PERFORMANCE WORK STATEMENT

SCOPE

In support of Department of Defense (DoD) initiatives to improve the control of hazardous materials (HM), the Contractor will provide information technology (IT) and scientific support to the HM Management Program at Marine Corps Base Quantico (MCBQ). This support includes three major tasks, which are: (1) transitioning the HM data currently stored in the Hazardous Substance Management System (HSMS) to the Hazardous Materials Management System (HMMS), (2) maintaining current data in the HMMS database, and (3) inspecting work centers to ensure that HM storage and usage are in compliance and conformance with applicable regulations and orders. MCBQ has 340 work centers with HM that will require performance of these tasks. The details of these tasks are discussed in Section 4.0, Task Requirements.

BACKGROUND

Executive Order (EO) 13693, Planning for Federal Sustainability in the Next Decade, requires federal agencies to reduce the procurement and use of HM. Marine Corps Base Order (MCBO) 6280.4A, Hazardous Material Management Program, outlines policies and procedures for meeting these requirements at MCBQ. In particular, the Order specifies policies and procedures for (1) the acquisition of HM, (2) safety data sheet (SDS)/material safety data sheet (MSDS) maintenance, (3) HM storage, (4) HM tracking, and (5) reporting. This contract will assist MCBQ in achieving these objectives.

APPLICABLE DOCUMENTS

1.1 The Contractor will be required to use the following documents, which contain Federal regulations and United States Marine Corps (USMC) guidance regarding HM:

· Marine Administrative Message (MARADMIN) 032/16, Guidance for Marine Corps Enterprise Life Cycle Management of Hazardous Materials and Hazardous Waste;

· EO 13693, Planning for Federal Sustainability in the Next Decade;

· 29 Code of Federal Regulations (CFR), Occupational Safety and Health Administration (OSHA) Worker Protection Regulations;

· 40 CFR, Environmental Protection Agency (EPA) Hazardous Waste Regulations;

· 49 CFR, Department of Transportation (DOT) Hazardous Materials Regulations;

· National Fire Protection Association Standards;

· Federal Standard 793; Depot Storage Standards.

· Marine Corps Order (MCO) 4450.12A, Storage and Handling of Hazardous Materials;

· MCBO 6280.4A, Hazardous Material Management Program;

· MCO 4140.5A, Shelf-Life Program (February 2015);

· MCBO 6280.1B, Handling, Transfer, and Disposal of Hazardous Materials and Hazardous Waste; and,

· MCBQ Environmental Standard Operating Procedure (ESOP) 3, Hazardous Material Management.

1.2 The Contractor may be required to consult additional documents, as requested by the MCBQ Natural Resources and Environmental Affairs (NREA) staff.

TASK REQUIREMENTS

Using Government-furnished hardware, software, wireless network access, and one (1) Common Access Card (CAC)-enabled computer, the Contractor shall perform the following tasks:

4.1 Task 1: Data Migration and HSMS Maintenance

· Transfer data (including work center authorized use lists (AULs) and inventories) from HSMS to HMMS – minimum ten (10) work centers per month.

· During the migration, the Contractor shall perform IT-related maintenance of the HSMS system, including weekly data backups.

· During the migration: Maintain AULs and inventories for those work centers that remain in HSMS. The Contractor shall maintain current AULs by entering data from AUL Approval forms. The Contractor shall maintain current HM inventories by entering data from HM Usage and HM Received reports. All AUL Approval data shall be entered into HSMS within forty-eight (48) hours of being received (pending approval by the AUL Working Group). HM Usage and HM Received data shall be entered into HSMS within fourteen (14) days of being received.

· During the migration: In addition, the Contractor shall extract data from HSMS. The Contractor shall extract data as requested by the HM Program Manager, to meet reporting requirements for the Emergency Planning and Community Right-to-Know Act (EPCRA), Environmental Compliance Evaluations, and other regulations and orders.

· Finally, the Contractor shall ensure that HM program documentation is in compliance and conformance with applicable regulations and orders.

