PERFORMANCE WORK STATEMENT
Purpose
Open since November 10, 2006, the National Museum of the Marine Corps (NMMC) is a military history museum dedicated to showcase the material history of the United States Marine
Corps (USMC).
The NMMC consists of seven (7) extent themed exhibit spaces:

Gallery 12 Vietnam
Each gallery portrays the history of the USMC through artifacts, graphics, audio and video media, theatrical lighting, life cast figures, interactive displays, scenic tableaus, and dioramas.
The NMMC intends to expand the existing USMC story beyond the Vietnam Gallery in a project titled The Final Phase. This project entails the creation of new galleries that will extend the
USMC storyline line from 1976 to present day and add/or update other related themed display spaces.
Scope
The contractor shall fabricate and install exhibits for the Final Phase projects in the following areas:
Gallery 1 Leatherneck Gallery (Update of the existing space)
See “Vietnam Tableau Exhibit Drawing Package” attachment for more detailed work scope.
Demolish existing Korea tableau. This includes removal of cast figures, removal of themed ground form and platform. The existing Sikorsky helicopter and associated mount to be removed by others.
Fabricate and install new tableau and associated ground form, graphics, railings and
Government supplied cast figures. Installation of UH-34 helicopter and associated mounts will be completed by others.
SBD Dauntless airplane-Raise and rig Government supplied airplane to hang from skylight. See “SBD Installation” attachment for more detailed work scope.

The NMMC has achieved and maintained a high level of quality in its exhibits earning it a gold standard rating with independent museum rating organizations, and winning awards for excellence from themed entertainment associations. It is incumbent on the contractor, and their sub-contractors, to maintain or exceed this level of quality and durability in the fabrication, installation and over all look and quality in the completed exhibitry. Any work failing to meet this standard, as deemed by the Contracting Officer Representative (COR), shall be corrected by the contractor at their expense. Time spent correcting rejected work shall not be accepted as a reasonable excuse for missing project deadlines. It is also the responsibility of the contractor, and their sub-contractors, to understand and adhere to the requirements of this document. It shall be understood that, for the sake of simplicity and to reduce redundancy, details listed herein are not always repeated on drawings. This is not meant to release the contractor from meeting these requirements. Any work not meeting the level of quality as specified in this document shall be corrected at the contractors expense to the satisfaction of the COR.
Drawings
1. Drawings shall be produced in AutoCAD 2014 or later as native format. Drawings created in other software will not be accepted. Drawings shall be submitted at 24 by 36 inches
(architectural size D).
2. Drawing Approvals. Drawings are to be submitted electronically as Adobe Portable
Document Format (PDF) files and one (1) set printed on bond paper at full size to the COR for review and approval. The COR will have ten (10) business days to review and make corrections to the drawings and return them to the contractor. All COR mark ups shall be incorporated into drawings and resubmitted for COR approval within seven (7) days. Drawings completed to the satisfaction will be signed and dated by the COR and stamped “APPROVED FOR
FABRICATION”. Only approved drawings shall be used by the contractor for production. No work shall commence without fully approved drawings. All designs and fabrication methods shown in drawings are to be followed by the contractor. Deviations are not permitted and shall be corrected at the expense of the contractor.
3. Close-out upon completion of the package the contractor shall issue a final set of drawings approved by the COR. The final set of drawings shall consist of two (2) hard copy sets and two
(2) sets of CD’s containing all files in PDF format and native software format.
Themed Ground Forms
This refers to the simulations of natural and man-made materials that are not feasible or cost effective to use. These simulations are combined with macro artifacts and life cast figures to recreate a historic scene with the intention of giving the visitors, in the most realistic way possible, a sense of how that scene looked. Final look of displays to be unique to the NMMC.
Commercially precast materials can only be used when modified in color and texture or as approved, in writing, by the COR. All molds, stamps and tooling created for the thematic texturing shall remain property of the Government and shall be surrendered to the COR when no longer needed for installation. The Contractor shall produce the floor coverings and ground forms to withstand continuous heavy visitor traffic – over 600,000 persons per year. The rockwork must support a minimum live load of 200 lbs. per square foot. Sharp edges that could in any way puncture, cut or scrape the visitors or create a tripping hazarad, shall not be accepted.
