Justification for Other than Full and Open Competition
1. Summary/Introduction:
The Defense Logistics Agency (DLA) Energy, a component of DLA, is the contracting activity.
The action is for the purchase of a subscription renewal from GlobalView Software, Inc.
(GlobalView) for a software system that allows DLA Energy the ability to view and extract market pricing data from various sources. This annual subscription covers a 12-month period from January 1, 2024 to December 31, 2024 for DLA Energy. GlobalView is the sole producer of the proprietary software, therefore it is the sole responsible source for the software, and no other software is able to fulfill the requirement pursuant to 10 U.S.C. 2304(c)(1).
2. Nature and/or description of the action being approved (FAR 6.303-2(b)(2)):
The action being approved will be a contract with GlobalView to provide a software package that allows monitoring of real-time electronic pricing data that is used in DLA Energy fuel contracts. This action will use FY24 funding.
3. Description of supplies or services required to meet the agency’s need (including estimated value) (FAR 6.303-2(b)(3)):
GlobalView provides a software package that allows monitoring and analysis of real-time electronic pricing data for refined petroleum products from multiple sources in the Oracle Energy Downstream (OED) format that feeds directly into DLA’s computer systems. This software package provides critical support in DLA Energy’s ability to load published prices used in a number of the fixed price with economic price adjustment fuel contracts, into the eProcurement Business System via OED format. The estimated value is for 2024.
4. Identification of the statutory authority permitting other than full and open competition (FAR 6.303-2(b)(4)):
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(l), as implemented by FAR Part 6.302-1(a)(2): “When the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other supplies or services will satisfy agency requirements.” GlobalView is the only source able to provide the unique software package that enables DLA Energy to receive electronic pricing from multiple sources in DLA’s specifically-required OED format. The software package includes the required security encryption protocol that allows pricing data to be transferred directly to DLA’s computer system. DLA Energy receives pricing data from several sources used in fixed price with economic adjustments fuel contracts, and this pricing data in transmitted directly into DLA’s computer system via GlobalView’s software package. Further, GlobalView is the only

Therefore, in accordance with 10 U.S.C. 2304(c)(1), GlobalView is the only source that can meet this specific agency requirement.
5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited (FAR 6.303-2(b)(5)):
GlobalView provides a software package that allows DLA Energy to receive pricing data feeds directly into DLA’s computer systems in the proper OED format. Further, GlobalView is the only source able to provide this software package in compliance with DLA’s mandatory IT security policies. Additionally, the data feed package included in the GlobalView subscription is the primary method of pricing data distribution from multiple vendors. DLA currently has a contract with GlobalView to receive this proprietary pricing information from the various vendor’s publications that are used in numerous DLA Energy fuels contracts. Without this software package, DLA Energy would not be able to receive electronic pricing data that would interface with its computer systems due to the security encryption protocol requirements outlined in DLA’s security compliance policies.
6. Description of the efforts made to ensure that offers are/were solicited from as many potential sources as is/was practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies (FAR 6.303- 2(b)(6)):
On November 8, 2023, DLA Energy-FEA posted an intent-to-sole source notice on FedBizOpps (SP0604-24-Q-0407) that closed on November 24, 2023. No potential sources responded to the notice and to date, no other sources have written to express an interest, resulting in no additional competition for this requirement. Therefore, GlobalView is the only source available to meet DLA Energy’s needs at this time.
7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable (FAR 6.303-2(b)(7)):
The contracting officer finds that the proposed price is fair and reasonable using the techniques in FAR 15.404-1. Pursuant to FAR 15.404-1(b)(2)(ii), the contracting officer may make a “[c]omparison of proposed prices to historical prices paid, whether by the Government or other than the Government, for the same or similar items. The contracting officer may also, pursuant to FAR 15.404-1(b)(2)(iv), make a “[c]omparison with competitive published price lists, published market prices of commodities, similar indexes, and discount or rebate arrangements.”
GlobalView is proposing a one-year price of . This will result in a savings of compared to the cost a standard user would pay. Additionally, the previous price offered to DLA Energy was , resulting in a decrease compared to last year. This is less than the adjusted rate of inflation provided by the DOL Consumer Price Index for the last 12 months. Therefore, the contracting officer determines the price fair and reasonable when compared to historical prices paid and the standard market price.
8. Description of the market research conducted and the results or a statement of the reason market research was not conducted (FAR 6.303-2(b)(8)):
The customer (DLA Energy – RN) conducted market research and determined GlobalView was the only source that met the Government’s requirement. Specifically, each of the vendors that currently have pricing subscriptions for pricing data with DLA Energy were contacted for inquiry as to whether they would be willing to update their current IT security encryption protocol for data transferring so that an interface agreement could be completed. The interface agreement would allow pricing data to be fed directly into DLA’s computer system and comply with DLA’s mandatory IT security requirements. With the exception of GlobalView, no other vendor was agreeable to changing the data format to meet these requirements for interfacing with DLA’s computer systems.
Also, an intent-to-sole source notice was posted on FedBizOpps on November 8, 2023. There were no expectations that the notice would yield any additional sources. The above research efforts identified no other authorized or capable vendors for this requirement. Therefore, it has been determined that GlobalView is the only source available to meet DLA Energy’s needs for its propriety information at this time.
9. Any other facts supporting the use of other than full and open competition, such as (FAR 6.303-2(b)(9)):
(i) Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competitor have not been developed or are not available.
The software provided by GlobalView is proprietary and, therefore, we are unable to develop a specific purchase description that would satisfy the requirements and allow for full and open competition.
(ii) When 6.302-1 is cited for follow-on acquisitions as described in 6.302-1(a)(2)(ii), an estimate of the cost to the Government that would be duplicated and how the estimate was derived.
Not applicable.
(iii) When 6.302-2 is cited, estimated cost, or other rationale as to the extent and nature of the harm to the Government.
No viable sources replied to the Intent-to-Sole Source Notice posted to FedBizOpps.
10. A listing of the sources, if any, that expressed, in writing, an interest in the acquisition (FAR 6.303-2(b)(10)):
An intent-to-sole-source notice was posted to FedBizOpps on November 8, 2023. No sources replied to the notice. Additionally, no sources have written to express an interest.
11. Actions that may be taken to remove or overcome barriers to competition before any subsequent acquisition for the supplies or services are required (FAR 6.303-2(b)(11)):
There are no known actions that will allow DLA Energy to overcome the competition barriers for this requirement.
