a) Access Control - Control entry and circulation within the restricted area.
b) Electronic Security - Use integrated electronic security systems (IESS) to provide continuous intrusion detection, automated entry control when so implemented, and surveillance at the restricted area boundary and individual resources. Post sentries when IESS is not installed or not operational. The security system employed on-board the SBX-1 is not a true integrated security system - - it is three separate systems which must be monitored by the Security Console Operator. However, for purposes of common verbiage, and to associate it to written standards, this document will use IESS for the SBX-1’s electronic security system. To facillitate this contractors shall provide documentation of 2 years of past company experience working with IESS similar to the ones described in this Performace Work Statement.
c) Barriers - Install barriers to impede access to protected resources.
d) Delay and Denial - Apply system security engineering during design and construction to provide delay and denial to protected resources. Delay must be long enough to allow security forces to respond and neutralize the threat before opposing forces gain access to the protected resource.
e) Active Patrol - Expand defense of the security area of interest through the use of a successive series of security screens and active patrolling to reduce the standoff threat.
f) Response Force - Post dedicated security forces inside the restricted area and designate an immediate response force outside the restricted area.
C1.9 Small Arms Locker and Weapons The SBX-1 has a central Armory and a magazine with 4 Ready Service Lockers. The contractor will store and secure ammunition and 40mm flashbang rounds in the ship’s magazine (located port starboard side midship in the vicinity of the armory) for issue to each Ready Service Locker. In addition one set of binoculars and one insulating barrel change mitt will be stored inside the RSL. Other equipment that may be necessary to the mission may also be stored in the RSL as relevant to the mission at the discretion of the Assistant Anti Terrorism Officer (ATO). The Government will provide the contractor with firearms and ammunition. See government furnished property list. The contractor (as Assistant ATO with authority delegated to him by the Master) shall be responsible for the weapons; weapons repairs will be conducted according to NSWC Crane weapons return guidelines. (CDRL A003)
C1.10 REDUCED OPERATING STATUS (ROS)
C1.10.1 Vessels in long-term Reduced Operating Status (ROS). Security force size for ROS will be negotiated on a case-by-case basis prior to a ship entering ROS, and will be based on specific crew requirements.
C1.11Personnel
C1.11.1 Key Shore Based Personnel: The Contractor shall submit to the Contracting Officer resumes of all Key Shore Based Personnel, to include the Project Manager as well as a listing of contact information of these personnel; including name, office telephone number and cellular telephone number and a list of references Substitution with equal or better qualified personnel requires Government Contracting Officer concurrence. (CDRL A014). The Contracting Officer will review all resumes submitted by the Contractor and approve/disapprove the employment of each individual. The Contractor shall provide particulars dealing with the Project Manager’s qualifications showing why they are qualified for these functions. The Project Manager shall have at a minimum 10 years of Security or Law Enforcement experience and 5 years of Project Management experience.
C1.11.2 Key Shipboard Personnel: The Contractor shall submit to the Contracting Officer resumes of the Assistant Anti-Terrorism Officer assigned to the vessel under this contract as well as a listing of contact information of these personnel; including name, office telephone number and cellular telephone number and a list of references ATO's assigned to this vessel shall have a minimum of 10 years experience in security or law enforcement and 3 years of supervisory experience in security or law enforcement either in the civilian or military sector. Substitution with equal or better qualified personnel requires Government Contracting Officer concurrence. (CDRL A014). The Contracting Officer will review the resumes submitted by the Contractor and approve/disapprove the employment of each individual. All documentation required under this contract for these key shipboard personnel shall be included with their resume.
C1.11.3 Contractor Personnel: If for any reason the Government is dissatisfied with the qualifications, conduct or performance of any person employed, the Contracting Officer will provide particulars to the Contractor, in writing, who shall promptly, independently investigate and take immediate corrective action, when appropriate, up to and including dismissal of the employee. The contracting officer may direct that a contractor employee be removed from service on SBX-1. The Contractor will have no recourse, to include financial, to the Navy for any corrective action taken by the Contractor.
C1.11.4 All guards must be U.S. citizens and meet all state and federal regulations pertaining to security duties including background checks as well as obtain and maintain secret clearance as required by this performance work statement. Inclusive of this (but not limited to) is: Speak, read, write and understand English clearly and correctly; Follow instructions, both written and spoken; Prepare written reports as required; Physically be able to stand the entire watch on his or her feet and fulfill roving watch duties as required; Attend Government Furnished training as required.
