PERFORMANCE WORK STATEMENT (PWS)

Maintenance for Pentagon Firing Range

1. GENERAL: This is a non-personnel services contract to provide Maintenance for the

Pentagon Firing Range. The Government shall not exercise any supervision or control over the contract service providers performing the services herein.

1.1 BACKGROUND:

1.2 SCOPE OF WORK: The Contractor shall provide all management, tools, equipment, materials, and labor necessary to ensure that maintenance services are performed on the Pentagon Force Protection Agency (PFPA) 5 lane indoor firing range located within the Pentagon (Room RDF-IK693A) in a manner that will maintain a satisfactory facility condition and present a clean, neat and professional appearance, as well ensuring the range facility and related range systems are fully operational. All work performed by the contractor shall be performed in accordance with all applicable laws, regulations (to include but not limited to 29 CFR 1910), OSHA standards, instructions, and commercial practices.

1.3 SAFETY REQUIREMENTS: The Contractor shall maintain safety and health standards compliant with requirements of the Occupational Safety and Health Administration

(OSHA).

1.4 SECURITY REQUIREMENTS: The Contractor shall be responsible for the security of all information.

1.4.1 Neither the Contractor nor any of its contract service providers shall disclose or cause to disseminate any information concerning operations of military activities. Such action(s) could result in violation of the contract and possible legal actions.

1.4.2 The Contractor shall only conduct business with designated government personnel listed as points of contact (POCs). Names of authorized personnel shall be provided to the Contractor by the government, in writing, and updated as necessary throughout the contract period.

1.5 PERFORMANCE QUALITY: The Contractor shall establish and maintain a complete Quality

Control Plan (QCP) that shall ensure the requirements of the contract are provided as specified in Section 5 of the PWS. Within thirty calendar days after contract award, three copies of a comprehensive written QCP shall be submitted to the COR and within 5 working days when changes are made thereafter.

1.6 ENVIRONMENTAL CONTROL:

Information pertaining to environmental control can be found at:

• Biobased: Biobased Industrial Products certified by the U.S. Department of Agriculture at http://www.biopreferred.gov/DesignationItems.aspx http://www.biopreferred.gov/DesignationItems.aspx

• Energy Efficient: Federal Energy Management Program for energy efficient products at http://www1.eere.energy.gov/femp/procurement

• Recycled: Comprehensive Procurement Guidelines for products designated by the U.S. Environmental Protection Agency for purchase with recovered materials at http://www.epa.gov/epaoswer/nonhw/procure/products. htm

1.6.1 The Contractor shall comply, and assure that all subcontractors comply, with all applicable federal, state, and local laws, regulations, ordinances, policies and standards related to environmental matters. Where applicable, the Contractor shall use environmentally safe products in the course of this contract. The Contractor shall maintain and provide upon request Material Safety Data Sheets (MSDS) for all chemicals used in the performance of this contract.

A copy of all MSDS will be provided to the CO/COR. If the Contractor spills or releases any substance contained in 40 CFR 302 in the environment, the Contractor shall immediately notify the COR. The Contractor is responsible for all costs associated with clean-up and restoration including any applicable fines and/or penalties.

1.6.2 Biobased Materials and Products

The Farm Security and Rural Investment Act and Executive Order 13423 require all federal projects and facilities to preferentially purchase products certified by the U.S. Department of Agriculture to contain biobased content (see “Resources” below). The only justifications allowed for not purchasing the certified products with biobased content are the same as for recycled products—the CAP. In case of conflict with RCRA, RCRA prevails.

1.6.3 Energy Efficient Products

Energy policy acts of 1992, 2005, 2007 and Executive Order 13423 require the purchase of energy efficient products--either those labeled “ENERGY STAR” or designated by the U.S.

Department of Energy’s Federal Energy Management Program (FEMP). The requirement applies both to direct purchases and contracted services, including contracts for design, construction, renovation, or maintenance of a public building. For contracted services, the contractor must provide ENERGY STAR, FEMP qualified, or other energy efficient products.

1.6.4 Ozone-Depleting Alternatives

The Clean Air Act (Title VI) and Executive Order 13423 require giving preference to the purchase of safe alternatives to ozone-depleting substances as approved by EPA’s Significant New Alternatives Policy (SNAP) program.