4.2 Task 2: HMMS Maintenance

· Maintain accurate and current data in the database. This includes maintaining current AULs by entering data from AUL Approval forms. This also includes maintaining current HM inventories by entering data from HM Usage and HM Received reports. All AUL Approval data shall be entered into HMMS within forty-eight (48) hours of being received. HM Usage and HM Received data shall be entered into HMMS within fourteen (14) days of being received. Finally, the Contractor shall produce barcodes for newly-inventoried materials. The barcodes should be produced within forty-eight (48) hours of updating the inventory.

· Develop specific data-entry policies.

· Perform IT-related maintenance and upgrades of HMMS, as requested by Headquarters Marine Corps (HQMC).

· Respond to user requests for assistance with the database. (Note: The Contractor will not be set as an administrator on HMMS).

· Direct requests for HMMS passwords to the HMMS contractor at the Headquarters Marine Corps (HQMC) level.

· The Contractor shall extract data from HMMS. The Contractor shall extract data as requested by the HM Program Manager, to meet reporting requirements for EPCRA, Environmental Compliance Evaluations, and other regulations and orders.

· The Contractor shall ensure that HM program documentation is in compliance and conformance with applicable regulations and orders.

4.3 Task 3: Work Center Inspections and MSDS/SDS Maintenance

· Inspect work centers to ensure that HM storage and usage is in compliance and conformance with applicable regulations and orders; minimum fifteen (15) work centers per calendar month. The Contractor shall summarize the results of the each inspection in a one-page report, and submit the report to the HM Program Manager within twenty-four (24) hours of performing the inspection.

· Submit MSDSs/SDSs to the Hazardous Materials Information Resource System (HMIRS).

PERIOD OF PERFORMANCE

The Period of performance for this effort consists of a twelve (12) month base year and four (4) twelve (12) month option years. Each period is subject to the FAR 52.217-8 (Option to Extend Services) clause for 6 months performance; however, regardless of when or the number of times the clause is invoked, the total period of performance under this clause cannot exceed 6 months for the entire contract. If the base period and each option period are exercised, including the aforementioned option to extend services, the total period of performance of this contract cannot exceed five and a half (5 ½) years.

The Period of Performance reads as follows:

Option Period Two1 March 2019 – 29 February 2020
Option Period Three1 March 2020 – 28 February 2021
Option Period Four1 March 2021 – 28 February 2022

6.0 PLACE OF PERFORMANCE

The work described in this PWS will be performed at Marine Corps Base Quantivo, VA

7.0 SECURITY REQUIREMENT.

7.1 The Contractor shall provide personnel that is elegible to obtain a Common Access Card (CAC) at the base. Contractor personnel assigned to this contract who are accessing the base shall complete an SF-85 and MUST be elegible to obtain access and a CAC. Background checks will be conducted in accordance with the the National Agency Check with Inquiries (NACI) criteria. These positions do not require additional clearances.

7.2 The Contractor must provide the Contracting Officer with a list of all contractor personnel working on site at least three (3) days before work begins.

8.0 CONTRACTING OFFICER REPRESENTATIVE (COR)

Inspection and acceptance of contract deliverables is the responsibility of the COR. The COR serves in a supporting role to the Contracting Officer by providing advice and expertise on technical issues. However, only the Contracting Officer has authority to modify the terms and conditions of this contract.

9.0 WORKING ON A GOVERNMENT INSTALLATION

9.1 The Contractor and their employees shall be subject to all traffic, security, and registration regulations for personnel and vehicles.

9.2 The Contractor will provide their own modes of transportation when performing their duties on MCBQ.

9.3 All Contractor personnel attending meetings, answering Government telephones, working on site, where their Contractor status is not known to third parties must identify themselves as Contractors. Contractor personnel shall also ensure that when logged onto Government equipment that their profile shows them as Contractor personnel.

10.0 DATA RIGHTS

10.1 General. All reports, materials (including training materials, computer software and hardware, source code, interfaces, tools, works, and related items) and information, in whatever form, created, generated, or produced under this contract shall become the property of the Marine Corps; therefore, the Marine Corps shall have the right to use, modify, reproduce, perform, display, release, or disclose such reports, materials, and information in whole or in part, in any manner, and for any purpose whatsoever, and to have or authorize others to do so.

