52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.. The following factors shall be used to evaluate offers:

(1) Technical Factor: The Technical factor will be evaluated and rated either Acceptable or Unacceptable. In order for a quotation to be rated overall Technically Acceptable, offerors’ proposals shall demonstrate the ability to provide all the software support listed in the Equipment List/CLINs as required by this solicitation. Proposals must be received from the original equipment manufacturer (OEM) or its authorized resellers to be deemed technically acceptable. Failure to be found technically acceptable will result in the offeror being ineligible for award.

(2) Price Factor: The total evaluated price will consist of the sum of the offeror’s proposed price for all CLINs for the base period and all option periods/CLINs. Price proposals will be evaluated to determine if they are reasonable and complete. The Government reserves the right, but is not obligated, to review prices to determine whether they are so low that they reflect a lack of technical understanding, and to reject a proposal for offering unrealistically low prices.

(i) To determine completeness, the Government will verify that all solicitation requirements have been priced, figures are correctly calculated, and prices are presented in a clear and useful format.

(ii) The offeror’s price proposal will be evaluated for reasonableness in accordance with FAR 15.404.

(iii) Evaluation of option periods shall not obligate the Government to exercise such option periods.

(iv) The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.

(b) After receipt of proposals, the Government will first evaluate the lowest price proposal. If the lowest price proposal is determined to be technically acceptable and otherwise properly awardable, no further evaluations will be conducted, and award will be made. If, however, the lowest price proposal is determined to be technically unacceptable and/or otherwise not properly awardable, further evaluations will be conducted.

(c) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(d) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
