Justification for Other Than Full & Open Competition (November 2011)

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Agency and Activity: DLA Land and Maritime-KME

2. The action being approved is the acquisition of supplies/services on other than a full and open competition basis.

3. The supplies/services required to meet the using activity’s needs are described as follows:

This procurement is for the purchase of Cable and Plug Assemblies to support the SSN 775 (USS Texas). The total Government estimate is $377,633.00. The FSC Code for this procurement is 5935 and the NAICS code is 335931. FAR 13.5 / 41 USC 1901 Applies to this procurement.

This acquisition:

4. The acquisition is restricted to the only source(s) of supply known to have the capability of furnishing the required supplies/services. Source(s) are: (Include CAGE code)

The purpose of these document are to provide minimum generic guidelines, current technical references, and sample generic production support forms for: manufacture of all outboard submarine cable assemblies:

molding, inspection, and testing. Manufacture of preformed molded inserts: production, and inspection.

Audit requirements for vendors and Approved Vendor List (AVL).

The part numbers listed above are the Electric Boat Numbers assigned to these items during hull design.

This procurement is restricted to sources who have access to Electric Boat specifications. It is unknown how many entities Electric Boat has released their specifications to.

End-item part numbers may vary depending on the source that is the successful offer. Any vendor that meets the Fat certification, has access to Electric Boat specifications, and uses a Pro-20 approved vendor for molding, and a Pro-30 approved vendor for plasma coating is eligible to bid.

Vendors for this procurement MUST use a source from the NAVSEA S9320-AM-PRO-20 list for molding. A list of those sources are as follows:

Vendors must use a source from the NAVSEA S9320-AM-PRO-30 list or Teledyne’s separately approved process for plasma coating. A list of those sources is as follows:

5. The statutory authority permitting other than full and open competition is:

The Navy requires that vendors be pre-FAT certified. This is due to the need date of the cables being November 30, 2020. These cables can take 6 months to manufacture, and time does not allow for FAT certification to be performed after award without posing significant delays to the project.

This procurement also calls out Electric Boat Part Numbers and Electric Boat Spec Sheets. Spec Sheets:

EB4211/16-100 and EB4211/16-200. This restricts competition to only Electric Boat and Electric Boat distributors that have access to their Spec Sheets. Requirements are further restricted by the requirement for vendors to be listed on S9320-AM-PRO-30 approved vendor list.

Plug Assemblies: This requirement requires that vendors be restricted to vendors listed on the S9320-AM- PRO-20 and that they also have pre-FAT certification.

The Navy requires that any vendor providing the cables for this order MUST be pre-FAT certified before they can be issued an award. Not all of the sources on the list are pre-certified at this time.

The rights to use the data needed to purchase this part from additional source(s) are not owned by the Government and cannot be purchased, developed, or otherwise obtained.

7. Efforts to ensure that offers are solicited from as many sources as practicable are:

[X] was conducted, and firms indicating an interest in the acquisition will be solicited. Market research efforts, include:

Sources sought notice SPMYM3-21-Q-3S04 was posted to BetaSam on January 27, 2021 and closed February 03, 2021. Two were received from industry as follows:

AMETEK SCP, Inc (Cage Code ODNZ3) 52 Airport Rd Westerly, RI 02891

Ametek SCP is a large business. They advised that as an approved molding vendor, they can provide these cables and that they have provided similar ones to other Shipyards.

L3Harris Technologies, Inc (Cage Code 34246) 1164 Pickett Road Norfolk, VA 23502

L3 is not a distributor for Electric Boat and is a large business. They indicated in their response that they work with Electric Boat sometimes.

Both vendors are authorized to provide the cables per NAVSEA S9320-AM-PRO-020.

Market research determined that this material is considered commercial of a type. These are electrical connector assemblies and although unique to Government applications, there are similar items in the commercial market or a commercial customer could request a similar item be manufactured for them by one of these companies.

9. Additional facts supporting other than full and open competition are:

[X] Based upon the technical certification on file, technical data is not available and cannot be developed to permit full and open competition. The data presently available reflects the minimum needs of the Government.

11. The actions, being taken to overcome barriers to competition before any subsequent acquisitions are made are:

If it should occur that another manufacturer has the same design for these type of cables, the interested parties will be invited to provide descriptive literature about their product, its compatibility, and history regarding its use. If it is determined that there is another possible source future acquisitions will allow for more competition.

12. I hereby determine that the anticipated cost to the Government will be fair and reasonable. The cables have been bought before on smaller contracts and there is ample history. PPI analysis will be used to look at projected pricing anticipated today.