10.2 No data, materials, or other items created or provided expressly for this contract shall be used by the Contractor for any purpose other than the support and performance under this contract without the prior written permission of the Contracting Officer. The Contractor is obligated to protect from unauthorized use or disclosure all Government confidential or classified material and Government-owned proprietary data obtained in the course of performance of services under Government contract as long as such data remains proprietary, confidential, or classified. Any information obtained in the course of duties or the performance of services under this contract including, but not limited to, information that may be made available for use which relates to the technical data, trade secrets, processes, operations, style of work, or apparatus, or to the technical data, statistical data, amount or source of any income, profits, losses, or expenditures of any person, firm, partnership, corporation, or association is included in this clause. Contractor personnel shall not publish, divulge, disclose or make known this information in any manner or to any extent not authorized by Commanding General, Marine Corps Combat Development Center.

11.0 QUALITY ASSURANCE

The Contractor’s performance shall be monitored against the requirements outlined in the Performance Requirements Summary (PRS).

12.0 DELIVERABLES

The Contractor’s work must comply with the criteria specified in Section 4.0 of this PWS. In addition, the Contractor will submit the following deliverables to the HM Program Manager:

12.1 Data Migration and HSMS Maintenance

· Weekly Reports. These reports shall include:

· A bulleted, one-page summary of accomplishments (from the previous week) and goals (for the coming week).

· A list of IT-related maintenance tasks performed on HSMS that week.

· A list of data-extraction tasks performed on HSMS that week.

· Monthly Reports. These shall include the following information:

· A list of work-center inventories updated in HSMS;

· A list of work-center AULs updated in HSMS;

· Names of the work centers migrated from HSMS to HMMS; and,

· Names of the work centers pending migration from HSMS to HMMS.

· Annual Reports. These shall include the following (for those work centers pending migration from HSMS to HMMS):

· HSMS AULs;

· Data to meet the requirements of EPCRA and Environmental Compliance Evaluations.

12.2 HMMS Maintenance

· Weekly Reports. These reports shall include:

· A bulleted, one-page summary of accomplishments (from the previous week) and goals (for the coming week).

· A list of data-extraction tasks performed on HMMS that week.

· Monthly Reports. These reports shall include:

· A list of work-center inventories updated in HMMS;

· A list of work-center AULs updated in HMMS;

· Annual Reports. These shall include the following:

· HMMS AULs;

· Data to meet the requirements of the EPCRA and Environmental Compliance Evaluations.

12.3 Work Center Inspections and MSDS/SDS Maintenance

· Weekly Reports. These reports shall include:

· A list of work centers inspected during the previous week, and a list of those that will be inspected in the coming week.

· Copies of inspection reports for the previous week’s inspections.

12.4 The Contractor shall provide deliverables electronically. The Contractor shall store electronic copies of all deliverables on the NREA share drive, and on removable media. Removable media may include CDs and DVDs. The Contractor must produce deliverables in software approved by the Contracting Officer Representative.

13.0 TRAVEL

The Federal Government will not require the Contractor to travel in support of executing the requirements of this PWS.

14.0 TRAINING

The Contractor must possess the following training prior to commencement of work:

14.1 General awareness training in the following areas:

· One or more courses that provide(s) an overview of the following Federal environmental laws and regulations:

· EPCRA;

· Oil Pollution Act (OPA);

· National Environmental Policy Act (NEPA);

· Clean Water Act (CWA);

· Clean Air Act (CAA);

· Federal Insecticide, Fungicide and Rodenticide Act (FIFRA);

· Endangered Species Act (ESA);

· Safe Drinking Water Act (SDWA);

· Hazardous Materials Transportation Act (HMTA);

· Resource Conservation and Recovery Act (RCRA);

· Toxic Substances Control Act (TSCA);

· Superfund Amendments and Reauthorization Act (SARA);

· Pollution Prevention Act (PPA);

· Federal Facility Compliance Act (FFCA);

· Occupational Safety and Health Act (OSH-Act);

· Comprehensive Environmental Response, Compensation and Liability Act (CERCLA);

· EO 13693, Planning for Federal Sustainability in the Next Decade;

· Title 49 CFR; DOT HM Regulations;

· Title 40 CFR; EPA Hazardous Waste Regulations; and,

· Title 29 CFR; OSHA Worker Protection Regulations.

