All work performed by the contractor shall be performed in accordance with all applicable laws, regulations (to include but not limited to 29 CFR 1910), OSHA standards, instructions, and commercial practices.
1.3 SAFETY REQUIREMENTS: The Contractor shall maintain safety and health standards compliant with requirements of the Occupational Safety and Health Administration
(OSHA).
1.4 SECURITY REQUIREMENTS: The Contractor shall be responsible for the security of all information.

EVALUATION FACTORS
EVALUATION FACTORS FOR AWARD
LOWEST PRICE TECHNICALLY ACCEPTABLE (LPTA)
EVALUATION FACTORS FOR AWARD
a. BASIS FOR CONTRACT AWARD: This acquisition will utilize Lowest Price Technically Acceptable (LPTA) source selection procedures in accordance with FAR 15.101-2, as supplemented. This is a competitive LPTA best value source selection in which technical acceptability is considered the most important factor. By submission of its offer, the Offeror accepts all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. All technically acceptable offerors, with satisfactory past performance, shall be treated equally except for their prices. Failure to meet a requirement may result in an offer being determined technically unacceptable. Offerors must clearly identify any exception to the solicitation and conditions and provide complete accompanying rationale.
The Government intends to select ONE contractor for award of this effort.
For the purpose of award, the government shall evaluate offers based on the evaluation factors described below:
FACTOR 1 Technical Acceptability (Pass/Fail) FACTOR 2 Satisfactory Past Performance (Pass/Fail) FACTOR 3 Cost/Price
Factor 1 - Technical Acceptability:
Each offeror’s technical quotations will be evaluated to determine if the offeror provides a sound, compliant approach that meets the requirements of Part 5 of the Performance Work Statement (PWS) and demonstrates a thorough knowledge and understanding of those requirements. Provide your proposed technical approach for delivering high quality maintenance and repair services as defined in the PWS. Describe the firm’s technical approach in performing the resulting contract while focusing on the optimal use of resources to meet all performance requirements defined in the maintenance and repair of the stated firing ranges found in the PWS.
At a minimum the offeror should:
(1) Discuss the knowledge, skills and capabilities required by the PWS and how the firm will ensure that personnel performing on the contract will meet or exceed requirements.
(2) Discuss how the firm will address normal and emergency repairs including the repair that will be done at the award of the contract.
(3) Address all of the required information in the PWS.
An evaluation rating of Technically Acceptable / Non-Acceptable will be assigned upon completion of the technical quotations evaluation. If an Offeror receives a technical rating of “Non-Acceptable” they will not be considered for task order award. Technical quotations shall be limited to no more than 25 pages using Microsoft Word format, 12pt times New Times Roman font, double-spaced with 1 inch margins.
Factor 2 – Satisfactory Past Performance:
a. Submission Requirements Offerors shall submit up to a total of five projects. These projects can be any combination of projects between the prime contractor (at least three (3) projects) and subcontractor(s) to be evaluated for Factor 2 -- Past Performance. The Project Data Sheets will contain information used to evaluate Past Performance. Regarding past performance, offerors shall provide a brief history of the project to include the agency or firm for whom the work was or is being performed, the contract number, the date of award, the period of performance, the contract/project value, the type of contract (IDIQ, fixed price, cost reimbursable, Time and Materials, etc.), whether the offeror performed as a subcontractor or as a prime, and Point of Contact information (including name, telephone and fax number and the title of a reference who can verify quality of performance on the project(s) identified).
(1) Projects listed may include those entered into by Federal Government, agencies of state and local governments, and commercial customers for the same or similar services as described under this RFQ. If a firm has no relevant past performance history of the same or similar scope, size, and complexity of this requirement, the quote must affirmatively state that it possesses no past performance experience of the same or similar scope, size, and complexity. All projects submitted shall be completed or substantially completed within the past three years of the RFQ closing date to be considered in the evaluation of Factor 2, Past Performance.