1. Design Document review. The COR will meet with the contractor to provide and review the scope as set forth in the design documents. All Government provided reference materials will be reviewed so as to educate the contractor on the thematic goals of the display. Based on this meeting the type and quantities of design deliverables will be agreed upon by both parties to include the numbers and type of samples required.
2. Fabrication strategy. The contractor shall hold meetings with the COR to review the contractor produced drawings, references and/or models that illustrate their understanding and interpretation of the design intent. When the COR is satisfied with the materials provided the contractor will be authorized to proceed with fabrication.
3. Fabrication. The contractor will fabricate elements as determined in the previous step. The
COR will make on-site visits as needed to assure adherence to the design direction and perfume interim approvals as needed.
4. Installation The contractor shall install the displays on-site performing all sculpting, painting and finishing steps required to achieve the desired effect as agreed to by the COR. The contractor shall install the life cast figures supplied to them as Government Furnished Equipment
(GFE) from the COR. As all themed displays feature a macro artifact, the contractor shall add painted details to macro artifacts to blend them into the look of the scene. All paint to be water based and shall be such that it does not degrade or damage the artifact. In all cases the COR will act as field art director and will provide artistic guidance to the team. The COR will make the determination as to the extent of types of details needed to achieve the final look of the scene.
The contractor shall notify the COR when a given scene is complete and ready for final acceptance. After the COR concurs that the display has met the established design goals, the scene will be considered complete and no further scenic modification shall be made.
Graphics
Graphics are integral to every museum display. NMMC has an established method of production for all its graphic types. The contractor shall produce two (2) dimensional graphics that match the production style currently existing in the museum. The types of graphics used in this project are detailed in the design documents.
The COR will provide electronic production files to the contractor in a PC based format. The contractor will alert the COR as to any issues they have with production of these files. These files are considered by the COR to be ready for production without modification. The
Government understands that it may still be necessary for the contractor to modify the files to suit their production process. This is acceptable given that the modifications do not alter the finished appearance of the graphic and the modifications are done prior to submission of any samples.
Prior to the start of production, the contractor will submit samples to the COR for approval. The quantity and type of samples required will be noted in the contract. After approval of the sample by the COR the contractor can proceed with production.
The contractor shall transport and install all graphics to the work site. All materials and systems are to be installed in accordance with manufacturers' instructions and COR approved submittals.
Install materials and systems in proper relation with adjacent exhibits and with uniform appearance.
Macro Artifact Installation
Artifacts such as tanks, ground vehicles and airplanes weighing up to 55 tons are generically refer to as Macro Artifacts. It shall be within the scope of the contractor to install these artifacts into the exhibits. When handling these artifacts it shall be the responsibility of the contractor to take all steps necessary to insure that they are free from damage and mishandling during installation and protection from damage after installation has completed. In planning for installation, the contractor will assume that NMMC will deliver the artifacts to the job site.
Installation dates and times shall be coordinated with the COR.
Steps to installation:
1. Engineering Design. All ground vehicles will be supported by a structural frame that holds the artifact at a predetermined height and angle. For aircraft, overhead rigging holds the plane at a predetermined height and angle. In both cases NMMC will provide the display heights and angles in the form of a design document. The contractor shall have the support structure designed by a Structural Engineer licensed in the state of Virginia and will present NMMC with a signed and stamped fabrication drawing package for approval before continuing to the next step.
2. Fabrication. Once approved the contractor shall fabricate the structural support to the exact specifications of the engineering drawing(s).
3. Structural support installation. The contractor shall install the structural support on-site in the position needed to satisfy the design intent. The contractor shall provide and perform all mechanical connections to the facility as called for in the engineering drawing.
4. Artifact installation. Upon installation on the structural support, the contractor shall secure the artifact as specified by the engineering drawings.
5. Artifact protection. Once installed the contractor shall protect the artifact from damage as a result of installation personal, machinery or agents which may discolor or stain the finish. This shall be accomplished by such methods as plastic wrapping, plywood barriers or other similar methods that are appropriate to the nature and finish of the artifact. These protective materials shall be removed by the contractor before project completion at a time agreed upon by the COR.