· A course in Storm Water Awareness; per CWA.

· A course in Spill Management Awareness; per OSHA 29 CFR 1910.120.

· A course in Environmental Management System Awareness; per EPA ISO 14001.

· A course in Hazardous Materials General Awareness; per 49 CFR 172.704(a)(1).

14.2 Training that provides a comprehensive knowledge of the following Federal environmental regulations and standards:

· Hazard Communication Standard (HAZCOM); Globally Harmonized System (GHS) of Classification and Labeling of Chemicals (to include incidental spills); per OSHA 29 CFR 1910.1200.

· Handling and Storage of Flammable and Combustible Liquids and Aerosol Cans; per OSHA 29 CFR 1910.106.

· Depot Storage Standards; Federal Standard 793.

For the above, the Contractor must submit course completion certificates and outlines of course curricula (for all potential employees who will be working on site) as a part of its proposal package. The COR will inspect this documentation and make the final determination of the validity of the training. USMC/MCBQ-specific training (to include shelf-life training per Marine Corps Order (MCO) 4140.5A) will be provided.

15.0 WORKING HOURS

Desk space assigned for this contract will be open between 0730 and 1630, Monday – Friday; unless otherwise authorized by the COR.

16.0 FEDERAL HOLIDAYS

Government facilities will be closed during Federal Holidays. Federal Holidays are:

New Year’s Day, Labor Day, Martin Luther King Jr.’s Birthday, Columbus Day, President’s Day, Veteran’s Day, Memorial Day, Thanksgiving Day, Independence Day and Christmas Day

CONTRACTOR QUESTIONS & ANSWERS

Contractor Question #1: Where is the HSMS system currently run from? Is this system maintained by another contractor or USMC?

Government Response #1: The HSMS system belongs to the USMC, but it is currently being maintained by a contractor. The HSMS system is maintained onsite, in the Natural Resources and Environmental Affairs Office. The HSMS system is no longer on the USMC network, it is a stand-alone system.

Contractor Question #2: What database is currently being utilized to run the HSMS system? SQL Server, Oracle Database, Sybase, Informix?

Government Response #2: Oracle 8.0 is being used to run HSMS.

Contractor Question #3: What database is currently being utilized to run the HMMS system? SQL Server, Oracle Database, Sybase?

Government Response #3: The HMMS system is also an Oracle database.

Contractor Question #4: What are the other legacy systems used by USMC that the contractor will need reference for?

Government Response #4: To use HSMS, the contractor will need to know Oracle 8.0, Crystal Reports (to extract data from HSMS in fixed-format reports), and Windows NT (operating system).

Contractor Question #5: What is the estimated count of AUL’s and inventory (records) in the HSMS (Source System)?

Government Response #5: There are approximately 310 AULs in HSMS. There are 7,286 products on the Base's AUL, and 3,549 products in the Base's inventory (not every item on the Base's AUL is currently stocked).

Contractor Question #6: What is the estimated count of AUL’s and inventory (records) in the HMMS – (Destination System)?

Government Response #6: There are approximately 30 AULs in HMMS. Due to the way that HMMS is currently set up, The Government cannot provide inventory totals for Quantico work centers in HMMS at this time.

Contractor Question #7: Under [PWS] Section 4.2 "Respond to user requests for assistance with the database. (Note: The Contractor will not be set as an administrator on HMMS)." What privileges will be given to the contractor to fulfill user requests, query the data for reporting, database maintenance?

Government Response #7: To summarize, the support contractor will be given an HMMS account with routine user privileges, not administrator privileges. Database maintenance is done at HQMC, and the support contractor will not need administrator rights to perform data queries or to respond to most user requests. User requests that cannot be supported will be forwarded to the HMMS contractor at HQMC.

Contractor Question #8: Under section 14.0, 14.1 & 14.2 – Training – Does the contractor require training for all the courses for Federal environmental laws and regulations or any one from the list provided?

Government Response #8: The support contractor should have training that covers ALL of the environmental laws listed. The training can be accomplished through one or more courses.

