(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition is NAICS code 561210, Size Standards $35.5 million. However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show --

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of offers;

(3) The name, address, and telephone number of the offeror;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) “Remit to” address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);

(9) Acknowledgment of Solicitation Amendments;

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 90 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.

(d) Product samples. N/A

(e) Multiple offers. N/A

(f) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)

(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and—

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or

(C) If this solicitation is a request for proposals, it was the only proposal received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

The Government contemplates award of a single firm-fixed price (FFP) and Time & Materials (T&M) type contract resulting from this solicitation.

(End of Provision)

L.3. INSPECTION OF FACILITY:

The purpose of the meeting is to provide a briefing of the contracting concept, the scope of work, the specifications, and to allow prospective Offerors the opportunity to ascertain the complexities and the location of the services to be performed, along with the general and local conditions which could materially affect conduct of operations and the prices involved.

The Government considers attendance vital to the preparation of a competitive proposal. It will enable the Contractor to become acquainted with the areas to be serviced, and to be aware of the specific problem areas which require special attention or services.

Failure to attend this meeting may not be used as an excuse for omissions or miscalculations in offers. It is emphasized that it is more advantageous for each offer to have qualified representation at the Pre-Proposal conference.

(a) Site Visit/Walk-Through Tours: The site visit/walk-through portion of the buildings will be provided by GSA starting July 29, 2014. The site visit/walk through portion of the buildings will be continued through July 30, 2014. An opportunity will be provided to view all locations. Prospective Contractors are encouraged to make an on-site, in-depth review of the facility(s), equipment, job requirements, etc.

Aside from the scheduled site visit tour referenced above and because of the potential for disruption to governmental activities, particularly in the U.S. Court, and other tenant areas, additional access to non-public areas of the building(s)/facility(s) for inspection purposes may not be possible.

Transportation will NOT be provided to the locations. However, GSA will lead the caravan from location to location as best at possible. It will be the contractor’s responsibility to find and locate the destination. There is a chance that the order of the site visit may change but the dates will stay the same. 52.212-2 EVALUATION -- COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. For this solicitation non-price factors are more important than price. The following factors shall be used to evaluate offers: See Addendum below.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

ADDENDUM AND/OR SUPPLEMENT TO FAR 52.212-2:

METHOD OF AWARD

EVALUATION OF NON-PRICE FACTORS

This acquisition will be evaluated by utilizing the Lowest Price, Technically Acceptable (LPTA) process. Accordingly, award will be made to the Offeror that submits the lowest total evaluated price proposal that is fair and reasonable and meets or exceeds the acceptability standards for non-price factors in accordance with below tables. No tradeoffs are permitted. An evaluation for acceptability will be performed. To be considered technically acceptable, no evaluation factor in the proposal may be determined to be unacceptable. The failure of a proposal to meet all of the requirements under any factor will result in a technically unacceptable rating and preclude award. If the Contracting Officer determines that a small business’ past performance is not acceptable, the matter will be referred to the Small Business Administration for a Certificate of Competency (COC) determination, in accordance with the procedures contained in Subpart 19.6 and 15 U.S.C. 637(b)(7)). However, if a COC is not issued by the Small Business Administration, the Offeror will be ineligible for award.

Factor 1 – Past Performance Description: This factor considers the Offeror’s past performance on similar contracts. This factor also considers the quality and how well the Offeror performed on similar contracts. If a prime-subcontractor arrangement is proposed, then for the past performance factor for evaluation, each critical subcontractor may be evaluated individually and then averaged together for an overall Team factor rating taking into consideration the appropriate weight to give each critical subcontractor based on their planned performance as identified in the proposal.

For example, if the proposal indicates Team member “A” will do approximately 30% of work, then approximately 30% weight is given to Team member A’s past performance rating in assigning the overall Team past performance rating. A subcontractor is considered critical if it is expected to perform 30% of the work.

If a prime-subcontractor arrangement is proposed, the burden is exclusively on the Offeror to supply the Government with adequate evidence in its proposal to clearly establish, expressed as a percentage, the degree to which each contractor is intended to be utilized in the performance of the work under the resulting contract.

Past Performance Acceptability Criteria

Rating
Description
Acceptable
Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror’s will successfully perform the required effort, or the Offeror’s performance record is unknown. (See note below)
Unacceptable
Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.

Note: Note: In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance (See FAR 15.305(a)(2)(iv)). Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” will be considered “acceptable.

Recency Definition

Contracts that are complete shall be for a minimum of twelve months of performance within five (5) years from the closing date of this solicitation;

Contracts that are current/ongoing shall have a minimum of twelve (12) months of performing the services from the closing date of this solicitation.

Factor 2 – Management Approach Description: This factor considers the Offeror's understanding of the requirements and deliverables and anticipated barriers and risks and a plan for overcoming those risk and barriers. Offeror shall provide an organizational chart illustrating corporate key personnel. The Offeror shall provide onsite supervisory personnel and qualifications. A plan that identifies on-site representatives for each building, work schedules for all on-site personnel. Provide a detailed description of the formal quality control plan (QCP). Offeror shall complete and submit the ‘Minimum Performance Standards’ worksheet identified in Section L.16.

An acceptable proposal shall meet these Management Approach key minimum requirements that are necessary for successful contract performance:

1. The proposal addresses the technical requirements and deliverables of the PWS and is indicative of an understanding of all technical requirements of the PWS and deliverables in Section C; and addresses any barrier and risks and includes a successful plan to overcome them;

2. Offeror staffing meets minimum requirements of section C.8.1, and proposed on-site supervisory personnel meet minimum qualifications identified in Section H.15.2;

3. Plan identifies on-site representative(s) for each building, work schedules for all on-site personnel;

4. QCP shall include minimum the requirements of Section C.8.6 (A-E), Quality Control Plan; and

5. Meet the minimum performance standards in the “Minimum Performance Standards” worksheet.

6. The proposal assents to all material terms of the solicitation.

Technical Acceptability Criteria

Rating
Description
Acceptable
Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable
Proposal does not clearly meet the minimum requirements of the solicitation

Factor 3 – Price Proposal Price will be evaluated and considered but will not be scored or combined with other aspects of the proposal evaluation. The proposed price will be evaluated for reasonableness.

Comparison of proposed prices with independent government cost estimates (IGCE) and or competition. Proposals unrealistically high or low in cost or price, when compared to the government estimate and/or competition, may be deemed reflective of an inherent lack of understanding of risks of the solicitation and may result in proposal rejection.

The Government is going to first rank price proposal based on price, excluding price for transition cost, and then evaluate the lowest-priced proposal for technically acceptability against the non-price factors of Past Performance and Management Approach that meet the above criteria, for technically acceptability. If the lowest-price proposal is determined to be unacceptable, the next lowest-price proposal will be evaluated. The evaluation will stop at the point when the government determines an Offeror to be technically acceptable with the lowest evaluated price, because that offer will represent the best value The otherwise technically-acceptable lowest-priced Offeror may be required to confirm/validate its price on a Contract Line Item (CLIN), element, or total price basis, and/or provide additional information in support of their price, prior to contract award at the Government’s request and discretion.

M.3. The Government intends to evaluate the proposal and may award a contract without discussions with Offerors (except communications conducted for the purpose of minor clarification). Therefore, each initial Offeror should contain the Offeror's best terms from a price and technical standpoint. The Government reserves the right to make no award. The Government reserves the right to reject any proposal that includes any assumption that adversely impacts the Government’s requirements.

M.4. Offerors failing to submit proposals conforming to the structure described in Section L will be rejected without further evaluation.
