About this file

This justification and approval document seeks other than full and open competition to issue a firm fixed price purchase order for Industrial Training International, LLC virtual reality crane simulator software subscriptions. The Naval Sea Systems Command Contracting Division requires the software subscriptions to train crane operators at Puget Sound Naval Shipyard & Intermediate Maintenance Facility in compliance with Naval Facilities Engineering Command P-307 guidelines. The software must provide functionality for pre-operational checklists, pre-lift assessments, travel paths, load charts, rigging methods, radius, blind lifts, and securing cranes. The subscriptions are also required to be compatible with existing Industrial Training International virtual reality crane training simulators. The period of performance is one base year and four one-year option periods from June 2022 to May 2027 with an estimated cost of $360,000. The justification cites 10 U.S.C. 2304(c)(1) for sole source brand name acquisition as no other software subscriptions are compatible with the training simulators and can meet Naval Facilities Engineering Command requirements.

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

This acquisition is conducted under the authority of Federal

Acquisition Regulation FAR 13.501(a)(2).

1. Contracting Activity.

The Naval Sea Systems Command Contracting Division (Code 410), Portsmouth Naval Shipyard (PNS), Kittery, ME.

2. Nature and/or Description of Action Being Approved.

This is a Brand-Name action submitted for approval to issue a

Firm Fixed Price (FFP) Commercial Request for Quote. A purchase order for Industrial Training International, LLC (ITI) Virtual

Reality (VR) Crane Simulator software subscriptions for a Base

Year plus four Option Years will be issued via an authorized reseller, or the Original Equipment Manufacturer (OEM), as appropriate.

3. Description of the Supplies or Services Required to Meet the

Agency’s Needs (including the estimated value).

The Government’s need is to acquire renewal of Brand Name ITI VR

Crane Simulator for Puget Sound Naval Shipyard & Intermediate

Maintenance Facility (PSNS&IMF) at Bremerton, WA.

In order to meet this need, proprietary, commercial off-the-shelf

Brand Name ITI VR Crane Simulator subscriptions must be procured.

This procurement will be awarded to the OEM or an authorized reseller of the OEM, Industrial Training International. The estimated cost is $360,000 (for the base plus four option years).

NCH 53.6-2

Fiscal Year 2022 Operation and Maintenance, Navy funds are provided on funding document to be determined. The period of performance is 01 Jun 22 to 31 May 23 for the base year with four one year Option periods.

PSNS&IMF requires VR crane simulation training software subscriptions that are compliant with Naval Facilities

Engineering Command (NAVFAC) P-307 Guidelines that require preoperational checklists, pre-lift assessments, travel paths, crane load charts, basic rigging methods, crane radius, blind lifts, and securing the crane. The Government must also acquire software subscriptions that are compatible with the existing training simulators.

ITI VR Crane Simulation software subscriptions meet this requirement because they provide the required pre-operational checklists, pre-lift assessments, travel paths, crane load charts, basic rigging methods, crane radius, blind lifts, and securing the crane as required and are compatible with the existing ITI VR Crane training simulators.

After conducting market research, the Government did not identify any other software subscriptions that are compatible with the existing training simulators and are compliant with NAVFAC P-307.

4. Statutory Authority Permitting Other Than Full and Open

The statutory exception permitting other than full and open competition for this acquisition is 10 U.S.C. 2304(c)(1) Sole source (including brand name) acquisitions. The procedures in FAR subpart 13.501 were used in accordance with 10 U.S.C. 2304(c)(1), One source or limited sources.

5. Rationale Justifying Use of Cited Statutory Authority.

Competition

PSNS&IMF acquired ITI VR Crane training simulators and software subscriptions in 2018 due to the features provided by ITI that were not found in competing products. ITI is the only company that provides a VR crane training simulator that offers a motion base that simulates actual crane movements ensuring a safe, real world training environment for crane operators. The requested software subscription renewal is necessary as ITI provides the only software subscriptions that work with the existing training simulator.

No other VR crane training providers are able to provide the necessary software subscription that is compatible with the existing training simulators. Without ITI brand name software subscriptions, the existing training simulators will become inoperable resulting in significant duplication of costs and unacceptable delays in the fulfilling the agency’s requirements.

PSNS&IMF will see a loss of productivity due to the procurement, testing, installation, and training time associated with procuring a new training simulator that supports other software subscriptions. Implementation of a new training simulator would require greater than 12 months due to production workers balancing the time required for implementation and training while also supporting the critical task of the repair and replacement of ships and submarines. Without any virtual training simulator, PHNSY & IMF will see increased fuel and equipment costs due to the need to perform training on cranes currently in use.

PSNS&IMF will also see increased safety issues due to the risks associated with training using actual cranes. The OEM of this requirement is the only company capable of maintaining its source code. Use of non-compliant/non-OEM products will void current support contract for this requirement. Market research confirms that this product is available from various authorized resellers via the OEM.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable.

Market research included gathering data from previous acquisitions, reviewing current contracts, internet searches, reviewing catalogs and other contractor literature, contacting the manufacturer and authorized resellers, conducting internal discussions, reviewing existing DoD-wide contract vehicles and other government-wide acquisition contracts, and determining potential sources.

PSNS&IMF performed steps in conducting market research in support of this requirement by determining if other brand names of product are available to meet the Government’s needs. Market research revealed no other product currently on the market, besides ITI VR Crane Simulator, will meet the government’s requirement.

Based on current market research, it has been determined only the aforementioned brand name product and/or product support, ITI VR

Crane Simulator, can fully support the Government’s needs. No competitor functional replacement products exist in the market at this time to meet the Government's needs. The Government will continue to conduct market research to determine if there are changes in the market place that would enable future competitive actions; e.g., there are similar products and/or product support in the marketplace that provide the same functionality, the OEM releases ownership rights of product, or it is economically feasible to procure a new system.

7. Determination of Fair and Reasonable Cost.

A determination of fair and reasonable price will be based on price analysis by the Contracting Officer of the contractor’s quotation. Proposed prices will be compared with the Independent

Government Cost Estimate and quotes from other vendors. This information should be sufficient to support the fair and reasonable cost determination of this procurement.

8. Actions to Remove Barriers to Competition.

The Government will continue to conduct market research to determine if there are changes in the market place that would enable future competitive actions and to ensure that the future acquisition strategy matches the market conditions.