Contractor Question #9: What technology platforms are HSMS and HMMS based on?

Government Response #9: HMMS is a web-based system that uses Oracle for database management. The support contractor will not be performing administrative maintenance (in an information technology capacity) on the HMMS database. The support contractor will need to know Jaspersoft to extract data in fixed formats from HMMS.

HSMS is an Oracle 8.0 database that uses Crystal Reports for fixed-format report writing. The operating system for HSMS is Windows NT.

Contractor Question #10: Solicitation states there are 340 work centers that need to be inspected over the course of the contract. Under the Travel section it is stated : The Federal Government will not require the Contractor to travel in support of executing the requirements of this PWS. How is it envisioned that the inspections will take place?

Government Response #10: All services will be performed aboard MCB, Quantico. There is no anticipated travel in support of the required services.

Contractor Question #11: Who is the incumbent on the development of the HSMS or HMMS systems?

52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (OCT 2015)

1. SUMMARY: This solicitation will result in a Firm Fixed Price (FFP) contract for the provision of Hazardous Materials Management Program aboard Marine Corps Installation National Capital Region (MCINCR), Quantico Virginia. The Government intends to award a single FFP contract for a base year and four (4) option years as a result of the solicitation.

2. FAIR OPPORTUNITY: This Request for Proposals (RFP) is solicited on an unrestricted full and open competition basis.

3. The Offeror is requested to thoroughly review the requirements of this solicitation and submit any questions via email to Rufus Lassiter at rufus.lassiter@usmc.mil no later than 2:00 p.m., Eastern Standard Time on Thursday, 1 December 2016.

4. SUBMISSION OF PROPOSAL:

Offerors shall submit hard copy and a compact disc with electronic copy of the entire proposals. Proposals shall be delivered to the Contracting Officer by 12:00 p.m. EST on Wednesday, 3 January 2017.

Proposals will not be accepted via e-mail. Proposals shall be sent via public or private courier or hand delivered to the following address and must be received prior to the cutoff date/time to:

5. FORMAT OF PROPOSAL:

1. Representations and certifications: The Offeror must post to https://www.sam.gov/index.html/#1 and must state that this has been accomplished when submitting the technical proposal.

1. Each Offeror must submit a proposal that includes the following:

a) Proposal shall contain the following volumes/sections:

Volume 1 – Offer Volume 2 – Technical Capability, Volume 3 – Performance Execution and Management Approach, and Volume 4 - Price

Proposal shall depict the approach proposed to execute each deliverable set forth under the PWS. For pricing, proposal shall include a price for each Contract Line Item Numbers listed in the RFP.

b) In order to maximize efficiency and minimize the time for evaluation of proposals, it is required that all proposals are submitted in accordance with the format and content specified herein.

· 8.5X 11 inch paper in 3-ring binders

· Single-spaced typed lines

· 1 inch margins on all sides

· 12 point font, Times New Roman

· Double sided pages

· Graphs and drawings must be clear and legible and may use a font no smaller than 8pt.

· No photographs or hyperlinks are permitted

· Microsoft Office or Portable Document Format (PDF) compatible files are required on the compact disc. The use of PDF documents shall only be for document requiring signature pages. All other documents shall be in Microsoft Word or Excel formats.

· Pricing narratives in Microsoft Word format and Pricing Data in Microsoft Excel format with no Macros.

The Government reserves the right to include all or part of the technical proposal in the award.

(b) The Offeror agrees to hold the proposal firm for 90 calendar days from the date specified for receipt of proposals.

(c) Offerors must be determined to be responsible to be awarded the contract.

All proposals must include the Offeror’s Cage Code, Data Universal Numbering System (DUNS) number, and Tax Identification Number

Volume 1 – Offer

The Offer Letter shall include a summary of the proposed price by CLIN including a total proposed price for this effort, Data Rights Assertion Listing, and the Organizational Conflict of Interest (OCI) Mitigation Plan proposed, if applicable. The Offer Letter shall be signed by an authorized company official and include the following:

1. The Solicitation number.

1. Company Information: the name, address, DUNS number, CAGE Code, and telephone number of the Offeror.

1. Authorized Personnel: the name, title, telephone number, facsimile number, and e-mail address of the company/division point of contact that can obligate the company contractually. Also, identify those individuals authorized to negotiate with the Government for this solicitation.