(2) For all projects submitted that have been completed or substantially completed within the past three (3) years of the RFQ closing date, offerors are responsible for having each of their customer POCs complete a Past Performance Questionnaire (Attachment A) and return this Questionnaire electronically via email to the Contract Specialists indicated in the questionnaire no later than the due date of quotes.
(3) References other than those identified may be contacted by the Government in the evaluation of the firm’s past performance. The Government reserves the right to contact and verify past performance experience with references, and to use any other past performance information available on the firm. Additional past performance data may be obtained through the Past Performance Information Retrieval System (PPIRS), the Contractor Performance Assessment Reporting System (CPARS) or similar systems, other Government departments and agencies, program managers, contracting officers, and other sources known to the Government (including commercial sources). Offerors will be given the opportunity to address any negative performance information resulting from the past performance assessment inquiries.
(4) Failure to provide the correct, current telephone and fax number, and/or email address for each point of contact (POC) listed may result in a lower rating for this factor.
b. Evaluation Criteria:
(1) Offerors will be evaluated on the quality of their past performance for the contracts listed in the Project Data Sheet that are currently on-going or have been completed within five (5) years from the closing date of this RFQ. Contracts listed may include those entered into by Federal Government, agencies of state and local governments, and commercial customers for the same or similar experience under this RFQ. Projects performed by the prime and subcontractor team as proposed on this contract (if applicable) will be considered more favorably in the evaluation of past performance than projects performed by proposed subcontractor team members working alone or with other primes.
(2) The Government will evaluate the Offeror’s record of past performance in “recent” and “relevant” contract efforts. With regard to past performance, the term “offeror” includes the prime contractor, subcontractors and/or teammates. “Recent” means contracts that were performed during the last five (5) years from the closing date of the RFQ. Additionally, the Government will evaluate whether the offeror and any proposed subcontractors or team members have consistently demonstrated a commitment to customer satisfaction and timely delivery of quality services at fair and reasonable prices by reviewing the offeror’s record of the following:
1. Conforming to contract and regulatory requirements;
2. Management effectiveness;
3. Quality Control;
4. Timeliness and adherence to schedules;
5. Customer satisfaction;
6. Adherence to safety standards.
(3) When performance is evaluated, the outcome is either satisfactory or unsatisfactory.
Unsatisfactory performance will disqualify an offeror from award.
Factor 3 - Price Evaluation.
The government shall conduct a price evaluation of all technically acceptable offers with satisfactory past performance including any option prices if applicable.
a. Submission Requirements The Price Quotes shall include prices for all Contract Line Items (CLINS) and SubCLINS as described below.
The Offeror shall price all CLINS including base period and options periods. The Excel spread sheet shall show hourly wages for laborers that are necessary for the maintenance and repair of the firing ranges. The Offeror’s price quote SHALL incorporate the wages and benefits applicable to the Service Contract Act. Finally, the offerer shall present a signed offer and representations and Certifications (unless annual Reps and Certs – ORCA – are used)
b. Evaluation criteria The Offeror’s price quote will be evaluated to determine if it is complete, and reasonable.
(a) Completeness is evaluated to assess the level of detail the offeror provided in price-supporting information for all RFQ requirements in the PWS and technical documents, and assessing the traceability of estimates.
(b) Reasonableness is evaluated by comparing the prices received in response to the RFQ or comparing prices with other similar work. The price quote will be evaluated using one or more of the techniques defined in FAR 15.404.
b. Rejection of Unrealistic Offers:
The Government may reject any quote that is evaluated to be unrealistic in terms of program commitments, including contract terms and conditions, or unrealistically high or low in cost/price when compared to Government estimates, or are unbalanced, such that the quote is deemed to reflect an inherent lack of competence or failure to comprehend the complexity and risks of the program.
c. Source Selection Decision:
The government shall select the source based upon a best value evaluation of the offeror’s technical acceptability, satisfactory past performance and price. The government shall choose the lowest realistically priced, responsive, with satisfactory performance, and technically acceptable offer for award.
