This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; there will not be an additional solicitation issued after this notice. This acquisition will be conducted in accordance with FAR 13.5, Test Program for Certain Commercial Items. This solicitation document incorporates provisions and clauses that were in effect through Federal Acquisition Circular 05-68 dated 26 June 2013.

The solicitation number for this requirement is HS0021-13-T-0079. This solicitation is issued as a request for quotations (RFQ). This acquisition is restricted as a 100% Set-Aside for Small Business (SB) concerns. The associated North American Industry Classification System (NAICS) code for this procurement is 517911, with a Standard Industry Classification (SIC) code of 3661. The Small Business size standard for this requirement is 1500 employees.

The Defense Security Service (DSS), located in Quantico, Virginia has a requirement to procure and installation of a complete telephone solution to include telephone services, and telephone hardware. The quotes will be evaluated in accordance with FAR Part 52.212-2. DSS anticipates making an award to the lowest priced offeror whose quote technically conforms to this combined synopsis solicitation and who also has an acceptable pass performance record.

The details for this requirement are attached on the statement of work and the specification spreadsheet:

DSS anticipates awarding a firm fixed price (FFP) contract. The government intends to issue a single contract to the responsible offeror who submits an offer in accordance with this solicitation.

52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The evaluation will consist of Pass / Fail Criterion, Technical Evaluation Criteria, and a Price Analysis. The following factors shall be used to evaluate offers:

Pass / Fail Criterion:

The following factor will be evaluated on a Pass / Fail basis:

Specification Conformity. Each offer will be evaluated to determine whether the proposed solution meets the exact specifications as required by the Statement of Work. Should an offer fail to conform to the exact specifications as solicited, the offer will be discarded and not evaluated further.

Technical Evaluation Criterion:

Once an offer has been determined to meet the exact specifications as solicited, it will then be evaluated based on the following factors (each factor is of equal importance):

Past Experiences. Each offer will be evaluated based on past experiences, and how they relate to the work that will be performed in the prospective contract.

Past Performance. Each offer will be evaluated based on how well the vendor has performed in the past for its customers (including DSS). DSS will only consider past performance information that is considered relevant to this procurement. In addition, DSS will consider the degree of relevance of the vendor’s overall past performance. DSS reserves the right to independently gather past performance information from any source, including sources other than listed by the vendor.

Price Analysis:

The total price will be calculated and evaluated by adding the sum of the base period and all option periods.

Specification Conformity, Past Experiences, and Past Performance are more important than Price.

All responsible sources may submit an offer which shall be considered by the agency. In order to be considered responsive, the offeror must:

1. Be a Small Business concern;

2. Propose all items to the exact specifications as solicited (offeror must include warranty information and part numbers);

3. Demonstrate past experiences with similar scopes of work;

4. Demonstrate successful past performance in similar scopes of work;

5. Provide pricing for all solicited supplies and services;

6. Submit a completed clause DFARS 252.209-7995 as an attachment to their offer; and

7. Sign and return a completed SF 1449 and subsequent amendments to this solicitation.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e) (1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1)in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within five days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least ten days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 60 months.

L. 113-6), none of the funds made available by that Act for DoD (including Military Construction funds) may be used to enter into a contract with any corporation that—

252.232-7006 WIDE AREA WORKFLOW PAYMENT INSTRUCTIONS (MAY 2013)

(a) Definitions. As used in this clause--

Department of Defense Activity Address Code (DoDAAC) is a six position code that uniquely identifies a unit, activity, or organization.

Document type means the type of payment request or receiving report available for creation in Wide Area Work Flow (WAWF).

(b) Electronic invoicing. The WAWF system is the method to electronically process vendor payment requests and receiving reports, as authorized by DFARS 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(c) WAWF access. To access WAWF, the Contractor shall--

(1) Have a designated electronic business point of contact in the System for Award Management at https://www.acquisition.gov; and

(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this Web site.

(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/.

(e) WAWF methods of document submission. Document submissions may be via Web entry, Electronic Data Interchange, or File Transfer Protocol.