1. “Remit to” address, if different than mailing address.

1. Acknowledgment of all solicitation amendments (if applicable).

1. Agreement with terms. A statement specifying the extent of agreement with all terms, conditions, and provisions included in the RFP. Identify any enclosures being transmitted.

1. State the length of proposal validity (at least 90 days).

Standard Form (SF) 1449 – A completed, signed and dated SF 1449 form shall be included in the Offer (Volume 1). Failure to do so may lead to rejection of the offer.

Volume 2 – Technical Capability The Offeror shall provide a detailed description of the ability, resources and experience required to perform the requirements in the Solicitation, including the detailed procedures and methods to be used. The Offeror’s proposal shall demonstrate an understanding of and ability to meet all of the requirements covered in the Solicitation. The proposal shall be sufficiently complete to demonstrate how the Offeror will comply with Government tasking and requirements throughout the performance period. Data previously submitted, or presumed to be known, (i.e., team structure used under previous contracts) cannot be considered as a part of the proposal unless physically incorporated in the proposal. Clarity, completeness, and conciseness are essential.

Volume 3 – Performance Execution and Management Approach The Offeror's management volume submission shall include all relevant supporting information required or specified in the solicitation. This volume shall be limited to twenty (20) pages double sided. Exhibits (i.e., flowcharts, tables) and attachments attachments (i.e., list of assumptions) are not counted as part of the page limit.

The Offeror shall demonstrate an understanding of and ability to meet all of the requirements covered in the Solicitation. The proposal shall be sufficiently complete to demonstrate how the Offeror will comply with Government tasking and requirements throughout the performance period. Data previously submitted, or presumed to be known, (i.e., team structure used under previous contracts) shall not be considered as a part of the proposal unless physically incorporated in the proposal. Clarity, completeness, and conciseness are essential. The Offeror shall demonstrate the ability, resources and experience required to perform the requirements in the solicitation, including the detailed procedures and methods to be used.

Management - The Offeror shall include a detailed description of the management plan approach to managing the magnitude and complexity of work detailed in the PWS. The proposal shall describe the Offeror’s corporate experience and management structure to successfully perform all tasks required in the PWS. The proposal shall describe the Offeror’s ability to identify and implement cost efficiencies on the contract and manage personnel. The proposal shall provide information that demonstrates the Offeror's ability and resources for meeting the requirement tasks.

Teaming - The Offeror shall include a description of the teaming approach to be used in the overall operational concept for this contract. The proposal shall demonstrate the Offeror’s approach for communicating, coordinating, resolving problems and working successfully as part of the overall team. The proposal shall clearly describe team structures, relationships, roles and responsibilities that are clearly defined and established to provide maximum quality performance and minimize risk to performance.

Staffing - The Offeror shall include a detailed description of the staffing plan approach used to provide a fully qualified work force to include key personnel at contract award as well as the Offeror’s demonstrated ability to recruit, train, and retain sufficient numbers of personnel with required skill sets and security clearances to perform all PWS requirements.

Subcontracting Plan- If the Offeror is a large business, per FAR 19.702-1, and FAR 52.219-9(d), a subcontracting plan shall be submitted as part of the proposal. Contractor shall demonstrate that the desired small business subcontracting plan goal of 26% of the proposed total dollars is achieved. The small business(es) specified in the Small Business Participation Plan shall be included in the Small Business Subcontracting Plan.

The Offeror shall provide a subcontracting plan as part of their proposal. It is the policy of the U.S. Government to provide maximum practicable opportunities in its acquisitions to small business concerns, to include veteran-owned small business, service-disabled veteran-owned small business, HUBZone small business, small disadvantaged business and women-owned small business. Such concerns must also have the maximum practicable opportunity to participate as subcontractors in the contracts awarded by the executive agency, consistent with efficient contract performance.

The Subcontracting Plan shall be submitted with the proposal and will be reviewed by the Government to determine if it is Acceptable/Unacceptable. This plan shall be included as an attachment to this volume. Offerors must possess an acceptable Small Business Participation/Subcontracting Plan to be considered for contract award.

