About this file

This file is a Louisiana Affidavit of Small Succession form used in the State of Louisiana for estate settlement purposes under Louisiana Civil Code of Procedure Article 3431 et seq. The document serves as a legal instrument for managing the succession of a deceased person's estate when the total value of assets does not exceed specified thresholds. The affidavit requires certification before a Louisiana notary public and must include documentation of the decedent's death date, last residence, marital status, and complete identification of all heirs with their addresses and social security numbers. The form also requires notation of any heirs who cannot be located despite reasonable diligence efforts and those who received ten-day notice of the succession intent via U.S. mail without objection.

The form necessitates a detailed accounting of the decedent's estate assets and debts, segregated between separate property and community property valuations, with the aggregate value capped at $75,000 when combined with any movable property. Each heir must acknowledge their percentage interest in the succession property and whether a surviving spouse's legal usufruct attaches to their inheritance. All participating heirs and affiants must sign the document and swear under penalty of perjury that the information provided is accurate and complete. The affidavit must be sworn before and notarized by a Louisiana notary public commissioned in the appropriate parish where the succession proceedings occur.