C1.11.5 Crew Retention Plan: Contractor shall establish and implement a Security team retention plan, which shall remain current throughout the contract. It shall address continuity of services and actions taken to increase the instances of Security team members returning to the SBX-1. The plan shall provide actionable items and shall contain more than statements of assurance that retention will be, for example, a focus of the company in providing Security forces for the SBX-1. (CDRL A016)
C1.12 Operational Responsibilities
a) The Master will act as the Anti-Terrorism Officer (ATO) onboard SBX-1; the Master has the authority to delegate his responsibilities as ATO to an Assistant ATO. The Contractor shall provide an Assistant Antiterrorism Officer (ATO) (who serves as lead security officer) who will report to the Master (who will act as the ATO), and to act as liaison between security forces, other contractors and government personnel onboard. The Assistant ATO will communicate directly with appropriate Area of Responsibility (AOR) Combatant Commander (COCOM) Antiterrorism/Force Protection (AT/FP) POCs, to include MSC area commands. The Navy O&S AT/FP Lead will provide contact information for these POCs. A team lead or second in command must be appointed to act for the Contractor’s Team Leader when the Assistant ATO is off-duty (CDRL A014).
b) Contractor personnel shall be trained IAW COMSCINST 5530.3 (series). Contractor personnel shall be capable of detecting, assessing, responding, delaying and disabling security threats and meeting performance goals of SD 538-2 and all applicable instructions. Periodic Navy and other agency inspections will evaluate performance and readiness of the Security Forces.
c) The Contractor shall create, update and maintain the Vessel Security Plan (VSP), with master (ATO) for approval by MSC N3, Director of Operations. The Vessel Security Plan shall meet all the requirements of the Security Plan as outlined in Reference 1. The Contractor shall comply with the Vessel Security Plan. The Contractor shall appoint a qualified individual who shall serve as the vessel's Assistant Anti-terrorism Officer (ATO) The Vessel Security Plan will be provided to MSC N34 within 90 days of contract award or before un-accompanied on-board performance begins. A Plan of Action and Milestones (Gantt chart) for creating the Vessel Security Plan shall be submitted as part of the contractors’ Transition Plan. Additional security checks may be required as directed by the COR. Contractor shall provide regularly scheduled readiness drills and exercises to assure readiness and capability to respond to anticipated threats. Such drills and exercises shall be scheduled in coordination with the Master, onboard Government representative and other operational contractors aboard the SBX-1. The Vessel Security Plan will further define and detail each of the security positions required IAW SD 538-2 and applicable references. The contractor shall further collect and all maintain verification records to demonstrate that the requirements of the Vessel Security Plan are met.
d) The security contractor shall designate Security Console Officers (SCO). The SCO position operates the CCURE Alarm System, Close Circuit Television (CCTV) System, and communication equipment. Government will provide On-The-Job (OJT) training for CCURE Alarm System operations during the Transition period. The SCO coordinates actions of the Security Forces with Assistant ATO oversight as required and IAW with Emergency Action Checklists contained in the Vessel Security Plan. Duty schedule and rotation for the SCO position is the defined by the Assistant ATO.
e) The Vessel and its associated Security Force will be subject to COMSC5530.3 (series) requirement for MSC performed Spot checks as well as NCIS performed (Individual Ship Assessments) ISA’s.
f) A minimum of one roving security watch must be active at all times. Roving watch duties include alarm investigation, patrolling, and armed response. Additional roving watches may be required by the Assistant ATO, FPCON or situations justifying increased security and vigilance (such as chokepoints, in-port, etc.), and times the vessel is either moored or dockside IAW SD 538-2, and the Vessel Security Plan.
g) IAW 538-2 and the Vessel Security Plan, the Assistant ATO shall designate individuals to serve as a response force. These individuals are “on-call” to respond in accordance with plans within the developed Vessel Security Plan and situations arising from actual incidents or increases in FPCON.
h) Intel Warnings and Indicators: The Government Mission Site Representative (GOMSR) will provide the Assistant ATO (Lead Security Officer) with access to classified message traffic in order to access, read, and ensure his team is briefed on appropriate Intel Warnings and Indicators.
i) Contractor personnel must become familiar with the relevant characteristics of the SBX prior to assuming their duties. As appropriate, these include, but are not limited to: general arrangement of the SBX, proper operation of the installed and portable security equipment, weapons and gear, firefighting equipment, lifesaving equipment, exposure suit, emergency duties, etc.
j) Functional Relationship: A professional and cooperative relationship between the Contractor personnel Security Force and the SBX-1 crew is critical to mission success, and must be maintained at all times. It is essential that the Assistant ATO and Master appreciate their individual responsibilities and dependence upon each other. In accordance with Article 0847 of U.S. Navy Regulations, 1990, the Master’s responsibility is absolute, except when, and to the extent, relieved therefrom by competent authority; the authority of the Master over the vessel and person’s onboard is commensurate with the Master’s responsibility. Embarked security contractor personnel shall follow all lawful commands of the Master (including directions regarding the use of force) and act as much as possible, as part of the crew. The Security personnel shall not perform tasks other than security functions when on duty aboard the vessel unless otherwise confirmed in writing by the Navy Contracting Officer.
C1.13 Telephone contact is preferred for items requiring immediate resolution.
C1.14 FUNCTIONAL RESPONSIBILITIES
a) The Security personnel shall not perform tasks other than security functions aboard the vessel unless otherwise confirmed in writing by the Navy Contracting Officer.
b) Use of force by Contractor personnel shall be in accordance with CJCSI 3121.01B Enclosure L (until such time as MSC issues guidance that DOD Directive 5210.56 of April 1, 2011 shall be used as the Rules for Use of Force). The Master has overall authority on and responsibility for the vessel in accordance with Article 0847 of U.S. Navy Regulations (unless and to the extent relieved therefrom by proper authority) and can veto the use of force by contractor personnel that he believes is inappropriate. The Master can also personally direct the use of force by contractor personnel under circumstances where the use of force is lawful under the Rules for Use of Force when the Master concludes that the use of force is necessary and appropriate. It is understood that the Master does not have to directly authorize the use of force by contractor personnel that is otherwise lawful under the Rules for Use of Force.
c) It is imperative for the Master and Contractor on watch to work together as a team while implementing force protection measures. This will require the contractor/ Assistant ATO to maintain situational awareness while the Master is navigating the ship, as well as determining the intent of approaching vessels. The Contractor shall keep the Master informed of the tactical force protection picture to allow the Master to maneuver his vessel so as to best protect his vessel and crew. Consultation between Contractor and ship’s Master prior to the employment of protective measures is recommended when feasible, but not required in the event of exigent circumstances.
C1.15 Staffing Each 15 person security team is separated into three contract labor categories: one Ship Security Officer, two Shift Leads, and twelve Marine Security Officers. The Ship Security Officer and Shift Leads are supervisors and exempt from overtime pay. Fifteen armed security officers from shall always reside on the vessel unless conditions require otherwise. In those cases, special accommodations will be made to provide for billeting and messing, and capability to respond to incidents.
C1.15.1 Underway Manning A minimum of three people shall form the SBX-1 on-duty guard force while the vessel is underway. These include one Ship Security Officer or Shift Lead, one Roving Security Patrol/Response Force, and one Security Console Operator. The remaining off-duty security personnel shall form the Designated Immediate Response Force. Elevated threat levels may require additional security watchstanders IAW Vessel Security Plan.
C1.15.2 Inport Manning A minimum of seven people shall form the SBX-1 on-duty guard force while the vessel is in port. One Entry Controller, one additional Roving Security Patrol, and two Line-of Detection Waterside Compensatory Rovers are added to the underway guard force.
C1.16 Personnel Clearances The Contractor shall ensure that all Security officers are U.S. Citizens and have a final secret security clearance before boarding the vessel (interim security clearances are not acceptable for contractor personnel). One person on board at all times will be required to have a security clearance with a government provided COMSEC and CRYPTO briefing. The Contractor is responsible for receiving all required security clearances.
C1.16.1 Crew Screening The contractor is responsible for providing a complete crew list to the COR no later than four working days prior to the date the security personnel will embark onboard the vessel in accordance with COMSCINST 5521.1(series).All security personnel will be screened through EPIC. The Contractor shall submit the Full Name, Billet, SSN, Date of Birth, US Passport number, nationality for all security personnel using the Government provided MSC/EPIC Force Protection Personnel/Crew list Submission Template to allow screening by the El Paso Intelligence Center (EPIC). The template must be filled out in its entirety by the contractor and resubmitted electronically in Microsoft Excel format to the following mailbox mschq.pm2-screening@navy.mil. Submit security personnel as they are identified to go toSBX-1. When a security personnel member is replaced, only submit that security personnel member instead of submitting the entire crew list again when the new security personnel member is submitted. All new personnel must be screened at the beginning of the hiring process prior to being sent to the SBX-1. All personnel shall be resubmitted at least once in each 12-month period.
