About this file
This document contains a Justification and Approval for Sole Source procurement and a related Notice of Intent to Award a Sole Source Contract. The Justification and Approval is to purchase an Illumina NextSeq 2000 next-generation sequencer from Illumina Inc. on a sole source basis under FAR 6.302-1. The sequencer is required to replace an aging Illumina instrument and will reduce reagent costs, downtime, and eliminate fluidics washes. The Notice of Intent was published to provide Illumina the opportunity to submit a proposal for the acquisition, with responses due by July 6, 2020. If awarded, the sole source contract would be with Illumina to supply the NextSeq 2000 sequencer to the National Eye Institute for approximately $290,700.

Justification and Approval for Sole Source
“Source Selection Information – see FAR 2.101 and 3.104”
1. Identification of the agency and contracting activity.
a. Federal agency and contracting activity: HHS/NIH
b. Sponsoring organization: National Eye Institute
c. Project Officer information
• Project Officer name: Anand Swaroop
• Mailing address: Bldg. 6, Room 338, National Eye Institute, National Institutes of Health, Bethesda, MD 20892-3739
• E-mail address: swaroopa@nei.nih.gov
• Telephone number: 301.435.5754
2. Nature and/or description of the action being approved.
a. Acquisition purpose and objectives. Purchase of an Illumina NextSeq 2000 next-generation sequencer.
b. Project background. The purchase of an Illumina NextSeq 2000 is required to replace an aging Illumina next-generation sequencer that will soon be obsolesced by the manufacturer, Illumina. Purchase of the new NextSeq 2000 will reduce reagent costs and down time due to instrument break downs necessitating repairs. The new instrument would eliminate the maintenance fluidics washes currently required on the existing system since the NextSeq 2000 is a dry instrument in which all the fluidics are contained in a removable cartridge. The throughput scale of the NextSeq 2000 is more in line with current sequencing needs of the laboratory.
Purchase of the Illumina NextSeq 2000 would also enable the bioinformatics team within the laboratory to maintain their existing established protocols. Sample preparation for the NextSeq 2000 would also permit the continued use of numerous protocols that have already been standardized and thoroughly tested. Illumina instruments are recognized in the scientific literature as being the major player in the NGS arena and sequencing results are widely accepted and trusted in publications. Finally, our experience with Illumina technical support over the course of ownership of two Illumina NGS instruments over the past 10+ years has been outstanding.
3. Description of the supplies or services required to meet the agency’s needs (including the estimated value).
a. Project title. Illumina NextSeq 2000 Next-Generation Sequencer

The amount of this acquisition is $ 290,700.00 Delivery period depends on processing time frames and figuring out lab schedule at the estimated time of delivery. Ask vendor to contact Linn Gieser to set up delivery period.
4. Identification of the statutory authority permitting other than full and open competition.
This acquisition is conducted under the authority of 41 United
States Code (U.S.C.) 253(c)(_1_) as set forth in Federal Acquisition Regulation (FAR) 6.302- _1_.
This acquisition is conducted under the authority of section 4202 of the Clinger-Cohen Act of 1996.
This acquisition is conducted under the authority of the Services
Acquisition Reform Act of 2003 (41 U.S.C. 428a).
5. Demonstration that the proposed contractor(s) unique qualifications or the nature of the acquisition requires use of the authority cited.
a. Name and address of the proposed contractor(s):
Illumina, Inc 5200 Illumina Way San Diego CA 92122-4616
USA
Hereinafter referred to as “Illumina”
b. Nature of the acquisition and proposed unique qualifications of the contractor(s):
Illumina Inc. is an industry leader in the design and manufacture of next-generation sequencing systems
6. Description of the efforts made to ensure that offers are solicited from as many potential sources as practicable. Indicate whether a FedBizOpps notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies. This will be a sole source under the authority of FAR 6.302-1 (Only one responsible source and no other supplies or services will satisfy agency requirements). A Notice of Intent will be posted on betaSAM.gov
7. Determination by the Contracting Officer that the anticipated cost/price to the Government will be fair and reasonable. The reasonableness of the cost of the new sequencer may be compared to the cost of the aging existing sequencer. POTS # 14-001454, Requisition # 3226285, PO# 263201400245P.
7. Description of the market research conducted (see FAR Part 10) and the results, or a statement of the reasons market research was not conducted.
Illumina offers the best NGS system in the country for the National Eye Institute.
Illumina offers trade in value for old equipment and will come to the lab to demo the equipment and appropriately train all bodies that will be using this system.
9. Any other facts supporting the use of other than full and open competition.
NextSeq 2000 advantages:
• Sequencing access for NEI - Many groups within the NEI would make use of the
NextSeq for their sequencing projects as they have in the past with the HiSeq and for lower costs (a benefit to NNRL since the lab usually ends up paying the reagent costs for most sequencing projects for NEI investigators, for one reason or another).
• More flexible throughput and shorter wait times - the NextSeq is better suited to smaller projects and will not require the coordination between multiple projects to fill up 8 lanes of the least expensive HiSeq flow cell. The smaller scale of the NextSeq will significantly shorten the time from sample receipt to sequence completion.
• Dramatically lower reagent costs – reagent costs for the NextSeq are almost 50% less than the HiSeq reagents.
• Vastly reduced annual service contract fees – $47K vs. ~$120K (HiSeq/cBot)
• Less down-time due to repairs than with the aging HiSeq.
• $40K trade-in credit for the HiSeq – this credit may not be offered by Illumina next year when the HiSeq is 6 months away from being “moth-balled” by Illumina and since the NextSeq 2000 will have been on the market for over a year.
• Faster sequencing – sequencing equivalent runs takes half the time on the NextSeq as compared to the HiSeq.
• No more weekly maintenance washes – NextSeq is a “dry” instrument; all fluidics are self-contained in a cartridge.
• Ability to sequence everything except large, whole-genome sequencing.
10. Listing of sources, if any, that expressed, in writing, an interest in the acquisition. The NextSeq 2000 is not available from the mandatory sources (NIH surplus, NIH supply center, UNICOR, GSA Advantage, Ability One) and is manufactured and distributed solely by Illumina.
11. Statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the required supplies or services.
12. Program office certification.
This is to certify that the portions of this justification that have been developed by the undersigned program office personnel, including supporting information and/or data verifying the Government’s minimum needs, schedule requirements and other rationale for other than full and open competition, are accurate and complete.
