2. Description of Action: (FAR 6.303-2(b)(2)) Approval is being requested for a new Indefinite Delivery, Indefinite Quantity type contract with a five year ordering period issuing Firm Fixed Price Delivery Orders.

Appropriate Fiscal Year Operations & Maintenance Funds will be used to support the requirement. The contract minimum will be $5,000 while the contract maximum will be $700,000. No incentives or other unique terms or conditions will be accounted for in this requirement.

3. Description of Supplies/Services: (FAR 6.303-2(b)(3))

Per FAR 13.501, post on FBO within 14 days after contract award, or within 30 if based on urgency (unless a 5.202 exception applies).

If citing brand name post with solicitation.

The Government has a requirement for Performance Design Lightning, Sabre, and Spectre, Optimum and Reserve Parachute Canopies and all parachute systems are outfitted with Performance Design reserves. The colors of the canopies are yellow with navy blue “SEAL”, “SWCC”, “EOD”, “DIVER”, “NAVY” or other similar customizable artwork stitched into the canopy. These parachutes have been tested by military freefall experts and are Authorized for Navy Use (ANU) and approved for the Navy Parachute Team and other related entities.

4. Authority Cited: (FAR 6.303-2(b)(4)) This sole source acquisition is being conducted under the authority of the simplified acquisition procedures for certain commercial items at 41 U.S.C. 1901, as implemented by FAR 13.501(a).

5. Reason for Authority Cited: (FAR 6.303-2(b)(5)) As outlined in NAVSEA Instruction 13512.1M, manufacturers of parachute systems are restricted by the Navy, which requires these systems to go through design safety reviews, test and evaluation, or both, to ensure parachutist safety. The Parachute ANU list for Category I: Life Support Equipment, references the company, Performance Designs as the only source approved by the Navy to manufacture these Parachute Systems. While there are authorized resellers of this product, the nature of this specific requirement requires standardization of the parachutes with custom artwork to ensure capability in performance and appearance. Given this, using a third party reseller provides an unacceptable safety risk due to past history of color and product variances from resellers which has deemed the delivered products as unusable. Given this, Performance Designs is the only company capable of providing the level of standardization required to support this specific requirement.

6. Efforts/Actions to Increase Competition: (FAR 6.303-2(b)(6)) The notice will be posted with the solicitation as it cites a brand name.

A notice will be posted within 14 days of contract award (30 if based on urgency).

7. Market Research: (FAR 6.303-2(b)(8)) Since the NSW Parachute ANU List and NAVSEAINST 13512.1M restricts what equipment can be purchased as well as which companies are authorized to provide that equipment. The Government will continue to monitor regulations and instructions to increase competition to the maximum extent practicable.
