BARE BOAT CHARTER
Statement of Work For Boat Charter
Ojbective:
Special Boat Team Twelve requires delivery of Bare Boat Charter for the period of ten and one half (10.5) days. Vessel is to be used for training purposes for up to ten (10) personnel plus supporting gear.
Requirement – Contractor Shall:
One (1) 46 Foot overall length, Fiberglass Hull, Sport fisher Vessel Type, Bertram Designer, Twin Screw, and United States Coast Guard (USCG) documented vessel.
Vessel must be equipped with Cummins QSC 8.3L Tier II engines and vessel equipment to include: safety equipment, engineering equipment, navigation, electronics, and monitoring systems.
The monitoring system must be adequately labeled to ensure proper operation.
Vessel must be capable of 18+ knots sustained speed and 350 nautical mile range and in excellent working order.
Vessel must have Furuno Global Positioning System (GPS) and Radar Units that are fully operational and include electronic charts of the local area.
Vessel must have six (6) bunk spaces in addition to sleeping areas in the salon.
Vessel must be able to be bareboat chartered without captain or crew during the required dates.
Vessel is to be delivered with a full tank of fuel to 3821 Warner Avenue, Huntington Beach, CA 92649, CA
Government will:
Returned to Contractor the Vessel with a full tank of fuel.
Deliverable: One (1) 46’ Charter Vessel for ten and one half (10.5) day.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

Alternate II (Dec 2010). As prescribed in 12.301(b)(4)(ii), substitute the following paragraphs (d)(1) and (e)(1) for paragraphs (d)(1) and (e)(1) of the basic clause as follows:
(d)
(1) The Comptroller General of the United States, an appropriate Inspector General appointed under section 3 or 8G of the Inspector General Act of 1978 (5 U.S.C. App.), or an authorized representative of either of the foregoing officials shall have access to and right to—
(i) Examine any of the Contractor’s or any subcontractors’ records that pertain to, and involve transactions relating to, this contract; and
(ii) Interview any officer or employee regarding such transactions.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), and (c), of this clause, the Contractor is not required to flow down any FAR clause in a subcontract for commercial items, other than—
(i) Paragraph (d) of this clause. This paragraph flows down to all subcontracts, except the authority of the Inspector General under paragraph (d)(1)(ii) does not flow down; and
(ii) Those clauses listed in this paragraph (e)(1). Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

SOFARS CLAUSES
SUBPART 5632.70 – ELECTRONIC SUBMISSION AND PROCESSING OF PAYMENT REQUESTS AND RECEIVING REPORTS (Revised May 2010)
5632.7002 Policy.
In compliance with 10 U.S.C. 2227, contractors shall submit payment requests and receiving reports in electronic form except as defined in DFARS 232.70.

5632.7004 Contract clauses.
(Revised September 2011) In accordance with DFARS 232.7004, contracting officers shall insert the DFARS clause 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports, in solicitations and contracts.
Contracting officers may insert a clause substantially the same as 5652.232.9003, Instructions to Paying Offices, in solicitations and contracts when Wide Area Work Flow (WAWF) is not the method for processing receipt and payment. When WAWF is not utilized, the Contracting Officer must document and coordinate an alternative method of payment to WAWF that is mutually agreed upon in accordance with DFARS 232.7003(b) with the contractor, administrative contracting office, and the payment/disbursing office.
Contract officers shall insert a clause substantially the same as 5652.232-9006, Electronic Distribution of Vouchers/Invoices Using Alternative to WAWF, in solicitations and contracts when an electronic alternative method of payment to WAWF is mutually agreed upon in accordance with DFARS 232.7003(b). Contracting officers may add or delete addresses based on the individual acquisition requirements. RAO and COR information should not be included in the solicitation. The Contracting Officer may designate RAO or COR by appointment letter after award.
When WAWF or other electronic alternatives are not feasible (reference DFARS 232.7002(c)), contract officers shall insert a clause substantially the same as 5652.232-9007, Manual Distribution of Vouchers/Invoices, in solicitations and contracts Contracting officers may add or delete addresses based on the individual acquisition requirements. Contract Completion Cost Voucher (Final Cost Voucher) and associated contract closing document(s) shall be sent to the electronic address of the DCMA office or other office administering the contract. If contract has been assigned to DCMA, insert the electronic address of the ACO. If not assigned to DCMA, insert electronic address of the Contracting Officer administering the contract. The Contracting Officer will provide copies of the final voucher and associated documentation along with request for audit electronically to the cognizant DCAA office.
When submitting payment requests electronically, the contractor is not required to submit multiple copies of vouchers/invoices to a single electronic address.
Alternate I: For use when the government purchase card is the authorized method of payment. Substitute the following paragraph (a) for paragraphs (a) and (b) of the basic clause.
The contractor shall simultaneously forward invoices as called for in the contract to the following government representatives at the address(s) provided upon contract award:
