The Louisiana Preference certification form allows bidders to claim a ten percent preference for products produced, manufactured, or assembled in Louisiana, provided the bidder's workforce comprises a minimum of fifty percent Louisiana residents and the cost does not exceed competing bids by more than ten percent. Bidders claiming Louisiana preference must complete and submit this certification prior to bid opening; claims submitted on alternative documents or after bid opening will not be considered. Qualifying vendors offering Louisiana products within the ten percent threshold may match the lowest bid price. Additionally, a five percent U.S. price preference applies to domestically manufactured products. All bidders must be registered in LAPAC prior to submission and, if Louisiana or foreign LLCs or corporations, must be appropriately registered with the Louisiana Secretary of State. Payment is made within 30 days of receipt of a properly executed invoice or delivery, whichever is later, on an F.O.B. destination basis.

LOUISIANA PREFERENCE
NOTE TO BIDDER: In order for preference to be considered, bidder MUST complete this document in its entirety and provide it prior to bid opening. Preference submitted on any other document or after the bid opening will not be considered.
PREFERENCE OF PRODUCTS PRODUCED, MANUFACTURED, OR ASSEMBLED IN LOUISIANA
In accordance with the provisions of Louisiana R.S. 39:1604(H) & (I), each procurement officer, purchasing agent, or similar official who procures or purchases materials, supplies, products, provisions, or equipment under the provision of this Chapter may purchase such materials, supplies, products, provisions, or equipment which are produced, manufactured or assembled in Louisiana, as defined below, and which are equal in quality to other materials, supplies, products, provisions, or equipment, provided that all of the following conditions are met:
(1) The cost of such items does not exceed the cost of other items which are manufactured, processed, produced, or assembled outside the state by more than ten percent.
(2) The vendor of such Louisiana items agrees to sell the items at the same price as the lowest bid offered on such items.
(3) In cases where more than one bidder offers Louisiana items which are within ten percent of the lowest bid, the bidder offering the lowest bid on Louisiana items is entitled to accept the price of the lowest bid made on such items.
Louisiana preference shall apply only to bidders whose Louisiana workforce is comprised of a minimum of fifty percent Louisiana residents.
For the purposes of this preference, in accordance with R.S. 38:2251(A) the following definitions shall apply:
(1) “Assembled” means the process of putting together all component parts of an item of equipment by the manufacturer when the assembly plant is located within the territorial boarders of the state of Louisiana.
“Assembled shall not mean the process of reassembling parts packed for shipping purposes.
(2) “Louisiana products” means products which are manufactured, processed, produced or assembled in
Louisiana.
(3) “Manufactured” means the process of making a product suitable for use from raw materials by hand or by machinery. “Manufactured” shall not mean the process of assembling component parts.
(4) “Processed” means the alteration of any raw product altered from its original state to enhance its value or render it suitable for further refinement or marketing.
(5) “Produced” means the process of manufacturing, planting cultivating, growing, or harvesting.
