QUESTIONS AND ANSWERS
Questions and Answers
1) 1.6.18 Reporting; Page 9; The Government states “Contractor will, in addition to invoice requirements, submit a monthly financial report to the Contracting Officer and COR that includes all labor and travel costs incurred by the contractor. The report shall be formatted to provide breakout of labor hours per employee and related costs for the current period to date and the total amount expended to include the remaining balance on each contract CLIN.”
Question: Will the Government please clarify if the requirement is Firm Fixed Price, Firm Fixed Price Level of Effort, or Labor Hour? If Firm Fixed Price, will the government please remove this statement as it is not congruent with the solicitation contract type as stated in 1.6.7 (Page 6) nor 52.216-1 TYPE OF CONTRACT (APR
1984) as stated on page 44.?
Answer: It is Firm Fixed price with reimbursement for travel CLIN.
2) FAR 52.212-2 Evaluation – Commercial Items; Page 31;
Question: Will the Government please provide the full text of this FAR Clause as Evaluation
Criteria has not been established for this requirement?
Answer: The Full text of FAR 52.212-2 is submitted.
3) FAR 52.222-41, Service Contract Labor Standard (MAY 2014) (41 U.S.C chapter 67)
Question: Will the Government please remove this clause as this is a Commercial Items acquisition as no standard for this Clause has been established in the requirement and
Employees under this contract qualify for exemption as bona fide executive, administrative or professional employees under the FLSA (29 C.F.R. Part 541).
Answer: Removed.
4) Volume II; Page 36;
Question: The government requests Past Performance Questionnaires (PPQ’s) from the offeror to be submitted to DSCA via customer reference. Since the CPARS/PPIRS is the official repository for contractor performance evaluation, will the government evaluate this requirement through the CPARS/PPIRS system for services performed similar to the scope of the requirement in lieu of the PPQ? The undue administrative burden placed on customers to complete a PPQ when the information is readily available in CPARS/PPIRS seems unreasonable.
Answer: The Past Performance questioners (PPQ) survey must be submitted.
5) Representations and Certifications
Question: Is it the Governments intent that vendors submit Representations and
Certifications in the Pricing Volume III or will a reference to www.SAM.gov be sufficient?
If Representations and Certifications are required with submission will you provided with the solicitation?
Answer: Yes. The www.SAM.gov reference will be sufficient.
SECTION SF 1449 - CONTINUATION SHEET
The following have been modified:
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible Offeror whose proposal conforms to the solicitation requirements and presents the lowest price technically acceptable
(LPTA) proposal, as determined by the evaluation criteria herein.
Contract award will be made to the lowest evaluated price of proposals meeting or exceeding the minimum acceptability standards for non-cost factors. Proposals will be evaluated on an “acceptable” or “unacceptable” basis.
Proposals will be evaluated for acceptability, but not ranked using the non-price factors/sub-factors. In order to be considered awardable, there must be an “acceptable” rating in every non-price factor/sub-factor.
The following factors shall be used to evaluate offers:
Volume I: Factor 1 Relevant Technical Expertise:
The volume shall be organized and provide information relevant to the Offeror’s technical experience in the following areas:
Factor 1 Relevant Technical Expertise
Sub-Factor 1A: Relevant technical qualification and education
Sub-Factor 1B: Understanding the work
Sub-Factor 1A: Relevant technical qualification and education –
Minimum requirements to be acceptable:
The contractor proposal must provide for technically qualified personnel to perform the work specified in this PWS.
The offeror shall provide resumes of all proposed personnel. Resumes of proposed contract employees must reflect experience directly related to the tasks and functions stated in the PWS Part 5.0 and meet the minimum requirements listed below.
a. General Experience – The minimum experience required of the proposed contractor personnel in order to be considered "acceptable" is 4 years working with U.S. Government processes to provide necessary support to similar to the requirement stated in the solicitation.
b. The assigned personnel shall have a minimum of 2 years experience in statistical work such as calculating average, medians, percentiles, simple linear regression and graphs.
http://www.sam.gov/ http://www.sam.gov/
c. Computer skills required:
Work history of proposed personnel shall show Average literacy with the MS Office Suite applications of
Outlook, Word, and PowerPoint.
d. Proposed contractor personnel must hold a SECRET clearance.
Sub-Factor 1B: Understanding the Work.
Minimum requirements to be acceptable:
a. The proposal shall provide an overall methodology and organization structure that indicates a clear understanding of the work to be performed and the support required from the contractor organization;
b. The Quality Control Plan (QCP) shall address include all elements in the PWS and Performance
Requiremetns Summary.
Factor 2 Past Performance
1. The past performance evaluation is an assessment of the offeror’s probability of meeting the minimum past performance solicitation requirements. This assessment is based on the offeror’s record of relevant and recent past performance information that pertain to the products and/or services outlined in the solicitation requirements.
2. Past performance shall be used as an evaluation factor within the LPTA process, unless waived by the
PCO in accordance with FAR 15.304(c)(3)(iii). It shall be evaluated in accordance with FAR 15.305 and
DFARS 215.305. However, the comparative assessment in FAR 15.305(a)(2)(i) does not apply.
Therefore, past performance will be rated on an “acceptable” or “unacceptable” basis.
3. Past performance should be initially evaluated to determine whether the offeror’s present/past performance is recent, and relevant or not relevant to the effort to be acquired. The criteria to establish what is recent and relevant shall be unique to each LPTA source selection. Therefore, the solicitation shall establish the criteria for recency and relevancy in relation to the specific requirement being procured. In establishing what is relevant for the acquisition, consideration should be given to what aspects of an offeror’s contract performance history would give the most confidence that the offeror will satisfy the requirements of the contract that is contemplated to be awarded as a result of the evaluation of proposals in the current procurement.
4. Second, the past performance evaluation should determine how well the offeror performed on the prior contracts. The past performance evaluation performed in support of a current source selection does not establish, create, or change the existing record and history of the offeror’s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the offeror performed those past contracts.
5. NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see
FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered
“acceptable.”
Factor 3: Price
1. Pricing will be evaluated in accordance with FAR 12.209, Determination of Price Reasonableness and
13.106-3(a) Award and Documentation.
2. In accordance with FAR 52.217-5, all options shall be evaluated for the purpose of award. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