C1.17 Contractor Responsibility for Safety. Nothing in this SOW, nor any Government action or failure to act in surveillance of this contract, shall relieve the contractor of its responsibility for the safety of the contractor’s personnel and property, the Government’s personnel and property, and the general public whether it is Instructor/Only support or turnkey. Furthermore, nothing in this performance work statement shall relieve the contractor of its responsibility for complying with applicable Federal, State, and Local Laws, ordinances, codes and regulations (including those requiring applicable licenses and permits) in connection with the performance of this contract.
C1.18 Berthing Accommodations Berthing space is limited to 8 staterooms, all of which are dual bunks (2 beds per stateroom). Persons berthed together should be of the same sex unless it is as spouse and arrangements be made, create no undue disruptions to ships operations, and are in the best interest of the command.
C1.19 On-board Storage The contractor‘s general storage is limited to that provided in the staterooms described in C1.18.
C1.20 Travel Personnel Travel will be necessary. Travel origination for employees will be based on each employee’s residence within the Continental United States, Alaska or Hawaii for purpose of determining maximum allowable limit. Reimbursement will be limited to actual costs incurred in going to initial destination and return. All travel shall be in accordance with the Joint Travel Regulations.
C1.21 Food and Recreation On board facilities include limited recreation facilities including gym and cafeteria. The Government through the MSC Vessel Operations contractor shall provide all necessary food. (3 meals a day and personnel assigned to nightwatch with hot lunches served between the hours of 2330-0030.) Due to the limitations onboard not all dietary restrictions may be provided for.
C1.22Reporting Criteria The Assistant ATO shall submit reports to the Master (ATO) and the Contracting Officer’s Representative as required.
C1.23 Deliverables shall be submitted in accordance with the associated CDRL.
a) Transition Plan (CDRL A001) The contractor shall provide a plan to accommodate the transition between the incumbent contractor and the performing contractor. The Transition Plan shall include a demobilization schedule as well as a VSP POAM. This is a one-time deliverable due with the proposal.
b) Staffing Plan (CDRL A002) The COR, Master and GOMSR shall be provided with the contractor’s staffing plan. The initial staffing plan is required with the contractor’s proposal and the final staffing plan is required 2 weeks after contract award and updates must be submitted two weeks before implementation except in emergency situations or as required by FPCON. Due to the unique nature of mission and vessel operations aboard the SBX-1, personnel schedules may frequently change to support operational missions and OSV transit scheduling.
c) Daily Logs and Briefings (CDRL A003) Daily security and Anti-Terrorism/Force Protection (AT/FP) briefing shall be in accordance with the CDRL, including information such as Vessels of Interest (VOI), Integrated Electronic Security System status and discrepancies, etc. The contractor shall maintain a Daily Activity Log/Blotter of all activities, incidents or threats.
d) Vessel Security Plan (CDRL A004) The contractor shall develop the Vessel Security Plan (VSP) IAW 5530.3 (Series) initially and submit to the MASTER, COR and MSC N34 for concurrence and the Assistant ATO shall review/update at least annually thereafter unless a change in procedures is necessary. The contractor shall be responsible for implementing the VSP.
e) Security Plan Verification Records (CDRL A005) The contractor shall collect and maintain records demonstrating that the requirements of the Vessel Security Plan are met.
f) Administrative Procedures and checklists (CDRL A006) The Contractor shall develop and maintain the Security Administrative Procedures and Security Officer Response procedures and check lists as required.
g) Firearms and Ammunition Control (CDRL A007) The contractor shall maintain control of and responsibility for firearms and ammunition aboard the vessel IAW DODI 2000.16 (series) DOD ANTITERRORISM (AT) STANDARDS, DOD MANUAL 5100.76-(series), and DOD 5220.22- (series) as delegated responsibility from the Master. Contractor shall maintain a daily log of daily weapons, ammo issuance and receipt and associated keys and locks on the SBX-1.
