JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN
FULL AND OPEN COMPETITION UNDER FAR 13.5, SIMPLIFIED
PROCEDURES FOR CERTAIN COMMERCIAL ITEMS
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Undersea Warfare Center Division
(NUWCDIVNPT), Newport, RI.
2. Description of the Action Being Approved
Request approval to solicit and award a Firm Fixed Price contract on a brand name specification, no substitutions allowed. This requirement is for the procurement of two
(2) Concurrent Afterbody (AB) Systems and (2) Concurrent Digital
Injection (DI) Systems with associated hardware and software.
3. Description of Supplies/Services
Estimated Dollar Value
These AB and DI Concurrent systems are components within a vehicle bench in the
Laboratory. The AB Concurrent System is used to provide presets and power to the vehicle, along with being able to both control and monitor the vehicle during a test event.
The DI Concurrent System is used to generate and inject acoustic signals to the receive array of the vehicle during a test event.
4. Statutory Authority Permitting Other Than Full and Open
The proposed action specifies brand name components using the procedures in FAR
Subpart 13.5 and in accordance with 41
U.S.C. 1901 and 10 U.S.C. 2304 (c)(1), Limited Number of Responsible Sources and No
Other Supplies or Services Will
Satisfy Agency Requirements as implemented by FAR 6.3021(c).
5. Rationale Justifying Use of Cited Statutory Authority
NUWCDIVNPT, is the
US Navy’s only high fidelity real-time simulator supporting all and variants across the full torpedo life cycle and defensive systems. The simulation is designed/required to support defensive systems and unmanned vehicles.
This support begins with Research & Development (R&D), continues through performance assessment, Test and
Evaluation (T&E), and extends well into the operational, inwater phase.
All of the newest high fidelity simulations are presently supported by
Concurrent Computer Corporation’s simulation computers and customized interfaces (environment models, afterbody, acoustic). In order to continue to use the existing environment-centric simulation code with the new software development, the
Concurrent Systems along with the Dell PowerEdge computer servers ( ) are required to support the existing simulations with the same interfaces and drivers. This correct hardware is necessary to be able to run the simulation in real time under broadband conditions.
The Graphic Processing Units (GPUs) are completely controlled by the development environment and cannot be accessed by other demands on the system (e.g. graphics) and this will allow the developers to optimize the capability of the complex models.
Concurrent Real-Time is the only make and model that can satisfy this requirement. The use of any other make or model of this hardware would require an investment to change the entire simulation suite. In addition, approval would be required from all sponsors currently using the to test torpedo hardware
A previous feasibility study cost approximately plus an additional to replace hardware and convert/upgrade the software in the
In addition, the would be required to obtain system accreditation from Commander
Operational Test and Evaluation
Force (COTF). This accreditation process would take a substantial amount of time and come at great expense to the government.
Based on the compatibility and cost issues stated above, it is therefore determined that requirement can only be met by Concurrent Real-Time for purchasing the AB and DI systems.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
A combined synopsis and solicitation will be posted to beta.sam in accordance with FAR
5.2. The notice will state the intention of NUWCDIVNPT to award a contract on a brand name basis and it will invite all responsible sources to submit an offer. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any brand other than Concurrent Real
Time’s brand to fulfill this requirement.
7. Determination of Fair and Reasonable Costs
The contracting officer will conduct price analysis using
FAR 13.106-3 and or 15.404-1(b) and 15.404-1(c) methods, in accordance with FAR
13.003(g)(2) to determine proposed prices are fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons described in Paragraph 5, including compatibility with existing
Concurrent Real Time’s systems and related Government interface and control systems in the laboratory, the Naval Sea Systems Command, NUWCDIVNPT has no plans at this time to compete for a different system. If another potential source emerges, the Naval Sea Systems
Command, NUWCDIVNPT will assess whether competition for future requirements is feasible.
