SIMPLIFIED ACQUISITION PROCEDURES(SAP) JUSTIFICATION FOROTHER THAN FULLAND OPEN COMPETITION (J&A)
SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER DETERMINES THAT ONLY ONE SOURCE IS REASONABLY AVAILABILE. THIS DETERMINATION MUST BE SUPPORTED WITH FULL JUSTIFICATION FOR SOLE SOURCE FROM CUSTOMER. WHEN THE CUSTOMER DESCRIBES AN ITEM WITH A PURCHASE DESCRIPTION WHICH LIMITS THE AVAILABILITY TO ONE SOURCE, THE JUSTIFICATION MUST EXPLAIN WHY THE ITEM IS THE ONLY ONE THAT WILL MEET THE GOVERNMENT’S REQUIREMENT. STATEMENTS SUCH AS “ONLY KNOWN SOURCE” OR “ONLY SOURCE WHICH CAN MEET THE REQUIRED DELIVERY DATE” ARE INADEQUATE TO SUPPORT A SOLE SOURCE PURCHASE. BRIEF DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED, AND THE INTENDED USE
Purchase (3) HF Direction Finding Antenna AS-141, SWRI Part number 9137-1100-02, NSN 5985-01-543- 9211. The U. S. Coast Guard (USCG), Engineering Logistics Center proposes to procure items on the basis of other than full and open competition for three (3) Part number 9137-1100-02 manufactured by SWRI. The AS-141 Antenna is designed for harsh shipboard environments with frequency coverage of 0.5 to 30 MHz. It is a passive direction finding/receive antenna with a linear operation up to 100 W. The SWRI AS-141 HF DF antenna is specifically designed for shipboard applications requiring a low radar cross-section. It provides full instantaneous frequency bandwidth with linear operation up to 100 W. It can be mounted on decks, bulkheads, etc.
UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED.
The AS-141 Antenna is designed to withstand the severe shipboard physical environments and can be mounted on ships, aircraft and vehicles. The external surfaces of the antenna provide environmental protection for reduced maintenance. The Coast Guard does not possess the manufacturing and technical data to procure these parts from another vendor. No known source other than this vendor can provide an exact replacement. SWRI “does not use distributors and is the OEM - all domestic customers purchase direct from the factory”. The CG does not have the ability to certify other vendor’s aftermarket parts due to the lack of technical data available. The Failure of these parts can lead to premature failure and damage which will seriously impact the cutters ability to perform its mission. No other source can provide an exact replacement. REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES
The CG does not possess the technical data and manufacturing drawings to solicit the parts from another vendor. The CG does not have the organic capabilities to certify aftermarket parts for this system.
EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR ARE NOT AVAILABLE The Coast Guard does not possess or own the technical data required to solicit these parts from a source other than the OEM.
PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED The Coast Guard can request the OEM to provide/sell their proprietary manufacturing technical data. The USCG SFLC LREPL does not have any funding allocated for these types of purchases at this time, and historically OEM's do not sell or provide their proprietary manufacturing data rights.