h) Weekly Alarm Reporting (CDRL A008) The Contractor shall complete DA Form 4930 Alarm/Intrusion Detection Record weekly, CCURE Alarm Report weekly.
i) Monthly Summary Report & Monthly FP Report (CDRL A009) The Assistant ATO shall submit a monthly FP report IAW MSCINST 5530.3(Series). A monthly summary report shall also be submitted summarizing accomplishments, personnel status, funds status, Other Direct Cost (ODC) expenditures, labor expenditures (standard time and overtime), forecast costs (labor and ODC), travel and overtime reports by week shall be also be submitted within 15 calendar days following the end of the month.
j) Incident Reporting (CDRL A009) IAW OPNAVINST 3100.6 (series), the contractor shall make reports of any use of firearms not for training, and training accidents. The Contractor shall fully cooperate with U.S. Government investigations with any use of firearms (operational or training accidents).
k) Contractor shall report and document the following to the Master, COR and MSC N34: (CDRL009)
(1) A weapon is discharged or a warning flare is fired by contractor security personnel.
(2) An individual performing private security functions is killed or injured in the performance of their duties.
(3) A person other than an individual performing private security functions is killed or injured as a result of conduct by contract security personnel.
(4) Property is destroyed as a result of conduct by contract security personnel.
(5) An individual performing private security functions has come under attack including in cases where a weapon is discharged against an individual performing private security functions or personnel performing such functions believe a weapon was so discharged.
(6) Active, non-lethal counter-measures (other than the discharge of a weapon) are employed by contract security personnel in response to a perceived immediate threat in an incident that could significantly affect U.S. objectives with regard to the military mission or international relations. (Active non-lethal systems include laser optical distracters, acoustic hailing devices, electro-muscular TASER guns, blunt-trauma devices like rubber balls and sponge grenades, and a variety of other riot control agents and delivery systems).
C1.23.1 Other Reports - Other reports may be required adhoc. COMSCINST 3121.9B, Military Sealift Command Standard Operating Manual provides additional detail regarding report formats, content and timing.
C1.24 Training (CDRL A010)
a) Security Awareness Training - The contractor shall be delegated responsibility by the Master to provide ship’s crew, contractors and authorized visitors with security awareness training and regular updates as required by staffing changes or minimally as an annual refresher.
b) The Contractor shall supply training IAW OPNAV INSTRUCTION 3591.1(series) and qualified personnel who have completed the USNAVY’s Small Arms Marksmanship Instructor’s course. One instructor qualified person shall be located on the vessel at all times.
c) The Contractor shall supply trained and qualified personnel to perform second echelon (intermediate) maintenance on the M-2 machine guns and the M-60 machine guns at all times. The Contractor shall ensure one person who has completed the U.S. Navy's Crew Served Weapons Operations and Maintenance Course (A-041-0013) is onboard at all times (OPNAV INSTRUCTION 3591.1 (series)).
d) Law of War Training The contractor shall provide training IAW DFARS 225.7402-4 to all security force members. The content will be coordinated with MSC Office of Council.
e) Quality Assurance Program (CDRL A011) The contractor will implement and maintain a comprehensive Training and Quality Assurance (QA) program with audits/tests/inspections designed for SBX-1. Contractors’ QA program will include: personnel selection, medical, psychological, and physical agility standards. Contractor will develop a Training Plan and record training certification for assigned personnel.
f) All security personnel shall have completed the U.S. Navy's Armed Sentry/Security Reaction Force - Basic course (A-830-0018) prior to ship assignment. (CDRL A010)
g) Security officers shall complete a Level I Antiterrorism Training Course in accordance with Reference 4. The ATO and Assistant ATO shall complete a MSC approved Level II Anti-Terrorist Training Course. The ATO (Master) will designate as the Assistant Anti-Terrorism Officer (ATO) IAW DODI 2000.16 DOD ANTITERRORISM (AT) STANDARDS and COMSCINST 5530.3 (series). (CDRL A010)
h) Security officers shall complete on-the-job-training (OJT) in the operation of the SBX-1 Integrated Electronic Security System (IESS) and be capable of performing duties as Alarm Monitor or Security Console Operator (SCO). The contractor shall provide a comprehensive training regimen illustrating all components of the SCO Job Qualification Standard. (CDRL A010)
i) Security officers shall complete training in use of Retractable Baton / use as well as non-lethal equipment comparable to the Long Range Acoustic Device (LRAD) and Night Sun II (spotlight). Contractor will use the manufacturer’s instructions for LRAD training. (CDRL A010)
j) The Government or the COR has the right to observe any scheduled training course of instruction for the security personnel. The government reserves the right to require additional training and/or provide such training when appropriate.
