PERFORMANCE WORK STATEMENT

1. INTRODUCTION:

a. The Defense Logistics Agency Disposition Services (DLADS) is a Major Subordinate Command (MSC) of the Defense Logistics Agency (DLA) with the primary responsibility of disposing of and reutilizing Department of Defense (DoD) excess and surplus property generated by the military services. This is accomplished through reutilization to other DoD activities, transfer to other Federal agencies, donation to authorized state and local organizations, sale to the general public, or ultimate disposal through abandonment or destruction. The headquarters for DLADS is located in Battle Creek, Michigan. DLADS Lejeune requires landscaping services as described in this Performance Work Statement (PWS) for Lots 202, and 906A.

b. Contractor personnel and subcontractors shall comply with applicable federal, local and host installation laws, safety regulations and procedures. Personal Protective Equipment (PPE) shall be provided by the Contractor and must be appropriate for the task. Contractor/subcontractors personnel and equipment are subject to safety inspections by government personnel.

c. The term Contractor applies to all subcontractor personnel/equipment/supplies that may be hired/provided by the Contractor.

d. Lot S1027 (Lot 202) is a 22,873 ft2 open storage lot (see appendix 1).

e. Lot 906A is a 4,878 ft2 scrap yard (see appendix 1).

2. PERIOD OF PERFORMANCE:

a. This is a firm-fixed price time and materials contract which consists of one (1) 12-month base period and four (4) 12-month options. The total contract length shall not exceed five (5) years.

3. TASKS TO BE PERFORMED:

The Contractor shall:

a. Furnish all personnel, management, supervision, properly trained labor, subcontractors, tools, transportation, equipment, supplies, products, materials to satisfactorily complete landscaping services at DLADS, Camp Lejeune, NC 28540.

b. Control grass, weeds, trees, and vines growing around or thru perimeter security fences and throughout the storage lots by mowing, weeding, trimming, spraying or edging.

c. Mow/trim areas identified in sections 1.d and 1.e to a maximum height of six (6) inches. Perimeter security fences shall be maintained with an eight (8) foot wide access cleared of brush and trees. Mowing/trimming shall take place in September of each year.

d. Apply herbicide to areas identified in sections 1.d and 1.e three (3) times every year (March, June, and December). Perimeter security fences shall be sprayed to maintain an eight (8) foot wide access clear of brush and trees.

e. Supplement with hand operations in locations that are inaccessible to the Contractor’s equipment.

f. Pick up and dispose of trash, litter, and debris as part of each landscaping operation. Trash, litter, and debris will be disposed of in approved waste containers on or off site which occur in March, June, September and December.

g. Repair damaged government facilities, government owned property and equipment caused by Contractor personnel.

4. HOURS OF OPERATION AND HOLIDAYS

a. The service to be performed under this contract shall be performed during normal U.S. Government (USG) business days. The schedule of service will be any normal workday Monday thru Friday 7:30 AM – 1:30 PM, and if not finished that day will return on the following workday to complete the task. Services will not be scheduled to be performed on a regular Federal holiday (see below), or one designated by Presidential proclamation.

b. * The holiday is observed on the preceding Friday or the following Monday when the holiday occurs on Saturday or Sunday, respectively.

5. BASE ACCESS AND SECURITY:

a. The Contractor shall coordinate base installation access for all their employees. The Contractor shall be familiar with and comply with all Base Command policies regarding security considerations for all Contractor employees.

b. Unscheduled gate closures by the installation security personnel may occur at any time causing all personnel entering or exiting a closed installation to experience a delay; this cannot be predicted or prevented. Contractors are not compensated for unexpected closures or delays. Vehicles operated by Contractor personnel are subject to search pursuant to applicable regulations. Any moving violation of any applicable motor vehicle regulation may result in the termination of the Contractor employee’s installation driving privileges.

c. Contractor employees shall become familiar with and obey the regulations of the installation, including fire, traffic, safety, and security regulations while on the installation. Contractor employees should only enter restricted areas when required to do so and only upon prior approval. All Contractor employees shall always carry proper identification with them and shall be subject to such checks as may be deemed necessary. The Contractor shall ensure compliance with all regulations and orders of the installation which may affect performance. The United States Government (USG) reserves the right to direct the removal of an employee for misconduct, security reasons, or any overt evidence of communicable disease. Removal of Contractor employees for reasons stated above does not relieve the Contractor from responsibility for total performance of this contract.

d. The Contractor shall comply with all applicable installation/facility access and local security policies and procedures, which may be obtained from the COR. The Contractor and all associated employees shall provide all information required for background checks to meet installation access requirements to be accomplished by installation security personnel. The Contractor shall ensure compliance with all personal identity verification requirements as directed by DoD and/or local policy. Should the Force Protection Condition (FPCON) change, the USG may require changes in Contractor security matters or processes.

6. U.S. GOVERNMENT FURNISHED PROPERTY, MATERIAL, EQUIPMENT, AND SERVICES (GFP/M/E/S):

a. Property: The USG will furnish the necessary workspace for the Contractor to perform services as outlined in this PWS.

b. Material: The USG will not provide any materials.

c. Equipment: The USG will not provide any equipment.

d. Services: The USG will provide utilities, if available at the lots identified in sections 1.d and 1.e, such as electricity and water to the Contractor for use in the performance of this contract. The Contract shall instruct employees in utilities conservation practices. The Contractor shall operate under conditions that preclude the waste of utilities, which include turning off the water faucets or valves after using the required amount.

