About this file
This document is a Questions and Answers (Q&A) addendum for Invitation for Bid (IFB) 25-062 for an Automatic Transfer Switch, issued by the New York State Office of Mental Health (OMH). The document contains a single question from a potential vendor regarding contract timing and pricing, with a detailed response from OMH addressing the bid submission and offer validity.
The Q&A clarifies that OMH does not anticipate having an executed contract and purchase order (PO) prior to September 30, 2025. The agency explicitly states that they cannot provide guidance on vendor pricing strategies. However, they reference IFB Section 9.A, which indicates that bid submissions constitute a binding offer that remains valid for 120 days after the submission deadline, with the potential for further extension by mutual agreement between OMH and the successful offeror.

Questions and Answers
# Question Answer
Do you know if this contract will be awarded and PO cut prior to the 9/30/25 to ensure the lower price or should we provide alternate pricing?
We do not anticipate having an executed contract and PO prior to 9/30/2025. OMH cannot provide guidance on how a Vendor should price their products and services, however, please note that per the IFB Section 9.A “The submission of a bid constitutes a binding offer to perform said services. Such binding offer shall be firm and not revocable for a period of 120 days after the deadline for bid submission and will continue thereafter until the Successful Offeror notifies OMH otherwise in writing. Such deadline may be extended further by mutual agreement between the Successful Offeror and
OMH.
