2. NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED.
This justification authorizes the use of other than full and open competition for the procurement of brand name specific FactSet Research Systems, Inc. for subscription software licenses for FactSet Workstation. The solicitation will be issued via Open
Market procedures as a Combined Synopsis/Solicitation-Request for Proposal (RFP) posted to SAM.gov. The award of a firm-fixed price contract is contemplated.
3. A DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO
MEET THE AGENCY’S NEEDS/ESTIMATED DOLLAR AMOUNT.
DLA has a requirement to obtain FactSet Workstation Subscription Software
Licenses in support of the Applied Market
Intelligence in Defense Acquisition effort.

4. IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING
OTHER THAN FULL AND OPEN COMPETITION:
The statutory authority permitting other than full and open competition is Title 10, U.S.C
2304 (c),(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, “Only one responsible source and no other supplies or services will satisfy the agency requirement.” FactSet Research Systems, Inc. is the sole source to provide FactSet
Workstation subscription software to DLA.
5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S
UNIQUE QUALIFICATIONS OR THE NATURE OF THE
ACQUISITIONS REQUIRES USE OF THE AUTHORITY CITED:
FactSet licenses provide access to in-depth commercial sources of industry information to better inform acquisition decisions. This is in direct support of the Applied Market
Intelligence in Defense Acquisition (AMIDA) initiative. Up until the current licenses expired April 2021, the FactSet Workstation was used effectively in the Subsistence supply chain as part of the AMIDA R&D pilot project. Having access to commercial data sources, acquisition professionals are able to create supplier profiles and industry overviews that go beyond readily available public resources. The information provides users with actionable information through an up to date, interactive look at the markets and suppliers that are relevant to DLA.
As mentioned above, FactSet has been successfully used within the Subsistence supply chain. Users have been trained on this product and that has been very significant investment. Also, during the Subsistence pilot, prior to selecting FactSet as the external data source, market research was completed and determination was made based on cost and functionality that the product FactSet provided was the best software for purposes of supporting the AMIDA effort.
These licenses enabled pilot participants to access the full scope of FactSet data through its website. This data was used extensively throughout the pilot project. This foundational data was supplemented by supply chain specific data and internal data stored on DLA systems, such as the Enterprise Data Warehouse (EDW).
In accordance with FAR 6.302-1, brand name FactSet Research Systems, Inc. as a sole source is essential to the Government’s requirement because the subscription software required by the agency are available from only one responsible source, and no other type of software will satisfy the agency’s requirements.
6. DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE
SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS
PRACTICABLE:
FactSet Research Systems, Inc., the sole source provider of the proprietary FactSet
Workstation Subscription Software. However, the requirement will be solicited as a
Combined Synopsis/Solicitation - Request for Proposal (RFP) SP4701-21-R-0020 on the
SAM.gov website to provide an opportunity for competitive software providers to submit an offer.
7. DETERMINATION BY THE CONTRACTING OFFICER THAT THE
ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND
REASONABLE:
As the Contracting Officer, I hereby determine that pricing will be fair and reasonable based on pricing analysis in accordance with FAR 15.404-1. It is anticipated that the
Government will use various prices analysis techniques including, but not limited to:1) comparison of proposed prices received in response to the solicitation (reference FAR
15.404-1(b)(2)(i); 2) comparison with competitive published price lists (reference FAR
15.404-1(b)(2)(iv); and 3) comparison of proposed prices with prices obtained through market research of the same or similar items (reference FAR 15.404- 1(b)(2)(vi)), in order to obtain a fair and reasonable price.
8. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AND THE
RESULTS OR A STATEMENT OF THE REASONS MARKET RESEARCH
WAS NOT CONDUCTED:
Market research actions were conducted amongst the developer/OEM. The findings from this market research subsequently confirmed that only the subject sole source seller
(FactSet Research Systems, Inc.) is capable of providing the required support. A decision was made to issue the requirement via a Combined Synopsis/Solicitation –
Request for Proposal (SP4701-21-R-0020) under open market procedures and posted to
SAM.gov to disseminate the requirement to the maximum number of potential sources to fulfill the posting requirements.
9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL
AND OPEN COMPETITION:
During the Subsistence pilot, the project team identified the types of data important to the Subsistence supply chain. Then they conducted a cost/benefit analysis for various potential sources, including FactSet, Bloomberg, Thompson-Reuters, and
ProcurementIQ. The primary reason for FactSet’s lower price is its lack of specialized data used in stock trading (e.g., derivatives data), which is not needed by DLA.
The software license fills a critical process gap by adopting an industry best practice.
The FactSet software license provides benefits which include improved workforce skills, stronger negotiating positions, contracts more aligned with industry practices to reduce costs, and reduction in lead time to obtain price reasonableness.
Procurement history includes SP4701-14-D-7016/SP4701-18-F-0135/P00002 and
SP4709-17-D-0023/SP4709-20-F-0034, Task 3.
10. A LISTING OF SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN
INTEREST IN THE ACQUISITION:

ANY SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES
REQUIRED:
At this time, the FactSet Workstation is the only product that has been tested and successfully used to support DLA’s requirements and meets the Government’s needs. However, as the AMIDA effort continues to expand out to the Enterprise, DLA will continue to survey other external data sources that may provide more meaningful data elements at each specific supply chain.
However, DLA has exercised and continues to exercise competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both in industry and in the Government. DLA uses a variety of vendors, manufacturers, and contracts/orders to fulfill its requirements and will continue its practice of surveying the market to ensure full and open competition to the maximum extent practicable.
J6 is required to conduct ongoing reviews of IT solutions in order to keep abreast of new technology, in both Government and private sectors. According to the IT Solutions document, whenever substantial improvement over presently identified solutions is demonstrated, the existing document will be updated to ensure DLA continues to use the best products and services for their mission requirements.
