JUSTIFICATION FOR EXCEPTION TO FAIR OPPORTUNITY (JEFO)

1. Defense Logistics Agency (DLA) Troop Support, Medical Supply Chain, Capital Equipment Division, is the contracting activity.

2. This justification is for the purchase of hardware and software upgrades, along with professional services to implement the updated hardware and software for the existing Fuji Digital Imaging Network-Picture Archive and Communication System (DIN-PACS) at the Landstuhl Regional Medical Center (LRMC) under FujiFilm Medical Systems U.S.A. (“Fuji”) DIN-PACS contract, SPE2D1-17-D-0040, which expires on August 21, 2022.

3. The total estimated dollar value for the upgrade is $781,000.

4. The authority under the Multiple-Award Schedule Program waiving the competition requirements is FAR 16.505(b)(2)(i)(B), only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized. The existing Fuji DIN-PACS at LRMC requires a hardware and software upgrade to eliminate an existing issue with slow retrieval of historic radiology studies.

The Radiologists at LRMC are currently experiencing delayed retrieval times from the image archive for historic radiology studies for comparison to newly acquired radiology studies. The hardware, software and professional services to be purchased allows for a back-up system that is more robust and refined than the current one, resulting in a faster more automated cutover that will provide near real-time historic radiology study retrievals from the archive image cache. This upgrade will improve the patient standard of care by improving the turnaround times of primary interpretations for radiology studies. Fuji is the only vendor who is able to provide the required hardware and software upgrades and professional services to implement the changes on its Fuji DIN-PACS to ensure the installed systems’ performance is improved because Fuji’s DIN-PACS includes proprietary hardware and software. Only Fuji can integrate the upgraded hardware with the existing Fuji proprietary DIN-PACS software.

Additionally, Fuji is responsible for all system information security certifications, testing and on-going Information Assurance (IA) and security updates and patches for installed DIN-PACS.

Accordingly, only Fuji can maintain the critical security status of the DIN-PACS on an on-going basis. DIN-PACS are FDA approved medical devices, and changes to the software/hardware on the equipment must be thoroughly tested by the manufacturer prior to being applied to a medical system; therefore, only Fuji can provide the needed hardware and software upgrades.

Market research performed in December 2017 by DLA Troop Support among the DIN-PACS contract vendors confirmed that no other vendor can supply the upgraded hardware, software and professional services to install and integrate the updates with the existing Fuji DIN-PACS system currently in place in LRMC.

7. There are no other facts supporting the use of this JEFO.

DIN-PACS vendors have the opportunity to add products that fall within the scope of the DIN- PACS contract at any time; however, currently there are no other known DIN-PACS vendors that would be able to offer these Fuji DIN-PACS upgrades that meet the customers’ minimum requirements. The original DIN-PACS for LRMC was solicited with a 9 year lifecycle (including a one year warranty and 8 years of post-warranty maintenance). The warranty ended in August 2011. Thus, future updates of the LRMC DIN-PACS during the remaining two year period of post-warranty maintenance will most likely be restricted to Fuji, the system’s original equipment manufacturer.
