About this file

This document is a Justification for Other than Full and Open Competition (JOTFOC) for the U.S. Coast Guard. The procurement involves purchasing three MA Shaft Seal Overhaul Kits (Part Number WLP001272-001, NSN 5330-01-527-0959) from Defense Maritime Solutions, Inc. at $46,022.03 each, for a total estimated value of $138,066.09. The kits are specifically required for 270' WMEC Platforms and are critical for maintaining the propulsion shaft seal, with the potential to prevent ship flooding and mission capability loss.

The justification cites unique technical requirements and proprietary specifications as the rationale for sole-source procurement. The shaft seal assemblies must meet exact configuration management standards outlined in Commandant's instruction 4130.6A, and are part of an Approved Parts List (APL 83717240A5) used on the 270 fleet. The Coast Guard cannot obtain the manufacturers' drawings and specifications, and the Original Equipment Manufacturer (OEM) is deemed the only known provider meeting the precise form, fit, and function requirements. The Contracting Officer has determined that only one responsible source is available to satisfy the agency's needs.

3. Description of Supplies or Services: Purchase: Three (3) MA Shaft Seal Overhaul

Kits, P/N WLP001272-001, NSN: 5330-01-527-0959, cost each $46,022.03.

4. Estimated Value of Procurement: $138,066.09.

5. Source Available:

Name: Defense Maritime Solutions, Inc.

Address: 3617 Koppens Way, Chesapeake VA 23323

6. Pursuant to FAR Subpart 13.106-1 (b), the Contracting Officer may solicit from one source if they determine that the circumstances of contract action deem only one source reasonably available; check the appropriate reason below:

X - Only one responsible source and no other supplies or services will satisfy agency requirements, i.e. Unique capabilities, Limited number of sources, Proprietary data or

- Brand Name Mandatory

- Unusual & Compelling Urgency

- Exclusive Licensing Agreements

- Industrial Mobilization/Standardization

7. The shaft seal creates the barrier where the propulsion shaft penetrates the hull preventing the entry of seawater. The MA Shaft Seal Overhaul Kit is required maintenance on the rotating shaft part and must meet the exact requirements of the installed rotating assembly part of the shaft seal. A failure of the item will render ships’ propulsion system non-functional, possible flood of the ship, causing loss of CG mission capability. The Commandant's instruction 4130.6A calls for configuration management. These seal assemblies are in APL

83717240A5 which are used on the 270 fleet and must be the same configuration to ensure effective logistics support. The item conforms to exact design and material requirements for form, fit, function to meet the required overhaul with the current system; any variance could cause failure or malfunction, jeopardize personnel safety, and subsequent inability to meet the needs of the Coast Guard.

8. The Manufactures drawings and specifications for this item are proprietary commercial property of the OEM; the Coast Guard has not purchased this information. The OEM is the only know provider meeting system requirements for form, fit, and function.

9. COTR will continue to conduct market research with a focus on locating vendors that are able to meet requirements, however without technical data described above obtaining full and open competition will be very difficult. The Coast

Guard cannot require any vendor to release any vendor to release proprietary data.
