About this file

This document is a Justification for Other Than Full and Open Competition (JOFOC) pursuant to FAR 13.501(a) for a firm-fixed price Purchase Order. The Department of State, Office of Acquisition Management, Regional Procurement Support Office Frankfurt, is awarding the contract on behalf of the Office of International Narcotics and Law Enforcement (INL) in Jerusalem.

The requirement is to provide spare parts for Light Armored Vehicles (LAVs) purchased by INL and donated to the Palestinian Authority Security Forces (PASF). The sole source justification is that the vendor, Auto Depot, is the only company located in the West Bank that is licensed by the Palestinian Authority and approved by the Coordinator of Government Activities in the Territories (COGAT) to deliver the required spare parts. Three other vendors provided quotes, but they are located outside the West Bank and do not have COGAT approval. The Contracting Officer determined the price from Auto Depot to be fair and reasonable based on market research. The contract will be awarded on 2024-08-05 under Solicitation Number 19GE5024P0049.

SOLE SOURCE JUSTIFICATION OVER THE SIMPLIFIED ACQUISITION THRESHOLD (SAT)

PURSUANT TO FAR 13.501(a)

1. Identification of the agency and the contracting activity:

This is a justification for other than full and open competition for an acquisition being conducted by the Department of State, Office of Acquisition Management, Regional Procurement Support Office Frankfurt on behalf of the Office of International Narcotics and Law Enforcement (INL) Jerusalem.

2. Nature and/or description of the action being approved.

Award a firm-fixed price Purchase Order to company “Auto Depot” for spare parts for

Light Armored Vehicle (LAVs) that were purchased by INL/Jerusalem and donated to the

Palestinian Authority Security Forces (PASF).

3. A description of the supplies or services required to meet the Agency’s needs.

This requirement is to provide LAV spare parts to the PASF Logistics Commission warehouse in Ramallah. The spare parts are required for operation of PASF’s LAVs throughout the West Bank. This will allow the Office of Palestinian Affairs/INL Jerusalem to accomplish its mission of supporting the Palestinian-civil police.

4. An identification of the statutory authority permitting other than full and open competition:

In accordance with Federal Acquisition Regulation (FAR) 13.501(a)(1), this acquisition is conducted under the authority of :

☒ 41 U.S.C. 1901 – Simplified acquisition procedures

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the action require use of the authority cited.

Company AUTO-DEPOT is uniquely qualified to provide the spare parts based on the following:

They are licensed by the Palestinian Authority (PA) to provide the supplies for LAVs owned by PA. Delivery to the PASF in the West Bank is controlled by COGAT. Without approval by The Coordination of Government Activities in the Territories (COGAT), no items may be imported. Quotes from a total of three (3) other sources have been received by INL. However, the offerors are located in Jordan and do therefore currently not receive COGAT approval. Only Auto Depot is located in the West Bank. Auto Depot’s offer meets agency’s needs.

6. A description of the efforts made to ensure that offers are solicited from as many potential sources as is practicable, include whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

INL Jerusalem conducted market research and received quotes from a total of four (4) offerors. However, only Auto Depot is located in the West Bank.

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer has determined the anticipated price to the Government for the supplies covered by this J&A will be fair and reasonable based on market prices.

The Contracting Officer will not award the planned contract action unless the Contracting Officer evaluates and determines that the resultant price is fair and reasonable.

8. A description of the market research conducted (see FAR Part 10) and the results or a statement of the reason market research was not conducted.

INL Jerusalem conducted market research and received quotes from a total of four (4) offerors (Auto Depot, Sector Security, JLVM, A.S. Motors). However, three of them are located outside of West Bank and do currently not receive COGAT approval for importation of the goods. Only one company (company Auto Depot) is located in the West Bank and is allowed to deliver the spare parts. This meets agency’s needs.

9. Any other facts supporting the use of other than full and open competition.

None.

10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition.

Four companies expressed interest and provided their quotes. However, only one company is located in the West Bank and is allowed to deliver requested items. The other three companies are located outside of the West Bank and do currently not receive approval from COGAT to import the items due to the ongoing war.

11. A statement of any actions the agency, if any, the agency may take to remove or overcome any future barriers to competition before any subsequent acquisition for the supplies or services required.

None.
