Justification for Use of Brand Name Specification Simplified Procedures for Certain Commercial Items for procurements exceeding the Simplified Acquisition
Threshold (> $150,000) pursuant to FAR Subpart 13.5
Justification for Use of Brand Name Specification Simplified Procedures for Certain Commercial Items for acquisitions exceeding $150,000
In order to use an alternate source, CBP would have to procure new security systems consisting of hardware, software, and software licenses. The estimated cost of replacing the security systems in all the covered facilities is approximately which far exceeds the estimated cost of this procurement. Additionally, CBP is currently working on a prospectus to consolidate the existing locations due to leases expiring in 2 to 3 years. With the leases expiring soon and the potential for consolidating facilities in the future, there would be no return on investment for CBP were it to switch to a new system at this time.
6. Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable.
It is anticipated that a combined synopsis/solicitation will be posted on FedBizOpps in accordance with FAR 5.203. This justification will be provided with the solicitation in accordance with FAR 5.102(a)(6)).
7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
It is anticipated that proposed prices will be determined fair and reasonable on the basis of competition, as market research indicates there are multiple authorized DSX resellers.
8. Description of market research.
As part of the market research process, CBP considered other manufacturers’ products as a potential alternative to continuing to maintain the currently installed DSX system. Although other manufacturers make similar products (including Hirsch Velocity and Lenel), market research indicated that it would not be cost effective to remove the currently installed system and install a new one rather than continuing to maintain the current system. This analysis showed that the similar products are comparable in price to the currently installed DSX system, and as noted in Paragraph 5 above, the cost to install new equipment would greatly exceed the estimated cost to maintain the current equipment.
9. Any other facts supporting the justification.
No other facts are applicable. For the reasons stated above, award must be made to a DSX authorized reseller.
10. A listing of the sources, if any that expressed, in writing, an interest in the acquisition.
No sources have expressed an interest in writing at this time.
