52.212-2 EVALUATION ADDENDUM

ADDENDUM TO FAR CLAUSE 52.212-2 EVALUATION – COMMERCIAL ITEMS

1.0 BASIS FOR CONTRACT AWARD

The Government will award a Firm Fixed Price contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

(1) Proposals containing exceptions, qualifications, conditions, assumptions or any other deviations from the solicitation will be rejected by the Government and considered ineligible for award irrespective of what volume it is contained in or when in the evaluation this information is identified.

(2) Data previously submitted, or presumed to be known, i.e., descriptions of previous projects performed for the Government, cannot be considered as a part of the proposal unless physically incorporated in the proposal.

(3) Proposals must be clear, complete, and concise.

(4) Unless all offers are rejected, award will be made to the responsible offeror whose offer, conforming to the solicitation, is determined to be the best overall value, price and other factors considered.

(5) The Government may select for award the offeror whose price is not necessarily the lowest, but whose technical and/or past performance proposal is more advantageous to the Government and warrants the additional price.

(6) In determining the best overall value, the combined non-price factors are more important than the price factor.

(7) Proposals will be evaluated based on the following volumes/factors listed in descending order of importance.

Volume II (Factor 1) – Technical capability Volume III (Factor 2) – Past performance Volume IV (Factor 3) – Price Technical Capability and Past Performance (Factors 1 and 2) are equal in importance and more important than Price (Factor 3).

Importance of Price. In accordance with FAR 15.304, the evaluation factors other than Price, when combined, are significantly more important than price, however, Price will contribute substantially to the selection decision.

2.0 EVALUATION FACTORS

a. Pass/Fail Requirements

An offeror that receives a “Fail” for the following requirement will not be evaluated further and will not receive award.

Facility Security Clearance is a pass or fail requirement. To pass this factor and be considered for award, the Offeror shall possess a facility clearance at the classification level of SECRET at the time of submission in accordance with Performance Work Statement (PWS) Section 1.6.7 and DD Form 254, Contract Security Classification Specification. Please provide official evidence of your company’s SECRET Facility Clearance. If the Offeror does not have an active SECRET Facility Clearance, the Offeror will receive a “Fail” for this requirement and will not be evaluated further and will not receive award.

b. FACTOR 1 – TECHNICAL CAPABILITY

The Government will evaluate the adequacy of the Offeror’s approach including staffing, completeness and understanding of the requirements specified in the solicitation and all attached documents, including the Performance Work Statement (PWS), as demonstrated by the proposed technical capability. The offeror shall be sufficiently complete to demonstrate how the Offeror will comply with Government tasking and requirements. Data previously submitted, or presumed to be known, i.e., descriptions of previous projects performed for the Government, cannot be considered as a part of the proposal unless physically incorporated in the proposal. Clarity, completeness and conciseness are essential. The Government will specifically evaluate the extent to which the Offeror presents the following:

(a) How the Offeror’s personnel, processes and experiences meet or exceed the requirements of task 5.

(b) The Offeror must submit detailed resumes that demonstrate that all key personnel proposed by the offeror shall, at a minimum, meet or exceed the criteria required to perform under sections 1.6.12 and

5.0 of the PWS. Resumes must state how proposed key personnel meet the requirements. If requirements are met by current or previous employment, the resume must state the job title, dates of employment (month and year), and demonstrate how the proposed personnel met the requirement. If requirements are met by education, the resume must state the educational institution, school, or university, dates attended (month and year) and degree obtained. Resume(s) are not counted against the page limit for this factor.

NOTE: A rating of Unacceptable under Factor 1 will render the entire submission unawardable.

c. FACTOR 2 – PAST PERFORMANCE

The Government will evaluate how well the Offeror has performed on contracts that have been determined to be both recent and relevant to the PWS.

Past performance is a measure of the degree to which the Offeror satisfied its customers in the past and complied with Federal, State, and local laws and regulations. The Government may contact some, all or none of each Offeror’s customers to ask, among other things, whether: (1) the Offeror is capable, efficient, and effective; (2) the Offeror’s performance conformed to the terms and conditions of its contract; (3) the Offeror was reasonable and cooperative during performance; (4) the Offeror was committed to customer satisfaction; (5) the Offeror was able to hire and retain qualified personnel to the satisfaction of the customer; and (6) if they would select the same Contractor or a different Contractor, given the opportunity.

The Government may also use other information available from other sources to evaluate the Offeror’s past performance, which may include, but not limited to: Past Performance Questionnaire, Federal, State and local Government agencies, Better Business Bureaus, published media, electronic databases such as the Contractor Performance Assessment Reporting System (CPARS) and the Past Performance Information Retrieval System (PPIRS). The Government reserves the right to limit or expand the number of references it decides to contact and to contact references other than those provided by the submitter. In the case of an Offeror without a record of relevant past performance or for whom no information on past performance is available, the Offeror will not be evaluated favorably or unfavorably on past performance.

d. FACTOR 3 – PRICE

In accordance with FAR 15.404-1, Proposal analysis techniques, submissions will be evaluated to determine if they are fair and reasonable. Price will not be scored or receive an adjectival rating. The Government may determine if the Offeror’s proposed price reflects the Offeror’s understanding of the requirements and if the proposed price is balanced and consistent with the submitter’s submission. The evaluated price will include all Contract Line Item Numbers (CLINs) and all options.

