SOLICITATION/CONTRACT FORM

The required response date/time has changed from 23-May-2016 12:00 PM to 24-May-2016 12:00 PM.

The following have been modified:

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract or multiple contracts resulting from this solicitation to the responsible offeror (s) whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Partial quotes are acceptable. In the event that all requested items are not available from a single contractor, the Government reserves the right to award multiple orders in the combination that is in the best interest of the Government. Awards will be made to offerors for all the products of each OEM (7 different OEMs) using lowest price technically acceptable. To be considered, the contractor must propose all products listed for a certain OEM. The following factors shall be used to evaluate offers:

(b) Technically Acceptable Quote: The Technical Subfactors will be evaluated and rated either Acceptable or Unacceptable. The technical quote will be evaluated on the offeror's understanding of requirements and whether the quote fully meets the requirement. In order for a quote to be rated overall Technically Acceptable, ALL subfactors must be rated Acceptable. Failure to be found technically acceptable will result in the offeror being ineligible for award. The following factors shall be used to evaluate offers:

(1) Factor: Technical

Subfactor 1: Offerors shall propose all the CLINS of the solicitation or all CLINS of the OEM products. If providing a partial quote, you must provide pricing for all the CLINs associated with one OEM.

(2) Price Factor: The total evaluated price will consist of the sum of the offeror’s proposed price for all CLINs of each OEM. Price proposals will be evaluated to determine if they are reasonable and complete.

(i) To determine completeness, the Government will verify that all solicitation requirements have been priced, figures are correctly calculated, and prices are presented in a clear and useful format.

(ii) The offeror’s price proposal will be evaluated for reasonableness in accordance with FAR 15.404.

(c) After receipt of proposals, the Government will first evaluate the lowest price proposal. If the lowest price proposal is determined to be technically acceptable and otherwise properly awardable, no further evaluations will be conducted, and award will be made. If, however, the lowest price proposal is determined to be technically unacceptable and/or otherwise not properly awardable, further evaluations will be conducted.

(d) In response to this solicitation, no terms, conditions, or assumptions will be entertained. If terms, conditions, or assumptions are included in a proposal, the proposal may be excluded because it failed to comply with the solicitation instructions.

(e) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
