DEPARTMENT OF HOMELAND SECURITY

CUSTOMS AND BORDER PROTECTION

Performance Work Statement For Snow and ice removal at the Massena Border Patrol Station

1.0 BACKGROUND

The United States Border Patrol (USBP) is tasked with detection and deterrence of potential terrorists and of those who violate the immigration laws of the United States. USBP must have the ability to quickly and safely have rapid access to and from Massena Station facilities in order to perform their law enforcement and national security duties.

2.0 SCOPE OF WORK REQUIRED

It is the intent of this Performance Work Statement (PWS) to set standards of performance and to define the activities necessary for snow plowing, snow removal, and sanding/salting to provide parking space access and personnel safety during all hours of operation and to have the pavement cleared as weather permits. Required activities are defined in Paragraph 3 of this PWS.

2.1 The Contract Type for this order shall be a Firm, Fixed Price contract comprising a base year and the potential for four (4) option years.

2.2 Contracts shall be in place from November 1 to October 31 of the following calendar year. Option years are contract renewals that are mutually agreed-upon between the USBP and the Contractor prior to the beginning of each fiscal year. USBP shall make an Option Year offer on or about August 1 of each Fiscal Year in anticipation of the following contract Option Year. Renewals are made based upon continued Contractor satisfactory performance and acceptable pricing. Formal snow plowing activities for the base year shall begin 1 December 2009 and end 30 April 2010. In the event of a winter storm prior to, or after, the snow plowing activities start/end dates; the incumbent may be called upon to plow/sand on a case by case situation.

2.3 This PWS provides guidelines for snow plowing and removal operations at the Massena Border Patrol Station, Massena, New York located at 135 Trippany Road, Massena, NY 13662.

3.0 DESCRIPTION OF TASKS AND DELIVERABLES

Work under this contract includes snow plowing, snow removal and sanding/salting operations and according to requirements delineated further herein. All roadways shall be kept clean of snow at a width that will ensure safe two-way vehicle passage. In general, all work shall be performed in a manner so as not to encumber walkways, entrances, exits or roadways. Removal of snow should include all parking areas and access points (driveways).

3.1 Performance-Based Activities Required of the Contractor

3.1a All ice or other hazardous conditions shall be treated with approved materials only.

3.1b. Sanding and salting are to be accomplished as needed, or as requested by the contracting officer’s technical representatives (COTR). Sand shall be of 1/4” screened material in accordance with New York State Department of Transportation standards. The incumbent shall maintain a bare pavement policy on all areas. This shall be accomplished with the use of sand/salt mix or other acceptable methods as recommended by the Contractor approved by the COTR. Contractor shall be responsible for all sand/salt barrels to be placed at strategic areas within the station compound.

3.1c(1) Snow banks are to be removed when snow has accumulated sufficiently along the driveway to create a hazard when entering Trippany Road. This will include both sides of the driveway so that there is a full view left and right of traffic on Trippany Road.

3.1c(2) Similarly, attention must be given to snow drifts that may accumulate due to windy conditions, even during non-snowy conditions. Removal of drifts are to be given the same consideration as snow banks so that there is a full view left and right of traffic on Trippany Road.

3.1d Snow and ice shall be removed when time permits from all on-site catch basins to allow adequate run-off of melting snow and ice or when there is insufficient space on compound to accommodate piling of snow, or as directed by COTR. The Contractor must remove and haul off the snow and ice to designated snow dumps or other appropriate places, and he shall comply with all city or county ordinances.

3.1e Snow plowing of all paved areas, entrances, and walkways will commence, at a minimum, when each storm’s initial accumulation reaches 3 inches and shall continue throughout the storm to maintain a safe accumulation level of 2-to-4 inches. Additionally, the incumbent will ensure the entrances; walkways and garage doors are cleared on normal workdays by 0700, prior to building occupants arrival.

3.1f The helipad shall be kept clean of snow and ice.

3.1g The Contractor shall hand-shovel sidewalks, entrances, around the bulk gasoline tank. All the entrance and exit gates including fencing shall be maintained free of snow and ice buildup.

3.1h Contractor shall keep lanes clear to allow for access to the station marina.

3.1i Contractor shall clear areas around card swipe access points to allow for full access by either vehicle or pedestrian, as intended.

