PERFORMANCE WORK STATEMENT
Insider Threat – Situational Awareness Training for Task Force Southwest 18.1
1.0 Introduction.
Marines require training for knowledge and skillsets in order to appropriately respond to an insider threat situation.
This requires each Marine to be able to read and assess a situation prior to any incident occurring. For this to be effective, the Command Element must be trained in Insider Threats - Situational Awareness Training.
2.0 Scope.
The contractor shall provide a three day course at Camp Lejeune North Carolina for up to fifty (50) students. Period of instrcution will be from 11 December 2017 to 13 December 2017. The course shall include training shall at a minimum consist of classroom seminar style academic delivery combined with photo and video practical applications which are applied in practical application of increasingly complex scenario driven exercises:
2.1 Reading of human behavior to determine intent with effective decision making framework.
2.2 Focus of reading and recognizing “pre-event” indicators.
2.3 Provide students ability to practice insider threat and situational awareness training skills by utilizing the knowledge gained in the instruction provided.
2.4 Provide conditions whereby students must combine their individually created profiles of situations with other students to create an organizational profile.
2.5 Provide hands-on experience that leads to the development of individual and unit adaptability and resilience and the ability to detect, observe and engage indigenous personnel demonstrating indicators of hostile intent in order to prevent future threats.
3.0 Applicable Documents

4.0 Technical Requirements
The contractor will provide a 3 consecutive day training package utilizing Marine Corps Base Camp Lejeune facilities.
5.0 Government Responsibilities
5.1 Unit specific items of equipment will be provided by the unit per their organizational Table of Equipment.
5.2 Individual and Team Uniforms and Equipment
5.3 One M4 Carbine, Glock 19, or M9 per student, as required
5.4 All Communications Equipment Items, GPS & Specialty NavAid Electronics
5.5 Classroom Training space to accommodate up to fifty (50) students which is capable of audio visual presentation.
5.6 Open training area for students and instructors to perform practical application scenarios. A parking lot or maintenance bay may be used in fulfillment of this.
6.0 Contractor Responsibilities
6.1 Experience in training events directly associated with Insider Threats and Situational Awareness Training.
6.2 Six (6) years minimum experience of training/teaching

