About this file
This justification document supports a sole source bridge contract award to US Foods Port Orange. The contract is for subsistence prime vendor support for 134 days from June 28, 2020 through November 8, 2020 for customers in the Mayport, Florida area. The Defense Logistics Agency Troop Support Subsistence plans to award an indefinite delivery, indefinite quantity fixed price contract with economic price adjustment and an estimated total value of $9,570,000. The minimum value is 10% at $957,000 and maximum value including 300% surge is $28,710,000. A sole source award is justified as US Foods Port Orange is the only firm with an existing fully implemented STORES electronic catalog that can perform within the required timeframe.

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION UNDER AUTHORITY
OF 10 U.S.C. 2304(c)(1) FOR FULL FOOD SERVICE PRIME VENDOR CUSTOMERS IN THE
MAYPORT FLORIDA AND SURROUNDING AREA
1. Defense Logistics Agency (DLA) Troop Support, Subsistence Supply Chain, is the contracting activity.
2. The action being approved is the ability to solicit for DLA requirements on an other than full and open competition basis.
3. The proposed acquisition will be an Indefinite-delivery, Indefinite quantity (IDIQ), fixed price with Economic Price Adjustment (EPA) bridge contract for Subsistence Prime Vendor (SPV) support for a period of 134 days, which includes coverage for a sixty day
(60) day ramp-up period for the follow-on competitive procurement to allow for implementation activities such as the establishment of a Subsistence Total Order and Receipt System (STORES) catalog by the awardee.
The proposed bridge contract (SPE300-20-D-3279) encompasses SPV support for all authorized DLA customers located in the Mayport, Florida area for a full-line of food and beverage items. Based on current annual usage/sales, the estimated total dollar value for the proposed bridge contract is $9,570,000. The guaranteed minimum dollar value is ten percent (10%) of the estimated dollar value, or $957,000. The maximum total dollar value, including surge of 300%, is $28,710,000. This proposed action will result in the award of a bridge contract to US Foods Port Orange effective June 28, 2020 through November 8, 2020.
4. The applicable statutory authority permitting other than full and open competition is
10 U.S.C. 2304(c)(1), as implemented by FAR Part 6.302-1 – Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. The use of this authority is necessary to provide continuous, uninterrupted food supplies to DLA customers in the Mayport, Florida area. The last Long Term Prime Vendor contract covering this region was a fixed price with EPA IDIQ contract (SPE300-15-D-3104) awarded to US Foods Port Orange, on October 10, 2014 and expired October 9, 2019.
Contract SPE300-15-D-3104 had a base period of up to twenty-four (24) months, which included a two (2) month implementation period and a twenty-two (22) month ordering period, and was followed by one (1) twelve (12) month option period and one (1) twenty-four (24) month option period. The contract was awarded utilizing full and open competition and had a maximum contract dollar value of $312,584,084.10. The current contract, SPE300-20-D-3245, is a 262 day bridge contract awarded on October 10, 2019 and due to expire June 27, 2020. This proposed action will result in the award of a second bridge contract to US Foods Port Orange effective June 28, 2020 through November 8, 2020.
The delays necessitating the first bridge contract are documented in the Justification and Approval (J&A) supporting that contract actions. This bridge contract is necessary due to unforeseen occurrences discussed below.
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION UNDER AUTHORITY
OF 10 U.S.C. 2304(c)(1) FOR FULL FOOD SERVICE PRIME VENDOR CUSTOMERS IN THE
MAYPORT FLORIDA AND SURROUNDING AREA
6. As required by FAR 5.2, a notice will be published in Contract Opportunities (Beta.SAM.GOV). All information pertinent to the special notice will be available to the general public at website https://www.dla.mil/TroopSupport/Subsistence/. In addition, this justification will be made available for public inspection, after award, in accordance with FAR 6.305.
7. As the Contracting Officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable based on price analysis, which will include an overall assessment of market conditions and a comparison of the distribution prices and delivered prices with recently awarded CONUS Prime Vendor contracts.
8. The information supporting this action is based primarily on the Government’s knowledge of the foodservice market in the region. With the exception of synopsizing this requirement, no additional market research will be conducted and no other firms will be solicited since the Government is unaware of any other firm in the region with the existing capability, including electronic STORES cataloging, to perform in the timeframe required.
9. In the Mayport, Florida region, only US Foods Port Orange has a fully implemented
STORES electronic catalog. The required foodservice supplies are available only from the current contractor in the timeframe required, and award to any other source would result in unacceptable delays in fulfilling the agency’s requirements.
10. US Foods Port Orange is the only source expected to express an interest in the proposed bridge contract.
11. The follow-on competitive solicitation, SPE300-19-R-0062 was issued on September 19, 2019 on a full and open competition basis and it is anticipated that all future acquisitions for these requirements will be competed on a full and open competition basis. The follow-on award is anticipated by .
12. As the Contracting Officer, I hereby certify that this justification is accurate and complete to the best of my knowledge and belief.