(f) WAWF payment instructions. The Contractor must use the following information when submitting payment requests and receiving reports in WAWF for this contract/order:

(1) Document type. The Contractor shall use the following document type(s).

(2) Inspection/acceptance location. The Contractor shall select the following inspection/acceptance location(s) in WAWF, as specified by the contracting officer.

(4) Payment request and supporting documentation. The Contractor shall ensure a payment request includes appropriate contract line item and subline item descriptions of the work performed or supplies delivered, unit price/cost per unit, fee (if applicable), and all relevant back-up documentation, as defined in DFARS Appendix F, (e.g. timesheets) in support of each payment request.

(5) WAWF email notifications. The Contractor shall enter the email address identified below in the “Send Additional Email Notifications” field of WAWF once a document is submitted in the system.

PACKAGING

Equipment ordered under this contract shall be packed in accordance with the Contractor’s standard commercial practice to prevent damage and to ensure a safe arrival at final destination. Any labels identifying products shall be affixed to the outside of the packaging in such a manner as to be visible and not affixed directly on the product.

MARKING

Packages shall be labeled with the “Contract Number and Performance address”. Markings by the contractor shall be clear and easily readable.

PRODUCT WARRANTY

All equipment shall have a warranty for a period of 12 months after the Government’s system acceptance.

INSTALLATION

• Protect walls and floors of all corridors, building areas, staging areas, and rooms where the equipment is to be installed. Damage will be repaired at no additional cost to the government.

• Remove and dispose of all packing materials, debris and cartons from the job site daily. No trash or packing material may be left at DSS facilities or discarded in the building's trash containers or dumpsters.

CODES AND REGULATIONS

The Contractor is responsible for ensuring that all installations shall comply with all applicable ADA, state, local, and federal building codes, local ordinances and regulations.

POST-INSTALLATION DELIVERABLES

Replace all damaged and incorrect products, and add all missing product within a reasonable period of time post-installation.

COOPERATION DURING OUTAGES

Contractor shall fully cooperate with the local phone service provider in resolving outages.

SPECIAL CONTRACT REQUIREMENTS FOR SERVICE CONTRACTS

(a) Inherently Governmental Functions - No inherently government functions as defined in FAR 2.101 and FAR 7.5 shall be performed by the contractor under this contract. Contractor employees shall not participate in any deliberations or meetings intended to exercise an inherently governmental function. All final determinations such as binding the United States to take or not to take some action, selecting program priorities, and providing direction to Federal employees shall be made by the government. The contractor shall immediately notify the Contracting Officer’s Representative (COR) and the Contracting Officer if performance of an activity would result in the performance of an inherently governmental function.

(b) Non-Personal Services Contract - In accordance with FAR 37.101, this contract is a non-personal services contract. Contractor personnel rendering the services shall not be subject, either by the contract's terms or by the manner of its administration, to the continuous supervision and control of a Government officer or employee. The contractor shall immediately notify the COR and the Contracting Officer if, through contract administration, the actions of a government employee will result in the performance of a personal services contract.

(c) Identification of Contractor Personnel – In accordance with DFARS 211.106, contractor personnel shall never identify themselves as representing the Defense Security Service (DSS), but rather shall identify themselves as being under contract to DSS. To that end, contractor personnel shall 1) identify themselves as contractor personnel at meetings by introducing themselves or being introduced as contractor personnel; 2) display distinguishing badges or other visible identification for meetings with Government personnel; and 3) identify themselves as contractor employees in telephone conversations and in formal and informal (e.g. e-mail) written correspondence.

(d) Marking of Reports - The contractor shall mark all documents or reports produced under this contract with the contractor name, contract number, and task order number, if applicable.

The standards do not require the installation of specific accessibility-related software or the attachment of an assistive technology device, but merely require that the EIT be compatible with such software and devices so that it can be made accessible if so required by the agency in the future. The quote must indicate where full details of compliance can be found (e.g., vendor’s website or other exact location or attach the information).

a. Maintenance and Local Calling Service shall be billed monthly in arrears.