Volume 4 - Price

The Offeror shall provide sufficient pricing information to allow the Contracting Officer to determine the reasonableness of the proposed price. A summary sheet with the Offeror’s total price shall also be included in the price proposal. The price proposal shall be submitted in Microsoft Excel format with no macros.

The Offeror shall submit price narratives using Microsoft Word format and numerical price data using Microsoft Excel 2007 or later on a Compact Disc. The proposed price information shall be in unprotected spreadsheets that disclose the formulas and depict how the figures were computed. All price models submitted must be consistent with the Offeror’s estimating system and must duplicate the logic and mathematical formula reflected in the paper copy of the proposal.

Due to the competitive nature of this procurement, the Government is not requesting submission of certified cost or pricing data under this solicitation in accordance with FAR 15.4. The Offeror shall not submit certified cost or pricing data substantiating the cost elements being proposed. If adequate competition is not obtained or should a situation develop that the Government will require submission of information other than cost or pricing data, the Offeror should be prepared to submit the cost or pricing data within five business days after being requested by the Government.

The Offeror, subcontractor, interdivisional transfer, or any other business entity associated with the proposal may submit their sealed proposal directly to the Government or the Offeror.

Proposal/Offer is solicited on an “all or none” basis. Failure to submit an offer for all requirements of the PWS shall be cause for rejection of the offer. Non-compliance with any of the provisions herein may lead the Government to determine that an Offeror’s proposal is non-compliant and may result in removal from the evaluation.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

Technical Approach. It is the intention of the Government to award a contract as a result of the solicitation in accordance with FAR 13.5. Award will be made to the Offeror whose proposal is deemed most advantageous to the Government under the selection criteria set forth in this section. The Government intends to evaluate proposals and award a contract upon initial proposals, therefore, the Offeror's initial proposal shall contain the Offeror's best terms from a price and technical standpoint. The contract resulting from this solicitation will be awarded to that Offeror whose proposal, conforming to the solicitation requirements, is determined to provide the “best value” to the Government.

Evaluation Factors are (1) Technical Capability, (2) Performance Execution & Management, and (3) Price, in the following order of importance:

1. Factor 3, Price

The Government intends to evaluate proposals and award a contract without discussions with Offerors. However, the Government reserves the right to conduct discussions if the Contracting Officer determines them to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

Factor 1 - Technical Capability

The Offeror will be evaluated on their demonstrated knowledge and understanding of the technical and programmatic requirements outlined in the Performance Work Statement (PWS); ensuring their discussion articulates their capability so as to provide continuous quality support. The discussion must be able to demonstrate that the Offeror has the capacity to support the requirements, understands the priorities, and can execute a comprehensive approach that ensures quality performance and use of staff resources to meet objectives. The Offeror will be evaluated on their ability to adequately identify a suitable level of technical understanding. This includes, at a minimum, describing performance objectives that can be accomplished by their technical approach; describe the benefits and advantages of that approach; and effectively illustrate the roles of staff and team resources to execute the intended strategy.

The proposal must be able to demonstrate that the Offeror has the capacity to support the requirements, as follows:

Task 1: Data Migration and HSMS Maintenance The Contractor must be proficient (at the level of a system administrator) in the following software: HSMS, HMMS, Crystal Reports, Oracle Discoverer, and Microsoft Office. The Contractor must demonstrate a basic operational knowledge of Oracle 8.0 and Windows Server 2000.

The Contractor must demonstrate a history of modifying work center AULs, updating HM databases, and generating barcodes for newly-inventoried materials.

The Contractor must have experience with federal, state, and local legislation regarding HM; as well as DoD and USMC guidance on HM.

Task 2: HMMS Maintenance The Offeror must demonstrate experience maintaining HMMS.

The Offeror must demonstrate a history of modifying work center AULs, updating HM databases, and generating barcodes for newly-inventoried materials.

The Offeror must have experience with federal, state, and local legislation regarding HM; as well as DoD and USMC guidance on HM.