k) Training and refreshers shall be scheduled in accordance with DODI 5240.6 as well as COMSCINST 5530.3 (series) (CDRL A010)
l) Anti-Terrorism Officer (ATO) (CDRL A010) The Master and the Security contractor who has been named as the Assistant ATO shall have completed MSC's Anti-Terrorism Officer training at either San Diego, CA or Freehold, NJ. There shall be two Assistant ATOs assigned onboard at all times for the length of the contract.
m) Small Arms and Crew Served Weapons Training for contractor personnel (CDRL A010) All security personnel shall have successfully completed the small arms training and qualification for the weapons aboard the SBX-1 IAW OPNAVINST 3591.1 (Series) Small Arms Training and Qualification. The Antiterrorism Officer (ATO) shall be responsible for all small arms training and will delegate this authority to the contractor who acts as the ship’s Assistant Antiterrorism Officer (Assistant ATO) see C1.14. The Contractor shall ensure that fifteen crew members who will bear arms as part of their physical security duties have successfully completed a small arms training and qualification course. The Contractor’s course shall be taught to the same content and standards as the U.S. Navy’s Small Arms Qualifications (Ashore/Afloat) Instructor Course J-041-0148. Such training shall be completed prior to commencement of shipboard employment. Additional training required for all small arms qualified personnel includes Small Arms Sustainment, Standing Rules for the Use of Force (SRUF), and Warning shot training for all qualified personnel, this training will be administered by the vessel’s Assistant ATO. The Contractor shall conduct Warning Shot Training in accordance with COMSCINST 12410.50 (Series). The Warning Shot Training Disc (May 2009) will be provided after award. Contractor is aware that the primary Use of Force rules for contractor security personnel will change during the contract performance period from the rules contained in enclosure L (STANDING RULES FOR THE USE OF FORCE FOR US FORCES) of CJCSI 3121.01B of 13 June 2005 to the Use of Force rules contained in DOD Directive 5210.56 of April 1, 2011.
n) The Contractor shall ensure one person who has completed the U.S. Navy's Crew Served Weapons Instructor (CSWI) course (A-830-2215) is onboard at all times (CDRL A010). This course qualifies personnel to instruct in light, medium and heavy machine guns, and qualifies personnel as RSO for crew served weapons. This course does not qualify personnel to instruct pistols, rifles, or shotguns, unless they are also a graduate of the Small Arms Instructor Course (A-041-0148).
o) The Assistant ATO shall ensure Small Arms sustainment training, Standing Rules of the Use of Force (SRUF) training and MSC's Warning Shot Training IAW COMSCINST 12410.50 (Series) Training Policy for the Employment of Warning Shots are conducted aboard ship. (CDRL A010)
p) Combating Trafficking in Persons (CTIPS) training (CDRL A010) The Contractor shall ensure all shipboard and company security employees deploying overseas successfully complete the DoD Combating Trafficking in Persons training. This course is available at http://ctip.defense.gov/requirement.html, click on “TIP General Awareness Presentation” and may be down loaded to CD for distribution to ships.
q) Operations Security Training (OPSEC) (CDRL A010) All Contract security and Company personnel shall complete OPSEC training annually. “Introduction to Operations Security” is available on CD.
r) Information Assurance Awareness Training (CDRL A010) All Contract Security and Company personnel shall complete “DoD Information Assurance Awareness (for DoD Personnel)”. This training is available on line or CDs may be order for distribution to ships at http://iase.disa.mil/eta/online-catalog.html#iaatraining
s) Security Refresher Training (CDRL A010) All Contract security and company personnel shall complete Security Refresher Training annually. This training available from COMSC, N13e email: kyrm.hickman@navy.mil.
t) SERE Level 1 (CDRL A010) (Reserved)
C1.25 Certification Data - CDRL A012: The contractor shall provide the COR copies of all employee certifications.
C1.26 Inventory Records - CDRL A013: The contractor shall provide inventory records of Government and contractor furnished equipment. Contractor shall maintain weapons and ammunition, records IAW DoD 5100.76 (series) (DOD MANUAL 5100.76-(series)) (current version).
