Siemens Control Replacements
NATIONAL AERONAUTICS AND SPACE ADMINISTRATION

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION (JOFOC)
For (NASA Building 1268 Siemens Control Replacements)
1. Federal Acquisition Regulation (FAR) 6.303-2(b)(1) – Identification of the agency and the contracting activity, and specific identification of the document as a “Justification for other than full and open competition.”
This document is a justification for other than full and open competition prepared by National Aeronautics and Space Administration (NASA) (LaRC):
The procuring agency is the National Aeronautics and Space Administration (NASA) and the contracting activity is (LaRC).
2. FAR 6.303-2(b)(2) – The nature and/or description of the action being approved:
This justification provides the rationale for contracting by other than full and open competition to award a sole source contract to Damuth Trane to replace the outdated, existing hardware in Building 1268 at NASA Langley Research Center.
3. FAR 6.303-2(b)(3) – A description of the supplies or services required, to meet the
Agency’s needs (including the estimated value):
The Contractor shall perform the following task requirements at NASA LaRC in accordance with the attached Statement of Work. Estimate cost of this task is . Period of Performance is 180 days after date of award.
For all buildings listed in the SOW the following requirements are applicable:
• Integration into the existing base-wide Trane web server
• Utilize NASA LaRC’s existing spatial data system (GIS) for asset locations and integration of managed components displayed in Trane Summit. This includes center level maps and layouts for individual buildings.
• Three (3) Trane System Controllers with local Ethernet and web-accessibility
• Generation of custom building graphics
• Disconnect and re-connect existing chiller controls and interlocks
• Programming and software set-up by Trane Controls Technician
• Controls schematics and wiring diagrams generated in CAD format
• One (1) year labor and materials warranty
4. FAR 6.303-2(b)(4) – An identification of the statutory authority permitting other than full and open competition:
Authority for the Justification for Other Than Full and Open Competition is provided by 41 U.S.C. 1901, Simplified Acquisition Procedures, as implemented by FAR 13.501(a). Only one responsible source and no other supplies or services will satisfy agency requirements (10 U.S.C. 2304(c)(1)). This justification is based on Damuth Trane being the only responsible source and no other supplies or services will satisfy agency requirements. This JOFOC complies with the special documentation requirements of FAR 13.501(a)(1)(ii).
5. FAR 6.303-2(b)(5) – A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:
The rationale supporting the use of 10 U.S.C. 2304(c)(1) is Damuth Trane is the sole source provider for this requirement as described below:
Damuth Trane is the local Trane office and is already familiar with the Energy Manage and Control Infrastructure at NASA Langley Research Center. Damuth Trane is the only certified vendor in this region that can integrate the existing building controllers, set-up software on the existing 4web server and program the system to meet NASA Langley Research Center’s needs. Note that the Trane Ensemble is NASA Langley’s primary building automation system (BAS) enterprise management tool. Since 2011, all new construction buildings at NASA Langley have been equipped with Trane building automation systems.
Ideal interoperability occurs when a building’s BAS equipment is from the same vendor as the parent building enterprise management system. The current workforce has received considerable training on Trane Ensemble, including controller programming, setup, sequence of operations, data logging, graphical displays and troubleshooting.
Damuth Trane’s work with Building Management Systems is very unique and specialized to each of their customer’s hardware and software. Therefore, Damuth Trane is the only vendor that can update and manage the Building Management Systems. It is imperative that the outdated, existing hardware is replaced with a Trane Direct Digital Controller (DDC) System in order to maintain continuity, compatibility and consistency with the existing Energy Manage and Control Infrastructure at NASA Langley Research Center which is equipped with all Trane building automation systems.
6. FAR 6.303-2(b)(6) – A description of the efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:
This requirement will be synopsized and posted on beta.sam.gov in accordance with FAR
5.201. Synopsis results will be included in the official contract file. Based on the authority city in paragraph 4, it is concluded that our minimum needs are only reasonably available from the selected source. 7. FAR 6.303-2(b)(7) – A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:
Before making award, the Contracting Officer will determine that the proposed price is fair and reasonable based on one of the techniques identified in Federal Acquisition Regulation (FAR) Subpart 13.106-3 – Award Documentation. This procurement is for a commercial item. Thus, the price can be determined fair and reasonable based on a comparison of the established market price, historical pricing, and current price lists. NASA has historical contract information from previous awards with Damuth Trane and there are no anticipated issues that would circumvent a fair and reasonableness price determination. The Contracting Officer will determine price reasonableness during the proposal evaluation process prior to contract award.
8. FAR 6.303-2(b)(8) – Description of the market research conducted, and the results, or a statement of the reasons a market research was not conducted:
The technical POC meets with Damuth Trane, Jacobs, Center Operations Directorate and the facilities involved frequently to discuss the infrastructures at NASA Langley Research Center. The technical POC has been involved with the Controls and maintaining the hardware and firmware for several years and has vast knowledge of the requirements for maintaining the controllers.
New market research was not conducted because there has been a Center decision to only use the Trane hardware/software as its BAS. Damuth Trane is the only vendor that can integrate the systems. Building controllers from another source would not seamlessly integrate with the existing Trane software/hardware and may experience operational issues such as: Global commands not understood or executed incorrectly; industrial alarms may not be accurate (false positives and/or false negatives); manual control may be required for some tasks and historical data used for Condition Based Monitoring may be inaccurate or incomplete. In addition, purchasing a second software control product would add a substantial duplication of cost from: Training for the new product and recurring (and redundant) software maintenance, operating and administrative costs. Overall, it would take substantial duplication of resources and time for another source to provide the required hardware and firmware updates. This additional expense is not expected to be recovered through competition.
9. FAR 6.303-2(b)(9) – Any other facts supporting the use of other than full and open competition:
With other vendor controls on the BAS Control Center, the BAS operator will not have any control over the HVAC equipment and therefore would not be able to keep energy costs down. Other controls were previously problematic with the Trane BAS System and were shutting systems down resulting in high maintenance costs.
Purchasing a different control product would add a substantial duplication of costs as follows:
• Training would be required for the new product
• Recurring software maintenance costs
• Recurring operator costs
• Recurring IT administration costs (i.e. patching, upgrading, issue resolution)
The proposal from Damuth Trane is a fair cost estimate passed on previous estimates of work completed in other buildings on Center under Contract 80NSSC19P1112, 80NSSC19P1979, 80LARC19P0024, and 80LARC20P0005.
10. FAR 6.303-2(b)(10) – A listing of the sources, if any, that expressed an interest in writing in the acquisition:

11. FAR 6.303-2(b)(11) – A statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:
In order to remove or overcome barriers to competition in future acquisitions for these requirements, LaRC will continue to utilize beta.sam.gov to assess industry capability to meet compatibility and performance needs for the BAS. However, LaRC does not anticipate any significant changes to the requirements that would allow the increase of fair opportunity in the near future.