Task 3: Work Center Inspections and MSDS/SDS Maintenance The Offeror must demonstrate experience inspecting HM storage areas for compliance and conformance with regulations and orders regarding HM storage and handling. This requires that the Contractor have experience with federal, state, and local legislation regarding HM; as well as DoD and USMC guidance on HM.

The Offeror must demonstrate a history of MSDS/SDS research and must be able to use HMIRS. The Contractor shall also possess knowledge and experience with Federal Logistics (FED LOG).

Factor 2 - Performance Execution and Management Approach

The proposal will be evaluated on its ability to adequately define an effective management approach complementary to the proposed technical solution set forth in response to the criteria in the PWS. At a minimum, this includes identifying responsibilities and roles of team members; describing the processes and quality measures associated with executing the PWS; and illustrating the roles of staff and team resources relevant to the approach so as to ensure suitable oversight and control of performance execution. Collectively, the integrated approach must demonstrate to the evaluator that the Offeror possesses the capabilities and resources to establish and operate an efficient organization that is both responsive and flexible to meet the requirements of the PWS. Roles of management and other key staff are annotated and provisions for quality assurance are incorporated. Measures for immediate action and remediation are noted in the discussion so as to ensure the quality and timeliness of service. Key considerations include process maturity, roles of responsible staff, and controls at both the corporate and contract level under performance-based operating parameters.

The Government will evaluate the proposed subcontracting plan and validate if the proposal considered the small business subcontracting goal set forth in the solicitation.

In accordance with DFARS 215.304, the Government shall evaluate the extent to which Offerors identify and commit to small business participation for this acquisition. The Offeror’s Small Business Participation Plan shall be evaluated to determine:

· The extent to which small business firms are specifically identified

· The extent of commitment to use small business firms

· The complexity and variety of the work small firms are to perform

· The realism of the proposed participation plan

· The extent of participation of small businesses in terms of the value of the total acquisition (The Government’s preference or goal for small business participation in this effort is 35% of the total contract value.)

EVALUATION RATINGS

Factor 1, Technical Capability and Factor 2, Performance Execution & Management Based on the strengths, weaknesses, significant weaknesses, and deficiencies identified by evaluators, the SSEB will assign each technical and management factor an adjectival rating using the following adjectival rating scale:

Proposal meets requirements and indicates a thorough approach and understanding of the requirements. Proposal contains strengths which outweigh any weaknesses. Risk of unsuccessful performance is low.
ACCEPTABLE
Proposal meets requirements and indicates an adequate approach and understanding of the requirements. Strengths and weaknesses are offsetting or will have little or no impact on contract performance. Risk of unsuccessful performance is no worse than moderate.
MARGINAL
Proposal does not clearly meet requirements and has not demonstrated an adequate approach and understanding of the requirements. The proposal has one or more weaknesses which are not offset by strengths. Risk of unsuccessful performance is high.
UNACCEPTABLE
Proposal does not meet requirements and contains one or more deficiencies. Proposal is un-awardable.

Factor 3 - Price The cost and price analysis techniques set forth in FAR 13.106-3(a) are used to determine whether the offered price is fair and reasonable. The proposed price is reasonable when it is fair to the buyer, fair to the seller, and reasonable considering the market conditions, available alternatives, and price-related factors as determined through one or more of the price analysis techniques. The proposal will also be reviewed for consistency to ensure that all performance, scope, and assumptions proposed in other sections of the proposal are captured in the price proposal section.

The evaluated price shall be used in the trade-off analysis between the price and non-price factors to determine the best value. The evaluated price of the proposal shall be the total price for the base period and all option periods.

Best Value Determination- Comparison of the proposed pricing is considered in the overall evaluation of "best value” to the government based upon the anticipated level of competition. The Government may accept other than the lowest priced proposal if the perceived benefits of the higher priced proposal is deemed to merit the higher price. The price of the base year and all option years will be evaluated in accordance with FAR 52.217-5 Evaluation of Options (July 1990). Prospective Offerors are forewarned that a quote meeting solicitation requirements with the lowest evaluated price may not be selected if award to a higher evaluated Offeror is determine to be most advantageous to the government.

In the event that all non-price factors are rated equally, Price will become most important factor.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (JUL 2016)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at https://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (r) of this provision.

(a) Definitions. As used in this provision --

“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