General requirements
1. Place of Performance. NMMC is located at 18900 Jefferson Davis Highway, Triangle, Virginia 22172. The museum is located within Prince William County on Marine Corps Base
(MCB) Quantico (Federal Property) and subject to concurrent jurisdiction within Prince
Willicam County.
The NMMC is currently opens to the general public from 09:00 AM until 5:00 PM, 364-days per year, except December 25, thus the Contractor will be working in areas that are in proximity to areas open to the public and will need to plan its construction and other activities accordingly.
For example, only work that does not degrade the visitors’ experience can be conducted during the hours that the museum is open. Work that is loud or degrades the visitors’ experience must be completed before 0900 or after 1700 each day. Loud or potentially degrading work is defined as noise created by any mechanical tool larger than a hand tool(s) that disrupts the visitor experience in the museum. This will be assessed on a case-by-case basis by the COR. Activities such as hammering and grilling will be permitted, but jack hammering or table saws will not be permitted during operating hours. Materials such as solvents and paint that potentially off-gas with an unpleasant of harmful vapors shall not be used in or around museum visitors or museum artifacts. Use of such materials shall be approved by the COR and it is the contractors responsibility to ensure it does not create a negative experience for the visitors or potential damage to musuem artifacts.
2. Delivery instructions. All exhibits are to be installed in the NMMC, 18900 Jefferson Davis
Highway, Triangle, Virginia 22172.
All deliverable items shall be packaged and marked according to the Exhibit Fabricator’s best commercial practices to ensure arrival at the specified destination free of damage or deterioration.
The Contractor shall comply with all shipping and hauling requirements of the State of Virginia, the USMC, and all other associated authorities.
All deliveries shall be coordinated with the COR. Any deliveries made without prior coordination run the risk of being refused at the discretion of the COR and at the expense of the contractor.
3. Travel. Milestone meetings and production meetings will be held at the museum. This shall require travel to the NMMC.
The Contractor shall conduct a site visit and verify all field conditions, dimensions and materials in the field after receipt of contract award, and before commencing work, with the understanding that the government drawings represent design intent and are not to be interpreted as ready-to-build. Deficiencies with the final produce caused by a lack of filed verification shall be corrected by the contractor at their expense to the satisfaction of the COR.
4. Working on a Government Installation. The contractor and his employees shall be subject to all traffic, security, and registration regulations for personnel and vehicles required for accessing
Federal property.
All Contractor personnel attending meetings, answering Government telephones, working on site, where their Contractor status is not known to third parties, must identify themselves as
Contractors on demand by Government personnel. Unless otherwise directed by the COR, all documents produced or revised by Contractors or developed through contract participation must be marked as “Contractor generated documents” or otherwise identified in a manner that discloses the Contractor’s participation.
The contractor and their sub-contractors shall understand they are working at a Government, military installation and shall comply will all posted rules and laws and/or as directed by
Government personnel. While on-site, all contracted personnel shall conduct themselves in a professional manner at all times and not create a situation that interferes the with Museum operations or with the general public’s visitor experience. Unacceptable or unsafe behavior will be documented by the COR and delivered to the contractor via email. It shall be the responsibility of the contractor to correct the behavior or remove the offending personnel per direction of the COR.
5. Deadlines. It shall be the contractors responsibility to meet all schedule milestones and deadlines agreed to by the COR for on-site installation. It is the responsibility of the contractor to complete all work, to include any punch list items, in time for the agreed upon deadline.
Payment will not be granted for incomplete work.
6. Hard Hats and Protective Equipment Areas. It is the Contractor's responsibility to require all those working on or visiting the site to wear hard hats and other necessary protective equipment at all times. All liners shall be changed before reissuing hats. The Contractor shall inspect personal protective equipment daily and maintain in a serviceable condition. Clean, sanitize, and repair, as appropriate, personal items before issuing them to another individual. Inspect and maintain other protective equipment and devices before use and on a periodic basis to ensure safe operation.
7. Hazardous materials. The Contractor shall ensure that all hazardous materials are stored in approved containers and are handled in a safe manner in accordance with Occupational Safety and Health Administration (OSHA) guidelines. Hazardous materials are defined as explosive, flammable, poisonous, corrosive, oxidizing, irritating, or otherwise harmful substances that could cause death or injury.
