6. Pursuant to FAR Subpart 13.106-1 (b), the Contracting Officer may solicit from one source if they determine that the circumstances of contract action deem only one source reasonably available:

7. The pump units provide seawater to Reverse Osmosis (RO) Desalination Plants on board the 210 & 270 WMEC fleet. Failure to maintain adequate stock to support field units would lead to loss of RO plant output of fresh water for the ship. The Commandant's instruction 4130.6A calls for configuration management. These items are in APL 010EXU30A1 RO Seawater Feed Pump with cyclone filter assembly installed on the 210’/270’ fleet for the RO Plants must be the same configuration in order to ensure effective logistics support. The pump has the exact design characteristics requirements for the piping and electrical power currently installed, mounting to existing brackets, and space limitations in the compartment.

8. The Manufactures drawings and specifications for this item are proprietary commercial property of Aqua-Chem Pumps. They are the only contractor that can guarantee interchangeability of the parts; the Coast Guard has not purchased adequate item information, documentation, and specifications to develop an appropriate purchase description for full and open competition; venders listed above are the only know provider meeting system requirements for form, fit, and function on the 210’/270’ Cutters.
9. COTR will continue to conduct market research with a focus on locating vendors that are able to meet requirements, however without technical data described above obtaining full and open competition will be very difficult. The Coast
Guard cannot require any vendor to release any vendor to release proprietary data.