7. CONTRACTOR FURNISHED PROPERTY, MATERIAL, EQUIPMENT, AND SERVICES (CFP/M/E/S):

a. Property: The Contractor shall not provide any property.

b. Material: The Contractor shall provide all materials such as petroleum, oil, and lubricants (POLs), and spill clean-up items for use during the performance of this contract.

c. Equipment: The Contractor shall provide all personal protective equipment, tools, and any other equipment required to perform under the provisions of this contract.

d. Services: The Contractor shall provide all supervision, quality control, trained and certified employees, and a primary and alternate point of contact (POC) with phone number.

8. QUALITY ASSURANCE (QA):

a. The USG will evaluate the Contractor’s performance under this contract IAW the Acceptable Performance Levels listed below. They are primarily focused on what the USG will do to ensure that the Contractor has performed IAW the performance standards as defined. They define how the performance standards will be applied, the method of surveillance, and the acceptable quality levels(s) or defect rate(s).

9. ACCEPTABLE PERFORMANCE LEVELS (APLs):

a. APLs are the minimum performance levels of specific requirements which the Contractor achieve or risk having the government consider performance unsatisfactory, which may result in monetary or other consideration from the Contractor.

b. If performance falls below the specified performance level, consideration may be taken at the USG’s discretion. Decisions will consider the impact on the USG because of the failure to meet the performance requirement and the number of times the failure has occurred throughout the contract period.

c. Performance incentives for the Contractor will include, but are not necessarily limited to, favorable impact on option exercise decisions, future awards of the same requirement, and future awards of similar requirements by DLADS as well as other government and non-government entities that may review performance of this contract.

10. CHEMICALS

a. Chemicals used in the performance of the work shall be purchased by the Contractor and issued to the Contractor’s employees in the original manufacturer’s containers. All chemicals must be authorized for use on Camp Lejeune and meet all the installation requirements. All containers shall identify the type of chemical, instructions for use, dilution, and any hazardous warnings. Products shall be recommended by the manufacturer for their intended use and shall be compatible with other manufacture’s products used in conjunction with these products. Products must have been available in the market for commercial use for at least two (2) years. Manufacturer’s published data will be the only acceptable evidence of materials meeting this requirement.

11. SPILL RESPONSIBILITY:

a. The Contractor is solely responsible for all spills or leaks during the performance of this contract, which occurs because of, or is contributed to by the actions of its agents, employees, or subcontractors. The Contractor shall clean up such spills or leaks to the satisfaction of the USG in a manner that complies with applicable Federal, state, and local laws and regulations. The clean-up shall be at no cost to the USG. The Contractor shall report all such spills or leaks, regardless of their quantity, to the COR and Contracting Officer (KO) immediately upon discovery. A written follow-up report shall be submitted to the COR and KO not later than twenty-four hours after the initial telephonic report. The written report shall be in narrative form, and as a minimum shall include the following:

1. Description of item spilled (including identity, quantity).

2. Whether amount spilled is EPA or state reportable, and if so, whether it was reported. Exact time and location of spill including a description of the area involved.

3. Containment procedures initiated.

4. Summary of any communications Contractor has with press or USG officials other than the KO.

5. Description of clean-up procedures employed or to be employed at the site including disposal location of spill residue.

6. Description of item spilled (including identity, quantity).

12. DLADS ENVIRONMENTAL MANAGEMENT SYSTEM (EMS):

a. DLADS implemented an Environmental Management System (EMS) in accordance with ISO 14001:2015(E), DOD, and DLA requirements at all appropriate DLADS facilities. An EMS is an overall management system that includes organizational structure, planning activities, responsibilities, practices, procedures, processes, and resources for developing, implementing, achieving, reviewing, and maintaining the environmental policy of an organization. The DLADS EMS is designed to ensure that all personnel, including contract personnel, whose work activities can cause real or potential significant environmental impact, are aware of how their work supports the EMS and are competent to perform their roles, responsibilities and authorities while supporting the DLADS mission. The DLADS EMS program is explained in the agency EMS Core Instruction. Site supplements may detail information required by EMS at a local level such as local, state and host environmental regulations as well as local emergency procedures and operating procedures unique to the location. Site supplements also contain information concerning the local interaction between the appropriate DLADS tenant facility and the DOD/DLA host facility EMS program. Contractors and their personnel are required to be aware that each appropriate DLADS facility has an EMS and to be aware of EMS policies to perform work and/or gain access to an installation. Each DLADS facility maintains EMS awareness posters that identify the DLADS Environmental Management Representative (EMR) and host facility EMR for specific guidance concerning an individual facility’s EMS program. Contractors may request current copies of EMS information identified in this Section by contacting the local COR.

14. INVOICING:

a. The Contractor will invoice on a monthly basis through the Department of Defense Wide Area Workflow (WAWF) system. Invoices must be submitted through WAWF in accordance with Defense Federal Acquisition Regulations Supplement (DFARS) 252.232-7003. Refer to https://wawf.eb.mil for additional information.

b. The COR will verify contractor hours reported in WAWF compared to recorded hours during performance prior to approving the invoice.