8.2 Practical Application of:
8.2.1 Six scenarios consisting of:

8.2.1.4 Patrol/ Pre Combat Checks, Pre-combat inspections

8.2.1.6 A student led interactive scenario based on; define, describe, evaluate, and determine based on the hosting unit’s pattern of life or most direct insider threat concerns.
9.0 QASP. The QASP details how the Government will ensure the service is performed in accordance with the
PWS.
9.1 Measure: The contractor shall provide for all deliverables in paragraph VII in a manner that covers the intended scope of paragraph II.
9.2 Method of assurance: 100% inspection through participation of the unit to receive the training.
10.0 Contractor Unauthorized Work Performance. The Contractor shall not perform work that deviates from contract requirements and specifications. If the Contractor deviates from contract requirements and specifications without approval of the CONTRACT ADMINISTRATOR and/or the CONTRACTING OFFICER, such deviation shall be at the risk of the Contractor and any cost related thereto shall be borne by the Contractor.
11.0 Employees.
11.1 The Government reserves the right to restrict the employment of any Contractor employee who violates federal regulations or is identified as a potential threat to the security, safety, health or operational mission of this base and its population. Contractor employees are allowed on base while in a work status. They shall not loiter on, or around the base during off duty hours. The removal of such persons shall not relieve the Contractor from providing all the services described herein.
11.2 The Contractor shall furnish sufficient number of qualified supervisory, administrative, and labor/journeyman personnel to accomplish all required contract services. The Contractor shall be staffed at all times during normal working hours with personnel authorized to book shipments and arrange for services under this contract. The
Contractor shall provide English reading, speaking and writing personnel at all times during packing and unpacking services. Any personnel appearing to be under the influence of alcohol or drugs, or using abusive language shall be replaced with qualified personnel for completion of services being performed. During the performance of this contract, Contractor's employees shall wear neat, clean clothing. The Contractor’s employees shall be identified by having company and employee name on, or attached to, the upper front of their clothing/uniform. The Contractor is responsible for acquiring an appropriate number of uniforms, tags or badges to meet these requirements at his own expense and without cost to the employee.
11.3 Conflict of Interest. The Contractor shall not employ the following personnel:
a. Off-duty quality assurance personnel.
b. An employee of the U. S. Government if the employment of that person would create a conflict of interest.
c. An alien who does not have a valid U. S. Immigration Alien Registration card.
11.4 Physical Location. The awarded contractor must have centralized operations and storage facilities within the geographical area of operations of MCB Camp Lejeune to include the counties of are Onslow, Duplin, Jones, Pender, New Hanover, Brunswick and Columbus.
12.0 Business Access Security Requirements.
12.1 Rapid Gate Access Planning.
12.2 In order to gain access to Marine Corps Base, Camp Lejeune and Marine Corps Air Station (MCAS), New
River non-Federal Government and non-DoD issued ID cardholders require identity proofing and vetting to determine fitness and eligibility for access. Specifically, a check of records through the National Crime Information
Center (NCIC) Interstate Identification Index (III) is the installation’s minimum background check for access to these installations (MCAS) for non-Common Access Card holders, to include entrance of visitors.
12.3 Marine Corps Base, Camp Lejeune and Marine Corps Air Station (MCAS), New River applies the following non-Federal Government cardholder criteria to determine the authorized type of access control credentials:
a. Contractors: RAPIDGate or 30-Day Pass followed by 4-DayPass*
b. Sub-Contractors: RAPIDGate or 30-Day Pass followed by 4-Day Pass*
c. Vendors: RAPIDGate or 30-Day Pass followed by 4-Day Pass*
d. Suppliers: RAPIDGate or 30-Day Pass followed by 4-Day Pass*
e. Service Providers: RAPIDGate or 30-Day Pass followed by 4-Day Pass*
f. Delivery Personnel: RAPIDGate or 30-Day Pass followed by 4-Day Pass*
g. Public-Private Venture (PPV) Housing and Installation Volunteers: Local Population Credential.
12.4 Contractor Common Access Card (CAC) Eligibility: Contractor personnel authorized CAC’s are exempt from
RAPIDGate enrollment.
12.5 Contractor personnel who are ineligible for a CAC will be required to either obtain a 30-Day pass followed by a 4-Day pass* or enroll in the RAPIDGate Program. RAPIDGate is a voluntary program due to associated costs.

12.6 The Government will not be responsible for any access delays. Delays that may result from inadequate planning are contractor responsibility. Any and all costs associated with RAPIDGate are the sole responsibility of the contractor.
12.7 Contractors not enrolled in RAPIDGate will be issued a one-time pass for 30 days. Upon expiration of the 30 day pass, they will only be issued a 4 day pass every 4 days thereafter, for the duration of the contract.

5237.102(90) The contractor shall report contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for aircraft maintenance via a secure data collection site.
Contracted services excluded from reporting are based on Product Service Codes (PSCs). The excluded PSCs are:
(1) W, Lease/Rental of Equipment;
(2) X, Lease/Rental of Facilities;
(3) Y, Construction of Structures and Facilitites;
(4) D, Automatic Data Processing and Telecomunications, IT and Telecom-Telecommunications Transmission
(D304) and Internet (D322) ONLY;
(5) S, Utilities ONLY;
(6) V, Freight and Shipping ONLY;

Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year
(FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contractors may direct questions to the help desk, linked at https://doncmra.nmci.navy.mil.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The following factors shall be used to evaluate offers:
THIS PROCUREMENT IS 100% SET-ASIDE FOR SMALL BUSINESS. ALL RESPONSIBLE SMALL
BUSINESS SOURCES MAY SUBMIT A RESPONSE WHICH, IF TIMELY RECEIVED, WILL BE
CONSIDERED BY THE AGENCY.
Quotes will be evaluated and ranks according to price, from lowest to highest. The Government reserves the right to evaluate only the technical proposal of the lowest price offeror. Other technical proposals may not be evaluated unless the Government determines the lowest price offeror to be unacceptable or non-responsive. In the event that
Government determines the lowest price offeror to be unacceptable, the technical proposal of the next lowest price offeror will be evaluated. This process will continue until a technical proposal is determined to be acceptable.
Technical acceptability will be based on the demonstrated ability to meet the technical requirements, including the delivery requirement. A mere statement that the vendor "will meet the Government's requirements" is insufficient;
the vendor must demonstrate how it will meet the requirement. Lowest Price Technically Acceptable (LPTA) will be evaluated on: (1) price; (2) technical; and (3) delivery.
To ensure technical compliance with the requirements, vendor quotes shall include the following information:
a. Vendor Specifications. The manufacturer's name and manufacturer's complete part numbers of items shall be submitted in the quote.
b. Vendor's quote shall include an active Cage Code and Federal Tax Identification number.
Vendors are required to be registered with SAM database and have an active cage code at the time of award.
c. Delivery Information. Clearly state if the quoter can meet the requested delivery as stated in each
CLIN. If not, then state the best delivery date.
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (JAN 2017)

The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at https://www.sam.gov/portal . If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision.
(a) Definitions. As used in this provision--
“Administrative merits determination” means certain notices or findings of labor law violations issued by an enforcement agency following an investigation. An administrative merits determination may be final or be subject to appeal or further review. To determine whether a particular notice or finding is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance.
“Arbitral award or decision” means an arbitrator or arbitral panel determination that a labor law violation occurred, or that enjoined or restrained a violation of labor law. It includes an award or decision that is not final or is subject to being confirmed, modified, or vacated by a court, and includes an award or decision resulting from private or confidential proceedings. To determine whether a particular award or decision is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance.
“Civil judgment” means--
(1) In paragraph (h) of this provision: A judgment or finding of a civil offense by any court of competent jurisdiction.
(2) In paragraph (s) of this provision: Any judgment or order entered by any Federal or State court in which the court determined that a labor law violation occurred, or enjoined or restrained a violation of labor law. It includes a judgment or order that is not final or is subject to appeal. To determine whether a particular judgment or order is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance.
“DOL Guidance” means the Department of Labor (DOL) Guidance entitled: ``Guidance for Executive Order 13673, `Fair Pay and Safe Workplaces' ''. The DOL Guidance, dated August 25, 2016, can be obtained from www.dol.gov/fairpayandsafeworkplaces.
“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically https://www.sam.gov/portal http://www.dol.gov/fairpayandsafeworkplaces disadvantaged in accordance with 13 CFR part 127. It also means a State agency designated to administer an OSHA-approved State Plan, but only to the extent that the State agency is acting in its capacity as administrator of such plan. It does not include other Federal agencies which, in their capacity as contracting agencies, conduct investigations of potential labor law violations. The enforcement agencies associated with each labor law under E.O. 13673 are--
(1) Department of Labor Wage and Hour Division (WHD) for--
(i) The Fair Labor Standards Act;
(ii) The Migrant and Seasonal Agricultural Worker Protection Act;

“Forced or indentured child labor” means all work or service—
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
“Inverted domestic corporation,” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
“Labor compliance agreement” means an agreement entered into between a contractor or subcontractor and an enforcement agency to address appropriate remedial measures, compliance assistance, steps to resolve issues to increase compliance with the labor laws, or other related matters.

“Labor law decision” means an administrative merits determination, arbitral award or decision, or civil judgment, which resulted from a violation of one or more of the laws listed in the definition of ``labor laws''.
“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except—
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

Sensitive technology—
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act

“Service-disabled veteran-owned small business concern”—
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.
“Small disadvantaged business concern, consistent with 13 CFR 124.1002,” means a small business concern under the size standard applicable to the acquisition, that--
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

(1) Not less than 51 percent of which is owned by one or more veterans(as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

“Women-owned business concern” means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women.

“Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127),” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the
