Justification and Approval For
Other Than Full and Open Competition
1. Contracting Agency: Defense Human Resource Activity- Procurement Support Office 4800 Mark Center Drive, Suite 07G12, Alexandria, VA 22350-1300
2. Authority Cited: 10 U.S.C.2304(c)(1), FAR 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
3. Description of Supplies and Services: The Sexual Assault Prevention and Response Office (SAPRO) requires contractor support services for the Department of Defense (DoD) Safe Helpline, the sole sexual assault response hotline for the Department that enables military readiness by providing the DoD community with specialized assistance that is flexible, supports changing technology, legal guidance, DoD policy and Directives, that inspires victims to report their sexual assault and restores survivors resilience. The objective is to provide Helpline support services to target specialized educational opportunities supporting prevention, facilitate victim care, restore resiliency, retaliation awareness and increase reporting that are flexible and responsive to changing technology, Secretary of Defense Directives, legal guidance and DoD policy and Directives.
4. Description of Action: A firm-fixed price contract is planned for with a total estimated value of . The period of performance will include a 10-month base period and two 12-month options. FY15 Operating and Maintenance (O&M) funds are available for the base period in the estimated amount of .
5. Reason for Authority Cited:
a. The DoD Safe Helpline is built on the National Sexual Assault Online Hotline platform which is proprietary to RAINN. RAINN is the sole owner of the online hotline technology and all facets of its implementation. The helpline:
Was launched in February 2011 as the result of the Defense Task Force on Sexual Assault in the Military (DTFSAMS) Recommendation 27, issued in December 2009, which endorsed the establishment of a universal hotline to facilitate victim reporting.
Provides assistance to Service member victims of sexual assault for adult Active Duty, National Guard, and Reserve Component members consistent with DoD Directive (DoDD) 6495.01 as well as Coast Guard members and Transitioning Service Members (TSM).
Provides live, secure, one-on-one, confidential, anonymous, sexual assault assistance, crisis support and referral services on a 24/7/365 worldwide basis.
Serves to increase victim reporting, as underreporting sexual assaults poses a serious challenge to military readiness with potential costs and consequences of sexual assault being extremely high.
b. All technical, operational, maintenance and support services for the Department of
Defense (DoD) Safe Helpline are currently being provided by the Rape, Abuse & Incest National Network (RAINN) under contract number H98210-13-C-0016. This requirement is for additional services which are outside of the scope of the original award to include:
Providing an option to address prior victimization by anonymous self-guided educational program via safehelpline.org.
Developing terms of service, policies, and protocol that include procedures to accept official reports of sexual assault from military members via the DoD Safe Helpline.
Provide an announcement for reporting retaliation on the safehelpline.org home page and link to the DoDIG for more information and to make a direct report, as well as a link to the military feedback form for reporting retaliation.
Enhancing the Safe Helpline website and mobile application to include providing user access to an anonymous, self-guided, educational program grounded in research and best practices.
Providing training support and execution to Safe Helpline staff; conduct additional communication outreach support services from the education program and retaliation reporting; feedback, complaint and data collection and assessment support on the Safe Helpline self-guided educational program and reporting retaliation.
c. Market research did not identify any sources other than the incumbent contractor that has the technology and capabilities to meet the full requirement. RAINN is the sole owner of the online hotline technology. Use of another source would require recreating this technology in which the Government has invested approximately $17M, and over five years and meets Government security standards. No other source can meet this requirement without delays and cost impacts that would have a major negative impact on the Department’s Safe Helpline creditability and render the Safe Helpline services ineffective in critical support of sexual assault victims.
6. Effort to Obtain Competition: RFI DHRA04152015MT1 was posted 15 April 2015 on FEDBIZOPPS.gov. As detailed in the below paragraph 8, no sources in addition the incumbent were found that could meet the full requirement. This requirement will be advertised on the FedBizOpps (www.fbo.gov) with the intent to award on a sole source basis and any interested offeror will have the opportunity to submit a capability statement for the consideration by the Government.
7. Effort to remove barriers to/increase competition: SAPRO will continue to monitor the market place to identify any new sources that may become available that can meet this requirement.
Prior to the exercise of any option periods, SAPRO will review the requirement and conduct a thorough market research analysis to ensure that any/all barriers to competition can be identified/removed so that competition can be obtained to the maximum practicable extent.
8. Market Research: Research was conducted via internet search engines, vendor websites and contact/discussion with vendors. Identification of sources was also sought via issuance of RFI DHRA04152015MT. The RFI resulted receipt and review of capability statements from QNEXIS and the incumbent, RAINN. The Government found that QNEXIS could not meet the full requirement, including the ability to provide: an option to address prior victimization on safehelpline.org and via the Safe Helpline mobile app; training support and execution to Safe Helpline staff; feedback, complaint and data collection and assessment support, and information security. RAINN has the resources to provide the full service requirement.