For evaluation purposes only, the total evaluated price is the sum of the total prices submitted for (a) the base period,

(b) all option periods, and (c) the six-month extension authorized by FAR clause 52.217-8. For purposes of determining the evaluated price for the six month 52.217-8 extension, the total price is calculated as one-half of the total price of the final option year. The Government may determine that a submission is unacceptable if the option prices are significantly unbalanced. Evaluation of options will not obligate the Government to exercise the option(s).

3. RATING METHODS

a. FACTOR 1 – Technical Capability

Volume II of each submission shall be given a rating identified in Table 1 that reflects the degree to which the proposed approach meets or does not meet the threshold performance or capability requirements through an assessment of the relative strengths, weaknesses, significant weaknesses, deficiencies, and risks to successful performance.

TABLE 1: COMBINED TECHNICAL/RISK RATING

Rating Description Outstanding Submission indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.

Good Submission indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.

Acceptable Submission meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.

Marginal Submission has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.

Unacceptable Submission does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable.

Submission is unawardable.

NOTE: A rating of Unacceptable under Factor 1 will render the entire submission unawardable.

b. FACTOR 2 – Past Performance

There are three aspects to the past performance evaluation: recency, relevancy (including context of data), and quality (including general trends in contractor performance and source of information).

Step 1 - Recency. A Recency determination will be made for each contract reference provided. Recency is defined as contract performance during the past five (5) years from the date of issuance of this solicitation. Contracts that were started prior to this time, but still in effect as of five (5) years from the date of this solicitation, will be considered recent. Offerors’ performance record during the entire contract period will be evaluated.

Step 2 - Relevance. The second is to determine how relevant a recent effort accomplished by the Offeror is to the effort to be acquired through the source selection. WHS/AD reserves the right to determine which contracts submitted by the Offeror is relevant to the requirements and to utilize only those references. In establishing what is relevant, the Offerors will be evaluated on the relevancy of their past performance and the extent of similarity to the requirements of the PWS. Consideration will be given to those aspects of an Offeror’s history of contract (or subcontract) performance that would provide the most context and give the greatest ability to measure whether the Offeror will successfully satisfy the requirement as set forth in the PWS. Common aspects of relevancy include, but are not limited to, the following: similarity of product/service/support, complexity, dollar value, contract type, use of key personnel, and extent of subcontracting/teaming.

There are four levels of relevancy used to evaluate past performance relevance described in DOD Source Selection Procedures, paragraph 3.1.3.1.2, Table 4 - Past Performance Relevancy Rating Method and excerpted in Table 2 below.

Table 2 - Past Performance Relevancy Acceptable/Unacceptable Rating Methods

“Strength” is defined as an aspect of an Offeror’s proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.

“Weakness” is defined as a flaw in the proposal that increases the risk of unsuccessful contract performance.

A “significant weakness” is defined as a flaw in the proposal that appreciably increases the risk of unsuccessful contract performance.

“Deficiency” is defined as a material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.

Rating Definition Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant

Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

Step 3 - Quality of Products or Services. The third aspect of the past performance evaluation is to establish the overall quality of the Offeror’s past performance (see FAR 15.304(c)(2)). The Past Performance Evaluation Team will review all past performance information collected and determine the quality of the Offeror’s performance, general trends, and usefulness of the information and incorporate these into the performance confidence assessment.

A separate quality assessment rating is not required; rather, the past performance confidence assessment rating is based on the Offeror’s overall record of recency, relevancy, and quality of performance.

Performance Confidence Assessment. There are five levels of confidence used to evaluate past performance relevance described in DOD Source Selection Procedures, paragraph 3.1.3.3, Table 5 - Performance Confidence Assessment Method and excerpted in Table 3 below.

Table 3 - Past Performance Confidence Assessment Ratings

Rating Description

SUBSTANTIAL

CONFIDENCE

Based on the Offeror’s recent/relevant performance record, the Government has a high expectation that the Offeror will successfully perform the required effort.

SATISFACTORY

CONFIDENCE

Based on the Offeror’s recent/relevant performance record, the Government has a reasonable expectation that the submitter will successfully perform the required effort.

NEUTRAL

CONFIDENCE

No recent/relevant performance record is available or the Offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonable assigned. The Offeror may not be evaluated favorably or unfavorably on the factor of past performance

LIMITED

CONFIDENCE

Based on the Offeror’s recent/relevant performance record, the Government has a low expectation that the submitter will successfully perform the required effort.

NO

CONFIDENCE

Based on the Offeror’s recent/relevant performance record, the Government has no expectation that the Offeror will be able to successfully perform the required effort.

c. FACTOR 3 - Price

Price does not receive a rating. In accordance with FAR 15.404-1(b), the Government will evaluate whether the proposed price is fair and reasonable under Factor 3 above. If an Offeror’s price is not found to be fair and reasonable, the proposal will not be eligible for award.