8. On-site work. The Contractor shall have the appropriate licenses and shall acquire the appropriate approvals required to work in Prince William County, VA. The Contractor shall comply with federal, state, and local regulations, and shall understand that the museum is subject to concurrent jurisdiction, including MCB Quantico, Prince William County, and the
Commonwealth of Virginia.
9. Waste Removal. The Contractor shall be responsible for removal of all waste from the work site. The use of onsite government controlled dumpsters may or may not be made available at the discretion of the COR. Requests for use of these dumpsters shall be confirmed with the COR prior to commencement of work. In the situation where onsite dumpsters are not available the offers shall remove all trash from the property or provided a dumpster at their expense.
10. Deliveries. The contractor is responsible for designating or arranging mutually-agreeable delivery dates of Government furnished equipment and for receiving, unloading and handling
Government-furnished equipment at the site.
11. Contract Performance. The Contractor shall fulfill this contract in such a manner that all key personnel will be able to successfully manage all requirements of this Performance Work
Statement (PWS). Key personnel are identified as the Project Manager, Project Coordinators, and site Foremen. The Contractor shall provide a single point of contact in the person of a
Project Manager on the job site for all issues.
12. Fire-retardant materials. The Contractor shall supply inherently fire-retardant materials for all specimens. These include Artificial Foliage, Fabrics and draperies and Plywood. Certification of all materials to be provided to COR during fabrication.
13. Security Requirements. During on-site installations, the contractor is responsible for:
-security of equipment and materials left on the museum campus, including but not limited to the lay down yard/area.
- security breaches perpetrated by all Contractor employees and all sub-contractors.
- security and safety during truck delivery, offload, staging, and other potentially dangerous work performed on the museum campus.
14. Material Submittals. The Contractor shall follow the following Submittal Process:
Materials, supplies, and equipment procured by the Contractor shall meet the specifications, standards, and manuals listed in these specifications and approved by the COR prior to installation. Submittals are required for approval by the COR. The Contracting Officer may at any time require test data showing that any materials or supplies procured by the Contractor meet the industrial specifications.
If the quality of an item is not specified, it shall be of acceptable industrial grade and quality, per industry standards, equal to or better than the manufacturer’s original, and will be compatible with existing systems.
Replacement parts shall be new. If new parts are not available, the Contractor may request approval, in writing, from the Contracting Office to use rebuilt parts. The use of rebuilt parts prior to written approval of the Contracting Officer is at the Contractor’s sole risk. All parts, whether new or rebuilt, shall carry the full warranty required by this contract.
The Government acceptance, review, or submittal approval of any portion of the proposal or final design shall not relieve the Contractor from fulfilling his responsibility of any errors or omissions with respect thereto.
15. Government Furnished Equipment (GFE). The Contractor is responsible for protecting GFE from damage, including damage from exposure to the elements, and to repair or replace items damaged as a result of mishandling by the Contractor’s handling or operations. The Contractor shall not accept any GFE without receiving a transmittal from the COR. The transmittal will be signed by the contractor and the COR showing receivership of the materials. Condition of the
GFE will be noted on the transmittal at time of signature.
16. Submittals. Documents submitted will be reviewed by the COR within ten (10) business days of receipt. Any submittals not meeting the requirements of the contract shall be rejected.
The Contractor has ten (10) business days within which to correct and resubmit to the COR for approval. Although the Government understands there are instances requiring a fast approval of a submittal, the COR will not waive their right to the stated review period due to improper planning on the part of the contractor. The Government shall not be liable for project delays in situations where the contractor failed to allow for the full approval period. Any expenses associated by delays due to this situation shall be the responsibility of the contractor.
17. Coordination. The contractor shall coordinate exhibit fabrication and installation activities to assure efficient and orderly installation of each part of the work. Coordination must assure safe and timely fabrication, transportation, and installation of all exhibits and associated elements listed in the solicitation. Coordination shall involve the coordination of all work by all
Contractors. Contractor to provide on-site project coordinator as point of contact during any site work.
Where installation of one (1) part of the work is dependent on installation of other components, either before or after its own installation, exhibit fabrication activities shall be scheduled in the sequence required to obtain the best and most efficient results.
The Contractor shall be responsible for coordinating any work that affects the fabrication of any exhibit components, the use of any exhibit components, and the installation of any exhibit components.