3.1j Contractor must keep areas around the vehicle entrance and exit areas clear of ice buildup caused by melting snow from the roof and shall use approved materials, such as salt, to combat this buildup.

3.1k In the event of significant snow accumulation, the Contractor shall clear the roof of the main building in such a manner that causes no damage to the roofing system and keeps the roof ridge vent clear of obstruction. CBP expects no more than 18” of snow accumulation on the roof top and the ridge vent. Contractor shall also remove any snow that falls from the roof onto walkways, parking areas, or equipment, and shall move it to a safe piling area.

NOTE: For bidding purposes, in lieu of any accurate way to compute number of times the roofs will need snow shoveling, we recommend that vendors should figure at least $1,500 for roof shoveling for the entire period. If the roofs require more attention than what was actually estimated, then the additional expense is absorbed by the Contractor. If the roofs don’t require any shoveling throughout the season then the incumbent retains this money. This figure is used to level the estimating field for roof snow removal.

3.1l Prior to annual fiscal year closeout – usually in May of each year but at the direction of the COTR or his representative - the Contractor shall use a power sweeper to collect all excess accumulations of sand and to remove it from the site so as not to accumulate on landscaped areas.

3.2 Contractor-furnished Items

The incumbent shall furnish all trucks, rubber tired front-end loader, sand/salt spreader, power sweeper, and other equipment, i.e., frame, hoists, plows and chains on drive wheels suitable for snow plowing and sanding/salting, together with the necessary drivers for the same.

All equipment must be in proper mechanical condition and fully equipped as required for efficient operation, properly registered and insured in accordance with the laws of the State of New York. Appropriate equipment is defined as;

3.2a At a minimum, the Contractor shall use a 4 wheel drive truck (with flashing yellow light fixed atop of cab).

3.2b Rubber tired front-end loader (with flashing yellow light fixed atop) or ability to rent such, for removal of snow and for pushing back snow banks.

3.2c Dump Truck (or ability to rent such) for snow removal, if required.

3.2d Vehicle equipped with sand/salt spreader for uniform spreading of said materials.

3.2e Power sweeper or ability to rent such, for spring cleanup.

3.2f Appropriate hand-tools/equipment needed to maintain pedestrian areas and roofs.

3.2g Appropriate safety gear to mitigate potential harm to Contractor or Government employees (to be determined by the Contractor and Safety Officer) while clearing potentially hazardous areas, e.g., roofs.

3.3 Additional Contractor Requirements

3.3a The Contractor shall be responsible for repairs of any damage caused by snow plowing/removal activities to include but not limited to lawn, fencing, light poles, pavement, sidewalks, vehicles, etc.

3.3b The Contractor shall provide proof of insurance, including insurance contact information, at the time of award.

3.3c The Contractor shall employ only qualified and competent personnel. At the time of contract award but no later than October 20th of each contract year, the incumbent shall submit all full names, dates of birth, social security numbers, and driver’s license numbers to the COTR or his designated representative of personnel working under this contract. These personnel shall be of sufficient numbers to perform the required services effectively and efficiently, and in a manner to meet the Massena Station’s requirements outlined herein. If the incumbent is notified in writing that any person employed in the execution of this agreement is, in the Massena Station’s opinion and after consultation of the COTR, incompetent, disorderly, or otherwise unsatisfactorily performing their duties, such person shall not again be employed in the execution of this contract without the written consent of the COTR.

3.3d For contract estimate computation purposes, Department of Labor wage rates apply to this contract. A copy of the applicable Service Contract Act (SCA) labor rates schedule shall be included in the initial solicitation package and in subsequent Option Year renewal notifications. Contractor shall abide by all Federal, State, and local labor regulations. The Government has the right to report and refer any suspected labor violations to the Department of Labor for review and follow-up actions.

3.3e The Contractor shall complete the Quality Assurance Surveillance Plan (QASP) at the end of each month and shall submit the completed form to the COTR or the COTR Representative no later than the close of business on the third workday following the end of each month. The monthly QASPs shall be used to track Contractor performance over the course of each fiscal year. Negatively, it may be used to deduct funds as a result of unsatisfactorily-performed tasks. In extreme cases, it may be used to terminate the contract or deny implementation of option years. Positively, it will be used to mutually confirm and document perceptions of performance acceptability and to ensure renewal of option year terms for the length of the contract.
