PERFORMANCE WORK STATEMENT

1.0 Background: Marine Corps Engineer School, TECOM, TRNGCMD has a requirement to replace the existing

End of Life Video Teleconference (VTC) system with a new VTC system that can support ISDN (Integrated

Services Digital Network) & IP (Internet Protocol) Address calls and maintain a service contract for their Video

Teleconference (VTC) System.

2.0 Scope: The quote will include: programming, installation and testing of the Cisco CS-KIT60-K9 VTC system, and two years of maintenance support. Training on system operation and troubleshooting will also be included.

3.0 Tasks:

3.1 Installation: Install a Cisco CS-KIT60-K9 VTC in Building BB-28, Courthouse Bay, Camp Lejeune. All miscellaneous equipment, as part of the Cisco CS-KIT60-K9 VTC system, not installed at time of initial installation shall remain with the Government POC. Any uninstalled equipment will be returned to Government POC at the time of new system installation. Specifically, there may be extra equipment not needed for ISDN use, but will later be needed when transitioned to VOIP.

3.2 On-Call Maintenance Service: The Contractor shall provide on-call maintenance service and repairs for the base year and two option years.

3.2.1 The Contractor shall furnish all repair parts, labor, and transportation required to accomplish item repairs.

3.2.2 Within 24 hours of receipt of a repair call from the Government point of contact (POC) the Contractor shall accomplish all repairs.

3.2.3 If repairs cannot be accomplished within 24 hours, an on-site service/repairs are required, the vendor must be onsite at BB28 within 72 hours of contact. The contractor shall furnish the Government POC written documentation within the set timeframe showing the cause for delay of repairs. If equipment is down for longer than the established timelines in the contract, the Contractor will credit the government for each 24 hour period the equipment is non-operational.

3.2.4 After initial installation the vendor will have to provide follow on support in order to configure the VTC Suite to work with both ISDN & IP functionality. This is due to ongoing network infrastructure upgrades throughout the

Marine Corps.

3.3 Preventative Maintenance Service: On an annual basis the Contractor shall provide preventative maintenance service.

3.3.1 The Contractor shall furnish all repair parts, labor, software updates and transportation required to accomplish inspection, cleaning, lubrication, adjusting, calibrating, vacuuming (if required), and repairing of items.

4.0 Work Ticket:

A work ticket for each repair call shall be submitted to the Government POC upon completion of the repair call.

The work ticket shall have clearly marked spaces for, and include:

b. Date and Time Notified

c. Manufacturer and Model/Serial Number(s) of Equipment

d. Unit, Section, Equipment Operator, Building Number, Phone#

e. Description of Problem (Unit)

f. Parts Used (Description and Quantity)

h. Activity Representative’s Printed Name, Signature, Phone#, Date, and Time

5.0 Contractor’s Unauthorized Work Performance. The Contractor shall not perform work that deviates from contract requirements and specification. If the Contractor deviates from contract requirements and specification without approval of the CONTRACT ADMINISTRATOR/CONTRACTING OFFICER, such deviation shall be at the risk of the Contractor and any cost related thereto shall be borne by the Contractor.

6.0 Base Access.

a. Contractors, and or delivery drivers, must have in their possession: their contract number, delivery address and sponsor’s contact information in order to gain initial access to the base. For supply deliveries the customer/delivery point of contact is the sponsor.

b. Contractors must be registered in the Defense Biometrics Identification System (DBIDS).

(1) DBIDS credentials will be valid for the duration of your contract, not to exceed three years. However, re-vetting of individuals’’ information will occur each year.

(2) Contractors requiring access for over 60 days will receive a credential valid for up to one year.

(3) Contractors requiring access for less than 60 days will receive a temporary paper pass.

(4) Contractor Common Access Card (CAC) Eligibility: Contractor personnel authorized CAC’s are exempt from DBIDS enrollment.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO

SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2020)

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in the provision at 52.204-26, Covered Telecommunications Equipment or Services--Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items.

(a) Definitions. As used in this provision-

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause

52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or

Equipment.

(b) Prohibition.

(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.

115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--

(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or

(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.

(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM)

(https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."

(d) Representations. The Offeror represents that--

(1) It [ ] will, [ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds

(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--

(b) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM)

(https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014) “TAILORED”

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

This procurement is a 100% Small Business Set-Aside. All responsible small business sources may submit a response which, if received in a timely manner, will be considered by the agency.

This is a Barnd Name only requirement.

Potential offerors must complete FAR Provision 52.204-24, Representation Regarding Certain

Telecommunications and Video Surveillance Services or Equipment and send with quote.

BASIS FOR AWARD: Award will be made on the basis of best value, price and other factors considered. The

Government intends to make an award to the vendor whose proposal represents the best value to the Government based on (1) vendor’s ability to meet the technical specifications, (2) response time in accordance with Performance

Work Statement and (3) price.

TECHNICAL ACCEPTABILITY: To ensure technical compliance with the requirements, vendor quotes shall include the following information:

a. Item information: Descriptive literature outlining the capabilities and course/training information quoted with regards to ALL training detailed in the Performance Work Statement. Experience/Certifications must be included.

b. Price: The price must reflect unit prices, extended amounts per line item (if any), and overall total. Quote shall be FOB Destination (shipping included in the price).

c. Vendor’s quote must include an active Cage Code and Federal Tax Identification Number. Vendors are required to be registered within the SAM database and have an active Cage Code at the time quote is submitted.

PREPARATION OF QUOTE: Quotes must include the following:

a. Technical quote

b. Price quote

c. Complete FAR provision 52.212-3 and 52.204-24.

d. Clearly state the quoter understand response time in accordance with Performance Work Statement and can meet the requirement.

Past performance will be verified via the Supplier Performance Risk System (SPRS).

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(c) Quotes related to this solicitation must be received by the MCIEAST Contracting Department within the date and time specified in Block 8 on the first page of this solicitation. 52.217-5 EVALUATION OF OPTIONS (JUL 1990)

Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the

Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).

52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days;

provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 24 months.

52.232-19 AVAILABILITY OF FUNDS FOR THE NEXT FISCAL YEAR (APR 1984)

Funds are not presently available for performance under this contract beyond 30 September 2020. The

Government's obligation for performance of this contract beyond that date is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the

Government for any payment may arise for performance under this contract beyond 30 September 2020, until funds are made available to the Contracting Officer for performance and until the Contractor receives notice of availability, to be confirmed in writing by the Contracting Officer.

(a) Definitions. As used in this clause—

“Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.

“Document type” means the type of payment request or receiving report available for creation in Wide Area

WorkFlow (WAWF).

“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.

“Payment request” and “receiving report” are defined in the clause at 252.232-7003, Electronic Submission of

Payment Requests and Receiving Reports.

(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232-