During all meetings with the COR the contractor shall take meeting minutes. At a minimum the minutes shall include: date of meeting, those in attendance, old business, new business, open and closed items. For all open items the party responsible for its resolution shall be noted. Open items shall remain on the minutes until closed. Closed items shall be removed from the next minutes after they became closed. Minutes will be given a unique number for tracking
18. Final Inspection. The Contractor shall notify the COR, via e-mail, upon completion of any and all completed exhibit elements ready for review. The COR will respond, in writing, with an approval or a list of deficiencies to be corrected after review. The Contractor shall correct all deficiencies in accordance with the COR’s direction. All corrective work shall be complete within seven (7) working days unless otherwise agreed to by the COR in writing.
19. Field Measurement. The Contractor shall be responsible for field measurement and verification of locations of all facility elements. This data is to be used to verify proper fitting of all exhibit elements. Any discrepancies that affect the exhibit design with recommended corrective fixes are to be submitted to the COR, in writing, for resolution. Locations and elevations shown on the drawings are subject to final field adjustment by the COR before fabrication and installation. The Contractor shall immediately notify the COR, in writing, of apparent errors discovered on the drawings or in the initial stakeout indicating any discrepancies in field dimensions on a plan or elevation drawing. All work improperly located due to
Contractor’s errors or omissions shall be corrected at no additional cost to the Government.
20. Key Personnel. The contractor hereby agrees to assign to the contract those individuals whose resumes were submitted with this proposal who are necessary to fill requirements of the contract. Key personnel are the Project Manager, Project Coordinators, and Foremen. No substitutions shall be made except in accordance with this clause. In case of unsatisfactory performance, the contractor will take appropriate corrective action within ten (10) business days of formal notification to correct the problem as identified by the COR. In the event that the problem remains unresolved in excess of ten (10) working days, the Contracting Officer will be notified by the COR so that appropriate action is taken, to include employee removal from current contract, if warranted. The contractor shall ensure that all Government owned property is returned to the COR should a contractor employee be removed. The contractor and its employees shall conduct only business covered by the contract during periods paid for by the
Government, and will not conduct any other business on Government Premises. Contractor personnel shall abide by all rules and regulations applicable to the Government premises, on which they work, including any applicable safety and security regulations as well as any measures necessary to verify contractor labor hours. Contractor employees assigned to the contract shall not solicit business while performing within the scope of the contract.
21. Rights to Materials. All materials (including, but not limited to, designs, fabrications, exhibitry, pictures, presentations, graphic works, and other PWS-related items), and all associated property or works, in whatever form, created, generated, or produced in association with this PWS shall become the sole property of the Marine Corps and not the contractor, subcontractor, or individual artist, fabricator, or author; therefore, the Marine Corps shall obtain the irrevocable, worldwide, royalty-free right to use, modify, reproduce, perform, display, release, or disclose such materials, and any associated intellectual property, in whole or in part, in any manner, and for any purpose whatsoever, and to have or authorize others to do so.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (MAR 2015)
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.acquisition.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (p) of this provision.
(a) Definitions. As used in this provision --
“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
"Forced or indentured child labor" means all work or service-
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
Inverted domestic corporation means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except--
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the
Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment
Act of 2007) conducting the business can demonstrate--
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
Sensitive technology--
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act
(50 U.S.C. 1702(b)(3)).
Service-disabled veteran-owned small business concern--
(1) Means a small business concern--
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
"Small business concern" means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.
Small disadvantaged business concern, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that--
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and
(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and
(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.
Subsidiary means an entity in which more than 50 percent of the entity is owned--
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation.
Veteran-owned small business concern means a small business concern--
(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
(2) The management and daily business operations of which are controlled by one or more veterans.
"Women-owned business concern" means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women;
and whose management and daily business operations are controlled by one or more women.
"Women-owned small business concern" means a small business concern--
(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least
51 percent of its stock is owned by one or more women; or
(2) Whose management and daily business operations are controlled by one or more women.
Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part
127)”, means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the
United States.
(b) (1) Annual Representations and Certifications. Any changes provided by the offeror in paragraph (b)(2) of this provision do not automatically change the representations and certifications posted electronically on the SAM website.
(2) The offeror has completed the annual representations and certifications electronically via the SAM website accessed through https://www.acquisition.gov.
