• FAR 13.106-1(b) states that, “For purchases not exceeding the simplified acquisition threshold, contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization). The following documentation constitutes the rationale for this decision.

(2) Supplies or services being procured:
Security services to operate, monitor, maintain, upgrade, and provide security supplies for a managed security and access control system of Government-owned manufactured, maintained and operated Kastle system.
(3) Reason that this is a sole source procurement:
This contract action is for a renewal of security services to operate, monitor, maintain, upgrade, and provide security supplies for a managed security and access control system of Government-owned manufactured, maintained and operated Kastle system. The DITMAC was established in a building equipped and installed with an operating and pre-existing Kastle Security System that is manufactured, maintained and operated solely by Kastle. There are no re-sellers for this service and maintenance on Kastle security equipment. This contract action meets the criteria stated in FAR Part 13.106-1(b). Kastle is the original source and these maintenance services are only available from Kastle for Kastle security equipment. Award to any other source would result in a substantial duplication of cost to the Government that is not expected to be recovered through competition. Upgrade costs to the existing government-owned security system has been at a value of from and . Competing this requirement would require removing a pre-existing system that is in-place and fully functional and replacing with a new security system that will perform the same functions currently being performed by the existing system, including installation of new monitoring equipment, and the services to monitor, maintain and upgrade as necessary. The renewal of the existing product/services represents the most cost effective approach for DSS and ensures continuity of operations without interruption or lapse in security.

(4) Market survey (indicate if any other firms were contacted or expressed interest)
Market research was conducted only on the basis to determine whether or not any other company could service the Kastle equipment already installed in the building. Kastle Systems, LLC is the sole manufacturer and provider of the managed security for Kastle security equipment, upgrades and maintenance, and there are not multiple distributors with the required hardware/software/maintenance and support available on the open market.
(5) Technical requirements personnel certification.
I hereby certify that this justification is made in good faith, that the supporting data and information are accurate and complete to the best of my knowledge and belief, and that I would not be making this request if it were feasible to fully compete this requirement. I further certify that this request is not the result of lack of advanced planning or a desire to expend funds while those funds are still available.
(6) Price Reasonableness Determination:
Leveraging DSS’ current use of the Vendor/Manufacturers product and services, along with open market price comparison, the contracting officer is confident in obtaining the best value for DSS.
